보호감호제의 재도입과 감호자 처우제도 개선방안 (A study on the reintroduction of the prevention custody system and the improvement of a inmate treatment)

초록

보호감호제도는 1980년 제5공화국 출범과정에서 도입되어 2005년 사회보호법의 폐지로 제도의 종결을 보는 듯 했으나 흉악범죄의 상습화 ․ 누범화는 범죄에 대한 사회적 경각심을 불러 일으켰고, 형 집행 기간의 연장, 전자발찌 착용, 화학적 거세 등 형사정책의 강경화를 가져왔다. 더불어 보호감호제도는 형법개정안을 통해 형법에 누범과 상습범에 대한 가중처벌규정을 없애는 대신 보호수용의 이름으로 되살아나는 단계에 이르렀다. 그동안 보호감호제에 대한 이론적 배경과 재도입에 따른 비판적 고찰 등에 관한 논의는 활발히 이루어졌으나 실제 그들의 처우를 어떻게 할 것인가에 대한 논의는 크게 다뤄지지 않았다. 보호감호자 처우를 담당하고 있는 구 청송제3교도소(현재 경북북부제3교도소)의 「한국형 피보호 감호자 처우모델(안)」을 중심으로 합리적 감호자 처우방향을 정리하였다. 연구결과 첫째, 보호감호자의 처우는 과학적 분류를 전제로 사회적 위험성과 사회복귀 목적의 조화를 위해 단계별로 이루어져야 한다. 둘째, 보호감호자에게 주어지는 작업장려금(근로보상금)은 범죄로 인한 사회적 비용개념으로 받아들여 그들의 구금에 따른 보상적 성격을 인정하는 것이 필요하다. 셋째, 현재 범죄예방정책국의 정책과 교정본부의 관리 체제로 나누어진 처우시스템은 이중처벌의 비난을 불식하고 징역형과 차별화된 처우를 위해 범죄예방정책국으로 일원화하여야 한다. 넷째, 시설 내 처우환경을 획기적으로 개선하고, 외부교통권은 최대한 보장되어야 한다. 다섯째, 사회적응력 배양을 위해 사회에서 이루어지고 있는 다양한 직업훈련 교육기회를 광범위하게 보장하여야 한다. 여섯째, 감호의 종료를 위한 심사는 보다 유연성 있는 시스템 구축을 통해 심사의 경직성과 형식성을 개선하여야 한다. 아울러 보호감호자의 징역형 집행시 보다 전문화된 교정프로그램을 적용하여 실제 보호감호기간을 최소화하여야 한다.

영어초록

The prevention custody system was introduced in 1980 by the military force and was abolished in 2005 along with repealing the society protection law. But violent crimes have been tougher and worse than before, which have alerted people to the dangers of felony criminals. As a result, the authorities have taken a firm stand in criminal policy and brought in various tough actions like the long-term sentence, the electronic anklet and the chemical castration. And also the prevention custody has been renewed under the name of a protective custody which have eliminated the rules of additional punishment for repeated and habitual offenders in criminal law.
Meanwhile, discussions focused on the theoretical background and the justification over the prevention custody have been actively taken place. However, how to treat inmates under custody has not been considered carefully in all aspects. Currently, inmates under the system are confined in the northern-Gyeongbuk-the third correctional institution(old Cheongsong-the third correctional institution) and there is a guideline for inmate treatment, so-called the Korean-Treatment Model for the prevention custody inmate. This study has shown how to treat inmates effectively and reasonably based on this model. The results can be summarized as follows.
First, inmates should be classified scientifically and treated in phases to keep a balance between the isolation and the rehabilitation of inmates.
Second, the government grants for working inmates need to be redefined as government indemnification because it costs much anyway to isolate criminals from society for social security.
Third, a dual structure of treatment between Crime Prevention Policy Bureau and Korean Correctional Service should be unified under Crime Prevention Policy Bureau, which would reduce criticism of double punishment and provide inmates with customized programs different from a common jail sentence.
Forth, prison environment should be improved and the right of communicating with people outside should be guaranteed widely.
Fifth, more inmates should be able to get various vocational training programs which would lead them to a successful rehabilitation after release. Sixth, the authority need to design more flexible screen test system which determine the close custody. Also, the correctional authority has to provide more specialized treatment programs with prevention custody inmates to make their actual time served under the prevention custody shorter during their prison time.
