경정거부처분 취소소송의 소송물 ―대법원 2005.10.14. 선고 2004두8972 판결― (A Procedural Issue under Korean Tax System：　How to Dispute Simultaneously a Tax (Re-)Assessment and a Denial of Claim of Refund)

이 글이 평석하고자 하는 대상판결은, 감액경정청구를 거부하는 처분에 대하여 취소소송이 제기되어 계속하고 있는 도중에 동일한 납세의무에 대한 증액경정처분이 이루어져서 그에 대하여도 별개의 취소소송이 제기된 경우 두 소송 사이의 관계를 다루고 있다. 대상판결에 따르면, 이러한 경우 경정거부처분이 증액경정처분에 흡수되어 그 존재가 소멸하는 것은 아니지만 그 대신 거부처분 취소소송은 소의 이익을 상실하게 되어 부적법 각하되어야 한다. 거부처분의 원인이 된 경정청구가 양수(陽數)인 세액에 관한 납세의무로부터 벗어나는 것을 목적으로 하는 경우에, 이른바 ‘흡수설’을 근간으로 하는 현재의 소송물 이론하에서 납세자는 증액경정처분에 대하여 제기된 소송에서 종래의 경정청구의 내용을 아울러 주장하여 다툴 수 있기 때문에, 굳이 거부처분의 흡수․소멸을 부정하는 이론 구성에 다소 의문은 있지만, 어쨌든 대상판결은 결론에 있어서는 타당하다.
그러나 거부처분의 원인이 된 경정청구가 그러한 납세의무로부터 벗어나는 것에 그치지 않고 더 나아가 음수(陰數)인 과세표준이나 세액을 확정하여 달라는 것을 내용으로 하는 경우, 현재의 소송이론 체계하에서는 납세자가 증액경정처분에 대한 소송에서 이러한 내용을 주장하여 다툴 수 있는 길이 있다고 하기가 곤란하다. 따라서 이러한 경우에는 거부처분 취소소송이 부적법하다는 대상판결의 결론이 그대로 유지될 수 없음을 유의하여야 한다.

영어초록

This article reviews the opinion of a Supreme Court decision rendered in 2005 on a procedural issue that is unique to Korean tax litigation system.
There are two different tracks for a taxpayer to litigate his tax liabilities under Korean tax system. One is to dispute directly a tax (re-)assessment, issued by the tax authorities, and the other is to file a claim of refund first, and when this claim is denied by the tax authorities, then to file a complaint to have the denial revoked. When the taxpayer has reported his tax liability as required by the law and still intends to dispute the reported tax liability, he should typically rely on the latter measure. On such revocation of the denial, the tax authorities are obliged to accept the initial claim of refund.
It happens sometimes that both types of lawsuits are pending simulta- neously, because both the taxpayer and the tax authorities, having reviewed the relevant tax report, may find flaws. In this case, the taxpayer will file a claim of refund to reduce his tax liability only to see that his claim denied by the tax authorities, while the same authorities will issue on their own right a (re-) assessment to increase the taxpayer's liability. Should the taxpayer file two different types of lawsuits separately, or does it suffice to file only one, and if so, which one of the two, and on what theoretical ground? As the relevant procedural law is silent on this issue, it becomes a hard question for both practitioners and commentators to answer. In fact, it is all the more difficult for the fact that the theory on “object" (or Straitsgegenstand in German legal term) of tax lawsuit has already been incredibly complicated under Korean law, with such theories as total-amount theory, absorption theory, etc.
This article, having reviewed the 2005 Supreme Court opinion on this issue, examines from a critical point of view its conclusion and background reasoning, and tries to identify and present a clear criteria on when the two lawsuits should be pending separately and when a lawsuit should be “absorbed" into the other.
