초록

인류사회 생산력의 비약적인 발전, 과학기술의 급속한 진보, 지식경제의 번영 및 글로벌화의 도래 등으로 초국경적 환경오염은 이미 오랜 전에 인류사회를 위협하는 난제가 되어 있다. 초국경적 환경오염에는 다양한 내용들이 포함되어 있는바 그중 초미세먼지는 최근 몇 년간 사람들이 주목하는 대상이 되어있다. 초미세먼지로 인한 피해는 특정 국가의 내부에 국한되는 것이 아니며 일찍부터 다른 나라의 환경까지 위협하는 심각한 상황이다. 법적 측면에서 초국경적 환경오염침해구제에 대해 그동안 줄곧 국제공법 분야에서 토론하고 연구해 왔으나 국제공법분야의 구제는 뚜렷한 제약이 있다. 따라서 피해자의 적법한 권리와 배상이익을 확실하게 보장하기 위해서는 국제사법 측면의 구제도 고려해야 할 것이다. 초국경적 환경오염침해구제는 국제민사소송법 영역에서 다양한 쟁점들을 구현하고 있는데, 예를 들면 손해배상주체의 확정, 관할권 약정, 법적 충돌의 해결, 외국법원판결의 승인과 집행 등이다. 그러나 초국경적인 초미세먼지의 피해에 대해 국제민사소송법의 전통적인 이론과 구제방식은 효과적인 해결책이 되지 못하고 있는 실정이다. 때문에 법률관계주체, 관할권, 법적 충돌규칙 및 외국법원판결의 승인과 집행 등 분야에서 획기적인 연구와 실천이 있어야 하는데 특히 국가의 책임과 관련된 새로운 접근이 필요할 것이다. 따라서 국제민사소송법의 전통이론에 대한 변화, 국제사법과 국내 불법행위법 간의 유기적인 결합 및 배상분담의 사회화와 공동구제시스템의 구축 등 제반 조치들을 통해 초국경적 환경오염침해를 해결하기 위한 새로운 루트를 개척해야 한다.

영어초록

With the rapid development of the productive forces of human society, the great progress of science and technology, the booming advances in knowledge economy and the rise of globalization, cross-border environmental pollution has already become the crux to impact the human society. Cross-border environmental pollution infringement includes many contents, among them the haze has become the focus of attention in recent years. For the harm caused by fog is not only the specific country internal affair but also has already become the serious reality of other country’s environment. In Cross-border environmental pollution infringement relief, mainly carries on the discussion and the research from the perspective of international law all the time. However, the relief level of public international law has obvious limitation. In order to guarantee the legitimate rights and interests of compensation of the victim, we should consider the level of private international law remedies. The cross-border environmental pollution tort relief reflect many focus in the field of international civil procedure, such as how to determine the specific subject, how to define its jurisdiction, how to accurate classification of conflict of laws, how to solve the recognition and enforcement of foreign judgments effectively etc. However, in the face of cross-border haze phenomenon in international civil procedure law, traditional theory and the relief way may not be so effective. So, in the legal relationship main body, jurisdiction, conflict of law rules and the recognition and enforcement of foreign judgments etc should break through study and practice, especially necessary to redefine the role of the state. What’s more, through the following measures : breakthrough the traditional theoretical of international civil litigation, the organic combination of private international law and domestic law of tort liability, the socialization of compensation and mutual aid mechanism etc ,which strive to open new paths to solve cross-border violations of environmental pollution.
