국가특성과 다국적기업 조세회피의 관계 분석 (The Effects of Country Characteristics on Tax Avoidance of Multinational Corporations)

초록

[연구목적]본 연구는 투자자보호수준과 납세환경수준이라는 두 국가 특성이 다국적기업의 조세회피에 미치는 영향을 분석하였다. 구체적으로 투자자보호수준 및 납세환경수준이 높은 국가에 소재한 다국적기업이 조세회피를 더욱 적극적으로 수행하는지 또는 소극적으로 가담하는지 여부를 검증하여 국가 특성이 다국적기업의 조세회피 의사결정에 미치는 영향을 확인하였다.
[연구방법]분석을 위해 Orbis Database에서 확보한 전세계 다국적기업의 2009－2015년도 그룹－연도 표본을 이용하여 다국적기업의 조세회피를 측정하였으며, World Bank Group의 Doing Business에서 수집한 투자자보호수준 및 납세환경수준 대용치를 이용하여 회귀분석을 실시하였다.
[연구결과]분석 결과, 투자자보호수준이 높은 국가에 소재한 다국적기업일수록 조세회피 수준이 낮은 것으로 확인되었다. 이는 투자자보호수준이 높은 국가일수록 공격적 조세회피 행위의 적발에 따른 명성비용이 높아 조세회피가 억제됨을 의미한다. 한편, 납세환경수준이 높은 국가에 소재한 다국적기업일수록 조세회피 수준이 더 높은 것으로 확인되었다. 이는 납세환경수준이 높은 국가에 모기업을 둔 다국적기업은 모기업 국가의 정교한 조세시스템을 피해 자회사에서 보다 공격적으로 조세회피를 수행하기 때문으로 설명된다.
[연구의 시사점]본 연구는 다국적 기업의 의사결정에 미치는 국가특성을 확인하였다는 점, 효과적인 조세회피 억제를 위한 정책적 시사점을 제시하였다는 점에서 공헌점을 가진다.

영어초록

[Purpose]This study examines the effects of country characteristics of investor protection and tax environment on tax avoidance of multinational corporations. Specifically, the present study investigates whether the level of investor protection and that of tax environment of the resident countries of multinational corporations promote or suppress their tax avoidance behavior.
[Methodology]This study conducts a regression analysis using a group－level sample of observations obtained from Orbis Database for the period of 2009－2015, and proxies for investor protection and tax environment collected from World Bank Group’s Doing Business.
[Findings]The results of the analysis show that the groups of multinational corporations located in countries with the higher level of investor protection index tend to engaged in tax avoidance activities to a lesser extent than those located in countries with the lower level of investor protection index. These results indicate that the higher level of investor protection index incurs the higher reputational costs for aggressive tax avoidance of multinational corporations. On the contrary, it is observed that multinational corporations located in countries with the higher level of tax environment index involve in tax avoidance to a greater extent than those located in countries with poor tax environment index. This study identifies that multinational corporations headquartered in countries with the higher level of tax environment index attempt to conduct aggressive tax avoidance strategies through overseas affiliates located around the world.
[Implications]This study contributes in identifying the national characteristics which influence the decision－making of multinational corporations. It also contributes in addressing effective policy measures to control for aggressive tax avoidance of multinational corporations.
