초록

오랜 역사를 가지고 있는 고려대학교 법학연구원 학술지에 2012년 10월 현재까지 약 53편의 노동법관련 논문이 게재되었다. 필자의 대부분은 고려대학교 법과대학 및 법학전문대학원에 재직하였거나 재직 중인 교수들이지만, 최근에는 본교에 재직하고 있지 않은 연구자들의 투고도 점차 늘고 있다. 고려법학은 노동법학 분야에 관하여 고려대학교만의 고유한 학풍과 경향을 상대적으로 명확히 보여주고 있다.
고려법학이 보여준 노동법학의 가장 큰 특징은 전체 법질서의 조화적ㆍ유기적 관계 하에서 근로자보호를 실현할 뿐 아니라 바람직한 근로관계 질서의 형성을 도모하는데 중점을 두고 있으며, 나아가 현대적 노동질서의 방향과 논점을 제공하고 있다는데 있다. 특히 노동법도 전체 私法秩序의 범주에서 私法의 수정과 보완관계를 통해 노동법의 이론을 발전시키고 있다는 점, 헌법의 객관적 가치질서의 내용을 구체화하여 해석론의 준거로 제시함으로써 해석의 타당성을 견지하고 있다는 점 그리고 종래 일본 노동법 일변도의 비교법 연구에서 독일 노동법의 역사와 이론 그리고 실무를 직접 연구대상으로 삼아 노동법 연구의 이론적 다양성과 깊이를 더해주고 있다는 점을 그 기본적 방법론으로 삼고 있다고 할 수 있다.
나아가 노동법을 이념적, 계급적 틀에 가두지 않고 전체 법질서의 유기적 관련성을 고려하여 체계적 해석을 시도하고 그에 터잡아 이론과 실무의 조화를 도모하고 있다는 점도 고려법학이 이룩한 노동법학의 가장 큰 특징이라고 할 수 있다.
본고는 이와 같은 특징을 고려하여 노동법학 방법론과 노동법체계의 관점에서 새로운 이슈를 제시한 논문과 노동법의 새로운 과제영역을 던진 논문 그리고 비교법적 관점에서 새로운 쟁점과 논리를 제시하는 논문들을 중심으로 우리나라 노동법학을 위하여 고려법학이 이뤄낸 성과를 반추하고 있다.

영어초록

The journal of the Korea University Legal Research Institute which first launched as Law Journal(법학논집) in 1958 has carried about 53 articles in the field of labor law by October 2012. Most of the authors are from law department of Korea University or Korea School of Law, however increasing number of articles are being submitted by researchers from outside of the institute.
Legal researches appeared in Korea University Law Review focus on establishing order of labor relationship as well as realizing protection of workers in the cooperative and organic relation with the whole order of law suggesting directions and issues regarding modern labor order. Particularly, they have pointed out that labor law has been developed through amendment and complement of principles of private law and they regarded constitutional objective order of values as standard of interpretation. Also contrary to the previous tendency of concentrating on comparative studies with Japanese labor law, the history, theories and practices of German labor law began to be dealt with to extend diversity and depth of research on labor law.
This article attempted to ruminate the success Korea University Law Review has been deriving for legal studies on Korean labor law based on articles that presented methodology, new issues in regard to labor law system, original research subjects, new logic in the perspective of international comparison.
The most notable characteristic of legal studies on labor law presented in Korea University Law Review is that they tried to systemically interpret the laws considering the order of laws as a whole instead of restricting labor law to ideologies and classism in order to harmonize theories and practices. This especially stands out as the academic tradition of Korea University Law Review since 1960, when legal studies on labor law were at a primary stage in Korea. Korea University Law Review has considerably contributed to academic development by pursuing normative integrity in interpretation, focusing on presenting reasonable policies based on constitutional objective order of values and professionally conducting comparative legal studies between Korea and foreign countries including Germany. It is expected that the methodology developed by Korea University Law Review lasts and advances to be established as academic traditions of Korea University Law Review.
