개인정보보호법제정비에 대한 비판적 고찰 - 새로운 개인정보보호법안을 중심으로 - (A Critical Review of Personal Information Protection Act Revision)

초록

이명박 정부에서 다시 개인정보보호법 제정움직임이 일어나면서, 기존의 개인정보보호법 제정논의에 대한 학습효과 덕분에 여러 가지 쟁점들을 빠른 시일 내에 정리하여 바람직한 법안들이 제시되었다. 이 논문에서 다루고 있는 법안 역시 지금까지 논의된 개인정보보호에 관한 쟁점들을 잘 추려내어 개인정보 유출로 인한 국민의 피해를 최소화하고 정보사회에서 개인정보자기결정권을 보호하기 위한 다양한 내용들을 담고 있는 진일보한 법이라고 평가할 수 있다. 이러한 법제정을 통하여 끊임없이 발생하는 개인정보 유출사고가 줄어들어 국민의 개인정보보호 수준이 월등히 높아지고, 개인정보 관련 산업 발전에도 크게 기여할 것으로 전망된다. 그런데 그동안 개인정보보호법 제정과정에서 다툼이 없었고, 전혀 문제가 되지 않았던 개인정보 보호기구의 위상과 기능 때문에 현재 법안이 통과되지 못하고 있다. 결국 대안에 규정되어 있는 개인정보보호위원회의 경우 국제적 기준이나 그동안 논의되었던 수준에 비하면 보호기구의 독립성과 권한 등이 부족하다. 이러한 위원회는 효율적인 개인정보보호를 위한 독립된 기구로서 충분한 역할을 하기 어렵다고 판단되며, 체계적이고 일관된 형태의 개인정보보호기구라고 보기 어려울 만큼 ‘타협의 산물’이라고 할 수 밖에 없는 모습을 지니고 있다. 이에 대한 체계화, 명확화, 재정비가 필요하다고 생각한다.

There is a movement that establishment of personal information protection law again under Lee Myung-bak's administration. In this instance, disputed points settled as quickly as possible and desirable bills are drafted. Because Established discussion for the legislation of personal information protection law was already repeated several times. This study shows that the bill contains key issues of personal information protection under debate until now. We can evaluate it is a great step forward. Because the bill contain material of highly diverse for the minimization of people's damage by leaking personal information and the protection of right to decision of personal information in the information society. By establishing personal information protection act, the perpetual dangers of personal information leaks will be decreased. So that it is expected that it could contribute to the steady development of personal information industry. Meanwhile, the status and the role of personal information protection organization amounted to nothing at all in the process of the personal information. But a bill hasn't passed yet because of the status and the role of personal information protection organization that has not gone uncontested before. Ultimately, the committee of personal information protection prescribed on a alternative lacks theses things like the independence and powers of personal information protection organization compared to international standards and earlier discussion at level in the meantime. I think that the committee according to the alternative in this situation is not only disorganized but also inconsistent. so that this committee will not do an adequate role as the independent organization. Therefore I think that the alternative of personal information protection law demands systematization, disambiguation and rearrangement.
