부동산등기상의 주체의 진정성 확보 방안 연구 (A Study on Ways to Ensure Authenticity of Principal in Real Estate Registration)

초록

부동산등기에서의 본인확인은 부실등기방지라는 측면에서 직접적으로는 등기 주체의 진정성과 간접적으로 등기 내용의 진정성을 강화시켜서 부동산거래안전을 확보하기 위한 중요한 사항이다.
등기의 주체의 진정성 확보를 위한 개선방법은 현행 인감제도를 활용하는 것이다. 다만, 인감증명서상의 홀로그램(Holigram)의 위치를 이동하거나 없애거나, 지문인식시스템 개선 및 등기신청에서 전자지문 활용시에 행정자치부의 지문인식시스템상의 정보를 활용할 수 있도록 하는 것이 필요하다. 이에 더하여 첫째, 등기관에 의해 정리된 인감증명서에 있는 정보와 신청서에 있는 정보 중 대조하여야 할 사항이 인감증명서상에 표준바코드에 탑재하여 등기시스템에서 인감증명정보와 신청정보를 자동대조하는 검증체계를 구축하는 것도 구상할 수 있다. 특히 대리인에 의한 등기신청의 경우를 대비하여 현행 부동산 등기신청서의 양식에 관한 예규상의 위임장 서식을 일부 변경하여 부동산의 표시, 등기원인과 그 연월일, 등기의 목적 외에 대리인의 인적 사항을 기재하게 하는 방안도 구상할 수 있다.
이 밖에 공증제도는 공정증서의 작성방식에 한정되어야 하여서 운영되어야 한다. 그리고 자격자대리인을 통한 본인확인 강화를 위한 다양한 제도 개선이 필요하다.

Identification in real estate registration is important to ensure safe real estate transactions, as it strengthens the authenticity of the principal and content of registration, thereby preventing incomplete registration.
One of the ways to ensure the authenticity of the principal of registration is to use the current seal impression system. To this end, it is necessary that the hologram on a seal impression certificate is removed or printed on other areas of the certificate, or that the information contained in the fingerprint recognition system of the Ministry of the Interior and Safety is allowed to be utilized when such system is improved or digital fingerprints are used for registration application.
Another possible measure is to establish a verification system where information in seal impression certificates arranged by registration officers is automatically compared with information in applications in the registration system, with matters subject to comparison among both information stored in standard bar codes on seal impression certificates.
Furthermore, for a registration application filed by an agent, a change can be made to the form of an authorization letter under the established rules concerning the current format of an application for registering real estate so that personal information regarding the agent is entered in such form in addition to indication of real estate, the grounds and date for registration, and the purpose of registration.
On top of that, the notarial system should be operated only for the method of preparing notarial deeds, and various institutional improvements are required for a more thorough identification through an eligible agent.
