다단계판매 규제 및 개선방안에 관한 연구 (A Study on Multi-Level Marketing Restraints and Improvement Plans)

초록

2012년 2월 17일 방문판매법에서 소비자요건의 삭제와 소매이익의 완화로 다단계판매의 개념을 넓힘으로써 많은 업체가 다단계판매업체가 되어 사전적 규제의 대상이 된것은 유통시장의 건전화의 측면에서 긍정적인 효과가 있다. 특히 후원방문판매는 현재소비자에 대한 피해가 크거나 행정규제 위반 정도가 큰 행태가 보이지 않는 점, 후원수당 1단계의 사행성이 크지 않는 점 등을 고려하여 후원방문판매로 다단계판매와 달리규정한 것은 타당하다고 생각된다.
그러나 다단계판매원의 보호라는 제도의 취지, 비용의 문제 등을 고려할 때 다단계판매원 등록증, 다단계판매원의 수첩을 전자문서로 가능하게 하는 것으로 규제를 완화할필요는 있다고 본다. 특히 현행 정보 공개 제도에 있어서 행정규칙으로 공개 정보 범위를 정할 수 있게 한 것은 법률상 근거 없이 다단계판매업자의 경영상 비밀과 다단계판매원의 개인정보의 침해한 것이다. 공개되는 정보의 내용에 관하여는 법령에 명시적으로 규정되어야 한다. 또한소비자 등이 공정거래위원회에 침해정지를 요청하는 제도는현재 특별히 활용되지 않고 있는 점, 신고와 다르지 않는 점, 소비자 침해 구제의 즉시성을 위하여 법원을 대상으로 하여 금지를 구하는 제도로 변경하는 것이 타당하다. 그적용대상 행위는 제24조의 사행적 판매원 확장행위 등의 금지에 위반한 행위에 한정해야 한다. 또 다른 문제점으로는 현행방문판매법 제22조 제1항의 재화구매 등 일정 수준이상의 부담부과행위와 제24조 제1항 제4호의 가입비 등의 금품징수 등 의무부과행위가 구별되기 어려운 점, 처벌수위의 불균형을 개선할 필요가 있다고 본다. 다단계판매유통시장의 양적 질적 변화와 함께 사전적 규제의 효율성을 확보하고 형사처벌규정의명확성을 위해서 방문판매법의 일부 규정은 개정되어야 한다고 생각한다.

영어초록

On February 17, 2012, by eliminating consumer requirements and easing retail profits, expanding the concept of multi-level marketing, many companies became multilevel marketing sellers and became subject to prior restraints and it had a positive effect in terms of the restoration of the distribution market. Especially, considering that the door-to-door sales under sponsorship are not affecting a large damage to the consumers, not violating the administrative restraints that much, and the fact that the first stage of the sponsorship allowance is not large, it is reasonable to state that door-to-door sales under sponsorship is different from multi-level marketing.
However, considering the purpose of the system of protection of multi-level marketing salespersons and the problem of costs, it is necessary to relax restraints by making a multi-level marketing salesperson registration card and a pocketbook for multi-level marketing salespersons possible by electronic document. Especially, in the current information disclosure system, the restriction of public information just by administrative rules violates the business secrets of a multi-level marketing business entity and the personal information of multi-level marketing salespersons without enough legal grounds.
The content of the information to be disclosed must be specified explicitly in the legislation. In addition, the system for request for cessation of violation against consumers to Fair Trade Commission is currently not used, not so much different from the report, and for the promptness of consumer infringement relief, it is reasonable to change the system to a new system for seeking a prohibition on a court. The applicable action should be limited to the act in violation of Prohibition of Speculative Expansion of Sales Force in Article 24. Another problem is that it is difficult to differentiate between the imposition of overburdened charges such as the purchase of goods in Article 22, Paragraph 1 of the current Act on Door-to-Door Sales and the imposition of obligations such as the collection of money such as the entry fee of Article 24 Clause 1. In addition, it is necessary to improve the current imbalance of a punishment level. Along with the quantitative and qualitative changes in the multi-level marketing distribution market revised, in order to secure the efficiency of the pre-restraints and to clarify the criminal penalty provisions, some provisions of the Act on Door-to-Door Sales should be revised.
