등기제도의 문제점과 개선방안에 관한 연구 (A Study on the Issues in and Improvement Strategies for Real Estate Registration System)

초록

현재 우리나라에서 부동산 등기를 신청한 건수가 연 800만여건을 훨씬 넘고 있다. 이는 부동산 등기가 전국민의 초관심 분야로 부상했다는 것을 보여준다. 부동산 거래가 국민 경제의 한 축을 담당하는 현실에서 등기제도로 인한 문제점들이 끊임없이 제기되고 있으니, 부동산 등기제도의 정비가 시급한 과제라 아니할 수 없다.
부동산 등기제도는 국민의 재산권과 안정된 경제생활을 보장하는 지름길이다. 이 제도의 근본 취지는 실체적 물권변동을 정확하고 신속하게 공시함으로써 원활한 부동산 거래에 이바지하는 것이다. 그런 목적으로 세워진 등기제도의 생명은 안전성과 신속성을 바탕으로 국민의 신뢰를 높이는 데 있다.
그러나 부동산 수요가 급증함에 따라 부동산 투기로 인한 세금포탈 현상이 발생하고, 등기 실무제도의 문제점으로 인해 부실등기나 허위등기 등의 문제점들이 드러나고 있는 실정이다. 심지어 부동산 거래와 관련한 소송도 그치지 않는다. 예컨대, 등기제도의 문제점으로 인해 불거진 부동산 소유권이전등기말소 사건은 대표적인 사례라 할 수 있다. 이 사건에서 교회 부동산에 대한 소유권이전등기의 적법성 여부를 놓고 다툼을 촉발시킨 요인은 등기제도의 문제점이었다. 현행 등기제도에서 등기 공무원이 시행하고 있는 형식적인 심사는 부실등기의 요인이 될 수 밖에 없다.
특히 교회 부동산 등기 과정에서 적법한 절차에 따른 대표자의 신청을 거부하고, 이미 정당한 절차에 의해 자격을 상실한 대표자의 등기를 인정한 것은 등기관의 심사과정이 형식에 불과했기 때문이었다. 그로 인하여 나중에는 민법과 교회법을 위반한 채 개정한 불법 정관에 의해 교회 부동산을 매매하게 되어 법정 다툼으로 비화되었다. 결국 등기제도의 문제점으로 인해 불거진 부동산 소유권이전등기말소사건이 대법원 확정판결에 의해 교회 부동산이 제삼자의 명의로 등기되면서 사회적 파문이 일어났다. 그로 인하여 소송 당사자들이 당한 재산상의 손실이나 정신적 부담, 에너지 손실 등의 피해는 누가 보상할 것인가? 이와같은 사례를 교훈삼아 본 연구는 현행 등기제도에 드러난 문제점을 검토하였다. 동시에 우리 등기제도에서 오랫동안 쟁점이 되고 있는 등기 공신력과 관련하여 그것을 인정하기 위한 전제 조건으로써 등기관의 형식적 심사를 실질적 심사로 변경하는 방안을 모색하였다. 더 나아가 등기제도와 관련한 각종 개선방안들을 제안하였다.

영어초록

Currently, more than 8 million applications are received every year for real estate registration in Korea, indicating how real estate registration has emerged as a pressing issue warranting immediate attention to ensure a smooth process of registration. There is an urgent need to overhaul the registration system since real estate transactions serve as one of the most important aspects of the economy for many households within the country, and the issues plaguing the system need to be rectified.
The real estate registration system serves as a shortcut to guarantee property rights and a stable economic livelihood for many people in the country. The registration system is intended to facilitate real estate transactions by prompt and accurate disclosure of any change in real rights. Improving public trust through secure and speedy processes is one of the most important challenges that need to be addressed in reforming the real estate registration system.
However, with the rapidly growing demand for real estate, tax evasion cases have emerged from real estate speculation, and problems with the registration system have led to invalid or false registrations. Furthermore, real estate transactions have led to the filing of several lawsuits. A typical example of the flaws within the registration system pertains to the case of the expungement of the real estate registry. In this case, it was a problem with the registration system that sparked a dispute over the legitimacy of the transfer of ownership of a church property. The formality-based review conducted by the registrar under the current real estate registration system is a factor that contributes to invalid registrations.
In particular As revealed in this case, the review process was nothing but a mere formality, whereby an application by the eligible representative who followed the due process of registering the church real estate was rejected, and instead the registration of the ineligible representative was accepted. Consequently, the church real estate was later sold on the basis of illegal articles of association, thereby violating civil law and canon law; this resulted in a lawsuit.
In this case of expungement of registration of ownership transfer, caused by the problems with the real estate registration system, the church real estate was registered in the name of a third party based on a Supreme Court decision, which caused a social scandal, as the chapel that had been used by the mainstream orthodox church for decades was handed over to some heresy. The question was, Who would compensate for all the damages caused to the litigants, such as property loss, mental stress, or wasted energy? Drawing lessons from such cases, this study examined the shortcomings evident in the current registration system. Simultaneously, in relation to the long-standing controversy in our registration system, we aimed to change formality-based reviews by the registrar to substance-based reviews as a prerequisite to establishing public trust in the registration system. Furthermore, we proposed various improvements to the registration system.
