계파의 집단 극단화를 통한 정치적 양극화: 계파 공천(20·19대)과 19대 국회 입법 갈등 사례 (Political Polarization through Partisanship of Group Polarization Cases on Nomination by the Partisanship in 20th·19th of General Elections and 19th National Assembly Legislation Conflicts)

초록

19대 국회는 동물 국회를 막기 위한 「국회선진화법」을 만들었지만 그것으로 인해 여야가 아무것도 입법할 수 없는 또 다른 수준의 대립과 갈등인 ‘식물 국회’를만들어 냈다. 그렇다면 도대체 「국회선진화법」을 무력화하면서 ‘식물 국회’를 만들어 낸 원인은 무엇일까? 그 해답의 실마리는 19대 국회의 대립 구도에는 항상적으로 ‘친노’와 ‘비노’ 혹은 ‘친박’과 ‘비박’과 같은 정당을 지배하고 있는 계파들의 힘이 작동하고 있었다는 것을 볼 때, 계파와 계파 정치에서 찾을 필요가 있다.
본 글의 목적은 계파 공천과 정치적 양극화와의 상관성을 ‘집단 극단화’를 통해이론적으로 논의하는 한편, 20대와 19대 총선에서의 계파 공천의 현황과 19대국회에서 발생했던 입법 갈등 사례(세월호 특별법의 입법 과정에서의 계파 갈등, 행정 위임 입법을 견제하기 위한 국회법 개정에서의 계파 갈등)를 분석하여 그시사점을 찾고자 한다. 특히, 본 글에서는 정당과 국회를 사실상 지배하고 있는계파들의 집단행동의 논리인 ‘집단 극단화(group polarization)’를 매개로 계파공천과 정치적 양극화가 서로 연결된다는 것을 이론적으로, 그리고 경험적 사례로 살펴본다. 또한 20대 국회가 계파들의 ‘집단 극단화’에 따른 정치적 양극화에서 벗어나기 위한 대안적 패러다임으로 ‘협치와 민생을 위한 중도 정치’를 제시하고 이것을 구현할 수 있도록 하는 과제로 오픈프라이머리 법제화, 견제와 균형을 위한 숙의 문화 활성화 등을 제언한다.

19th Congress made the “Advanced Parliament Act” to prevent the ‘animal parliament. But “Advanced Parliament Act” created the ‘plants parliament’ anything that can not be legislation with the ruling party and the opposition can not be anything other legislative level of confrontation and conflict. so, hell would neutralize any cause, “Advanced Parliament Act” and created the ‘plants parliament’ ? clue to the answer is, considering factions working same as ‘pro-Roh Moo Hyun faction’ and ‘non-Roh Moo Hyun faction’ or ‘pro-Park Geun hye faction’ and ‘non-Park Geun hye faction’, with confrontation of in the 19th National Assembly, that it is necessary to find in partisanship politics and factions. the purpose of this article, the theoretical discussion through a “group polarization” the correlation between ‘faction nomination’ and ‘political polarization’. and, the purpose of this article is to analyze the status of the faction nominations in 20th and 19th for the general election and cases of conflict(factional conflict in the legislative process of special law on ‘Sewolho issue’, factional conflict in the legislative process of the National Assembly operating laws revision to counterbalance the administration delegated legislation) in the 19th Legislative Assembly and is to find its implications. in particular, this article will discuss theoretical and empirical case that virtually dominated the political parties and the National Assembly and ‘group polarization’(the logic of the collective behavior of 200 　동향과 전망 99호faction) is the mediated nomination factional and political polarization that connect to each other. also this paper, we present the 20th Parliament to ‘moderation politics’ and ‘governance for the people’s livelihood’ as an alternative paradigm to escape from the political polarization of the “group polarization” of the faction. in addition to the challenge to implement this, and suggestions such as ‘open primary legislation’, ‘check and balance for the deliberative culture’ enabled.
