다문화가족지원법의 문제점과 개선방안 (Problems and improvements of the Multicultural Families Support Act)

초록

우리 사회가 외국인근로자, 결혼이민자 등에 대하여 개방정책을 적극적으로 취함에 따라 국내체류외국인이 급증하였다. 이에 따라 다문화가족지원법이 마련되었다. 그러나 다문화가족지원법은 주로 결혼이민자를 대상으로 한 법이라는 점에서 한계를 갖는다.
대한민국헌법이 문화적 다양성을 지향하고 있음은 헌법규정으로 볼 때 명백하다. 그 단적인 예가 평등권 및 평등원칙을 규정하고 있는 헌법 제11조다. 제11조 제2문은 “누구든지 성별･종교 또는 사회적 신분에 의하여 정치적･경제적･사회적･문화적 생활의 모든 영역에 있어서 차별을 받지 아니한다.”라고 규정하고 있기 때문이다. 여기서의 성별, 종교, 사회적 신분 등은 하나의 예시에 불과한 것으로 이해된다. 따라서 모든 문화적 징표에 따른 어떠한 부당한 차별도 헌법적으로는 용인되지 않는다. 따라서 국내에 체류하는 외국인의 문화적 정체성을 존중하는 것이 헌법의 정신이다.
그런데 다른 한편 헌법은 매우 민족주의적인 경향을 띠기도 한다. 헌법전문은 우리나라의 유구한 역사와 전통 그리고 3･1 독립정신을 계승함을 선언하고 있고, 헌법 제9조에서는 국가는 전통문화의 계승･발전과 민족문화의 창달에 노력하여야 한다고 규정하고 있으며, 제69조에서는 대통령에 대해 민족문화의 창달에 노력할 의무를 부과하고 있다. 따라서 문화적 다양성이라고 하더라도 대한민국헌법이 지향하고 있는 문화적 정체성이 훼손되지 않는 범위 내에서 존중될 필요가 있다.
이러한 헌법적 한계 내에서 이 논문은 다문화정책의 지속가능성의 보장을 위하여 우선 다문화가족지원법의 헌법적 근거를 명확히 하고자 하였다. 그리고 그에 따라 다문화정책의 헌법적 지도원리를 도출하고자 하였다. 나아가서 구체적으로는 현행 다문화가족지원법이 갖는 다양한 문제점들에 대해 분석하고 그에 대한 개선방안을 모색하고 있다. 다문화가족지원법이 갖는 다양한 문제점들을 체계적으로 설명하기 위해 법체계적 관점과 법 정책적 관점으로 나누어 살펴보고 있다. 그리고 최근에 다행스럽게도 그 동안 지적된 많은 문제점들을 일부 보완한 전부개정안이 제출되어 있는 바 이에 대해서도 간략하게 검토하면서 결론을 맺고 있다.

영어초록

The number of foreigners residing in Korea has increased rapidly as Korean society actively adopts open policies for foreign workers and marriage immigrants. Accordingly, the Multicultural Families Support Act was adopted. However, the Multicultural Families Support Act has limitations in that it is primarily intended for marriage immigrants.
It is clear from the constitutional provisions that the Korean Constitution aims for cultural diversity. A simple example is Article 11 of the Constitution, which stipulates equal rights and principles of equality. This is because the second sentence of Article 11 stipulates that “anyone shall not be discriminated against in all areas of political, economic, social and cultural life based on gender, religion or social status.” It is understood that gender, religion, and social status here are just only examples. Therefore, any irrational discrimination based on any cultural sign is constitutionally unacceptable. Therefore, it is the very spirit of the constitution to respect the cultural identity of foreigners residing in Korea.
On the other hand, however, the constitution also tends to be very nationalistic. The preamble to the Constitution declares that we will inherit the long history and tradition of our country and the spirit of independence of March 1, and Article 9 of the Constitution declares that the state should strive to inherit and develop traditional culture and to promote national culture, Article 69 imposes an obligation on the President to endeavor to promote national culture. Therefore, cultural diversity needs to be respected to the extent that the cultural identity aimed at by the Korean Constitution is not damaged.
Within these constitutional limits, for the first time, this thesis attempted to clarify the constitutional basis of the Multicultural Families Support Act to ensure the sustainability of multicultural policies. And consequently, it tried to derive the constitutional guiding principles for the making multicultural policies. Furthermore, it analyzes various problems of the current Multicultural Families Support Act and seeks lots of ways to improve them. In order to systematically explain the various problems of the Multicultural Families Support Act, it is divided into a legal system perspective and a legal policy perspective. And, fortunately recently, a whole amendment of the Multicultural Families Support Act with the name of Migrant Families Support Act has been submitted to the National Assembly that partially complemented many of the problems pointed out so far. This is also briefly reviewed and concluded.
