초록

본 논문은 2022년 경찰제도개선 논의 과정에서 경찰의 중립성과 민주적 통제라는핵심 가치를 둘러싼 정책 형성 과정을 분석한다. 기존 연구가 경찰국 설치 등을 둘러싼찬반 논리 중심이라면, 본 연구는 다양한 주체들의 참여를 시기별로 정리하여 논의의쟁점을 규명하고, 향후 경찰개혁 방향에 대한 시사점을 제시하고자 한다.
행정안전부는 경찰의 중립성 침해라는 비판에도 신속하게 민간 중심 자문위원회를구성하여 정책의 방향을 설정하고, 관계 법령 개정을 완료하는 등 제도개선을 속도감있게 추진한다. 반면, 경찰청은 지휘부 교체시기의 불확정성으로 소극적 자세로 일관하여, 내부 동력을 결집하지 못하고 정책 형성과정에서 주도적인 역할을 수행하지 못했다.
2022년 경찰제도개선 논의는 민주적 절차 부족 및 다양한 주체 간 의견 충돌과 협력부재라는 문제점을 드러냈다. 향후 경찰개혁 논의는 정책 결정의 민주적 절차 확보 및다양한 주체의 참여를 보장하는 숙의의 장에서 진행되어야 할 것이다.

영어초록

This paper analyzes the policy formation process surrounding the core values of political neutrality and democratic control of the police, focusing on the 2022 police system reform discourse. While previous studies have centered on legal issues or arguments for and against the establishment of a police bureau, this study aims to identify the issues in dispute and suggest directions for future police reform by organizing the participation of various actors, such as the Ministry of the Interior and Safety, the National Police Agency, and field police officers, by period.
To this end, the study examines the flow and characteristics of the discourse for each period, classifying it into the following stages: discussions by the Police System Reform Advisory Committee, the Ministry of the Interior and Safety Minister's acceptance of recommendations, the legislative notice, and the launch of the police bureau and subsequent discussions.
Despite controversies over legal violations and infringement of police neutrality, the Ministry of the Interior and Safety rapidly promoted the reform by establishing a private-led advisory committee to set the policy direction and completing the revision of relevant laws and regulations. On the other hand, the National Police Agency maintained a passive stance due to the uncertainty of the leadership transition period, failing to gather internal momentum and play a leading role in the policy formation process. The 2022 police system reform discourse revealed problems such as a lack of democratic procedures and conflicts and lack of cooperation among various actors. Future police reform discussions should be conducted in a deliberative arena that ensures democratic procedures for policy decisions and guarantees the participation of various actors.
