초록

핵심협약 비준은 정치적 논쟁의 산물이 아니다. 노사 간 실질적 대등성에 바탕을 둔 협약자치원리의 수용을 위한 것이어야 한다. 국가가 정치적 차원에서 협약자치질서에 영향을 미쳐서는 안된다. 이점은 우리의 쟁의행위법 체계에서도 마땅히 존중되어야 하며 따라서 쟁의행위에 있어 국가 중립 의무에 관하여 다시 한번 강조될 필요가 있다. 협약자치질서의 실질적 보장이야 말로 ILO 핵심협약 비준 및 발효를 통해 지향하고 달성해야 할 목표가 되어야 하기 때문이다. 이를 위한 노조법의 추가적인 개선에 나설 필요가 있다. 나아가 핵심협약은 개별적으로 구체적이면서 세부적인 규율형식을 취하고 있지 않다. 해당 국가의 구체적 사정을 고려해야 하기 때문이다. 입법자는 국가의 구체적 사정과 문화 그리고 관행 등을 고려하되, 핵심협약의 정신에 부합하도록 입법해야 한다.

영어초록

In 1994, the International Labor Organization (ILO) is a three-party consultative body in which government representatives, workers' representatives and employers' representatives participate.
Korea officially joined the ILO as the 152nd member state on December 9, 1991, after wishing to join the ILO at the 75th General Assembly in June 1988.
In 2021, Korea ratified No. 87 (Convention on Freedom of Association and Protection of the Right to Organize), No. 98 (Convention on the Right to Organize and the Right to Collective Bargaining), and No. 29 (Convention against Forced Labor) among the core ILO conventions. In short, all core conventions except Convention No. 105 have been ratified. And as of April 20, 2022, the ratified convention came into force.
There are concerns that the ratification and application of the ILO core conventions will completely change the existing labor-management legal system and practice. These concerns are too great. The Korean legal system also exists to effectively guarantee the right to organize, to guarantee the right to collective bargaining, and to guarantee the right to collective action.
The ratification of the Core Convention is not the product of political debate. It is a device to secure practical equality between labor and management. The obligation of the state to be neutral in industrial action needs to be emphasized once again. Substantial guarantee of the autonomy of the Convention should be the goal to be pursued and achieved through the ratification and entry into force of the ILO core conventions. To this end, it is necessary to further improve the current union law.
The core convention is the general discipline on labor human rights. Its content is very comprehensive. There will be no cases that clearly conflict with the laws of our country. This is because the law on labor unions was enacted within the scope that harmonizes with the three labor rights in the Constitution.
