유럽연합 대내외 협상에서 의회 간 협력의 역할 (The Role of Inter-parliamentary Cooperation in EU Internal and External Negotiations)

초록

이 연구의 목적은 유럽연합(이하 EU)의 대내외 협상 과정에서 의회 간 협력이 EU 의 민주적 정당성과 투명성을 높이는 데 미치는 영향을 확인하고 EU의 대내외 협상과정에서의 의회 간 협력의 지속 및 확대의 필요성을 주장하고자 함이다.
이 연구에서 다루고자 하는 유럽연합 내 의회 간 협력이란 유럽의회와 27개 회원국 의회 간 수직적 협력과 27개 회원국 의회 간 수평적 협력을 포괄하는 개념으로, 유럽연합조약 제12조와 유럽연합조약에 첨부된 의정서 1(Protocol n° 1)과 의정서 2(Protocol n° 2)가 이를 법적으로 뒷받침한다.
이 연구에서는 우선, EU 대내 협상, 특히 EU 가입 및 탈퇴 과정과 관련하여 EU 내 의회 간 협력이 어떠한 역할을 했는지 살펴본다. 특히, 의회 간 협력이 EU 가입협상 과정과 가입 이후, 가입 후보국과 회원국이 EU 가치를 준수하도록 어떻게 모니 터링 기준을 조화시키고, EU 기관에 영향을 끼치면서 효과적인 감독을 촉진할 수있는지를 검토한다. 이후, 이러한 협력이 브렉시트(Brexit)와 같은 EU 탈퇴 협상 중에 회원국의 EU 가치 준수 여부를 민주적으로 통제하는 데에 어떻게 도움이 될 수있는지 살펴본다.

영어초록

The purpose of this study is to identify the impact of inter-parliamentary cooperation in the internal and external negotiation processes of the European Union (EU) on increasing the democratic legitimacy and transparency of the EU and to argue for the need to continue and expand inter-parliamentary cooperation in the EU’s internal and external negotiation processes.
The concept of inter-parliamentary cooperation in the EU encompasses both vertical cooperation between the European Parliament and the 27 Member States’ parliaments and horizontal cooperation between the 27 Member States’ parliaments, and is legally supported by Article 12 of the Treaty on European Union and Protocol n° 1 and Protocol n° 2 attached to the Treaty on European Union.
This study first examines the role that inter-parliamentary cooperation has played in EU internal negotiations, particularly in relation to the accession and withdrawal processes. In particular, it examines how inter-parliamentary cooperation can harmonize monitoring standards for candidate and member states' adherence to EU values, influence EU institutions, and facilitate effective oversight during EU accession negotiations and thereafter. It then explores how such cooperation can help democratically monitor member states' compliance with EU values during EU exit negotiations, such as Brexit.
It also examines the role of inter-parliamentary cooperation in EU external negotiations in the context of free trade agreements and international climate agreements. It argues that there is a need to increase the involvement of Member States’ parliaments in order to enhance transparency and democratic control over the negotiations conducted by the European Commission. To support this argument, it provides examples of the influence of Member States’ parliaments in the EU’s international negotiations, including the Transatlantic Trade and Investment Partnership (TTIP) and the Comprehensive Economic and Trade Agreement (CETA), and discusses the challenges and opportunities for the influence of Member States’ parliaments in these negotiations.
Given that inter-parliamentary cooperation within the EU serves as a mechanism that contributes to some extent to securing democratic legitimacy and enhancing transparency in both internal and external EU negotiations, it will be worth paying attention to whether the role and scope of this cooperation, which is increasingly institutionalized through the regularization of inter-parliamentary meetings, the establishment of sectoral inter-parliamentary meeting bylaws, and the operation of inter-parliamentary information exchange platforms like IPEX, will be further expanded in the future.
