중국의 대(對)한국 산업스파이 범죄의 현황과 대책 (Current Situation and Countermeasures of Korean Industrial Spy Crime in China)

초록

중국 산업스파이 범죄는 외교관이나 유학생, 교수나 연구원, 주재원이나 기업인, 기자 등 각종 신분으로 위장한 중국 산업스파이나 고정간첩이 우리나라의 기업이나 대학, 연구소에 침투하여 인재 빼가기와인수합병, 해킹 및 스파이 범죄활동 등의 각종 방법을 동원하여 우리나라의 국가 핵심기술이나 첨단기술을 훔치고 복제하고 있다. 이러한 중국 산업스파이 범죄는 우리나라의 주요 분야 경제 리더십을 약탈하고 산업전반에서 우리나라 첨단기술의 역량을 위협하고 있다. 그러나 우리정부의 적절하고 마땅한 노력과 조치는 부족한 편이다. 지금까지 중국의 해외 고급우수 인재의 유치정책과 산업스파이 활동과 경찰과탐정의 역할, 중국의 사이버 산업스파이 활동 분석과 규범적 대응방안에 대한 연구는 있었지만 중국 산업스파이 범죄의 현황과 대책에 관한 연구는 없었으며 미비하였다. 따라서 이번 연구는 중국 산업스파이범죄의 개념과 원인, 활동 근거를 먼저 살펴보고 중국 산업스파이 범죄의 현황과 산업스파이 단속 및 사법현실, 중국 산업스파이 침투 및 공작 수법을 분석하여 중국 산업스파이 범죄에 대한 효과적인 대책을제시하였다. 중국 산업스파이 범죄를 미연에 방지하며 효과적이고 적절한 대응책을 제시하여 우리나라의경제안보를 지키고 국가경쟁력을 위협하는 범죄를 예방하는 측면에서 중요한 의미를 갖는다. 중국 산업스파이 범죄를 예방하기 위해서는 정부는 물론 국민들의 지속적인 관심이 필요하며 진화하는 중국정부의해외 우수인력 유치 전략과 중국 산업스파이의 침투방법과 범죄수법을 체계적으로 연구하고 분석하여 대응할 수 있는 전문연구 인력의 양성이 필요하다. 또한 국민들로 하여금 중국 산업스파이 범죄에 대한 경각심을 갖게 하며 중국 산업스파이 범죄에 대한 위험성과 폐해를 제대로 환기할 필요가 있다.

영어초록

Chinese industrial spies or fixed spies disguised as diplomats, international students, professors, researchers, expatriates, businessmen, and journalists are infiltrating Korean companies, universities, and research institutes. It steals and reproduces Korea's core or high-tech technologies by mobilizing various methods such as human resources deprivation, mergers and acquisitions, hacking, and espionage criminal activities. Such industrial espionage crimes in China loot Korea's economic leadership in major fields and threaten Korea's high-tech capabilities throughout the industry. But our government's appropriate and proper efforts and measures are lacking. Until now, there have been studies on China's policy to attract high-quality overseas talent, the role of industrial espionage activities, police and detectives, and China's cyber industry spy activities and normative countermeasures, but there have been no studies on the current status and countermeasures of Chinese industrial spy crimes. Therefore, this study first examined the concept, cause and basis of activities of Chinese industrial spy crimes and analyzed the current status of Chinese industrial spy crimes, industrial spy crackdown and judicial reality, Infiltration of Chinese Industrial Spies and Work Methods and suggested effective measures against Chinese industrial spy crimes. It has important significance in terms of protecting Korea's economic security and preventing crimes that threaten national competitiveness by presenting effective and appropriate countermeasures to prevent Chinese industrial espionage crimes in advance. In order to prevent Chinese industrial espionage crimes, the government as well as the people need constant attention. It is necessary to cultivate professional research personnel who can systematically study, analyze, and respond to the evolving Chinese government's strategy to attract excellent overseas manpower, and the penetration method and criminal method of Chinese industrial spies. It is also necessary to alert the public to Chinese industrial espionage crimes and properly remind the public of the dangers and evils of Chinese industrial espionage crimes.
