초록

가석방제도는 자유형의 대체수단으로서 수형자의 교화와 개선의 여지에 따라 적극적으로 활용하고자 하는 의도에서 입법되었다. 즉 가석방은 자유형의 집행 중에 있는 수형자의 행장이 양호하여 개전의 정이 현저한 때에 한하여 형벌의 목적이 충분히 달성되었다고 판단하여, 수형자의 사회복귀와 갱생의 분발을 촉구하기 위하여 시설내 처우에서 사회내 처우로 전환하는 제도이다. 이는 형사정책상 특별예방사상의 실현과 교정정책상 수형자의 조기사회복귀를 도모하여 교정비용을 절감하는 효과도 기대할 수 있는 합리적인 제도이다. 그러나 현행 가석방제도는 입법적 취지에 비하여 가석방허가의 요건이 다소 엄격하여 실제 소극적으로 운영되는 측면이 있다. 그 이유로서 형법 제72조에 규정된 가석방의 실질적 요건을 들 수 있다. 즉 현행 형법 제72 제1항의 ‘행장이 양호’와 ‘개전의 정’에 대한 판단은 실제 교정기관의 자의적인 판단이 개입될 여지가 충분하다. 따라서 이러한 가석방의 요건은 입법적 취지와 달리 수형자에게 가석방기회를 축소하는 결과를 가져올 수 있기 때문에 가석방의 활성화를 위하여 가석방심사대상자의 기준을 완화하거나, 행형성적의 최상급에 도달할 수 있는 소요기간을 보다 완화하는 방안도 고려해볼 필요가 있을 것이다. 이러한 점에 착안하여 필자는 교정기관의 자율성과 효율성을 보장하면서 수형자의 복지증대의 측면을 고려하여 수형자에게 가석방기회를 확대할 수 있는 방안으로서 가석방의 형식적 요건을 실질적으로 완화하는 입법적 개선방안을 제안하고자 한다. 즉 형법 제72조 제1항의 가석방이 가능한 시점에 대하여 ‘무기에 있어서는 15년, 유기에 있어서는 4분의 1 경과한 후’로 개정하여 수형자에게 가석방이 가능한 시점을 현행 보다 단축하는 것이 바람직하다고 생각된다. 그리고 이에 상응하여 형법 제73조의2 제1항의 가석방의 기간은 ‘무기형에 있어서는 15년으로 하고, 유기에 있어서는 남은 형기로 하되, 그 기간은 15년을 초과할 수 없다’라고 규정하면 필요적 보호관찰제도의 활용에 의하여 가석방확대에 따른 부작용을 최소화할 수 있다고 생각된다. 아울러 수형자의 신청에 의한 가석방심사제도의 확립과 가석방적격대상자에 대한 보호관찰사안에 대한 심의를 별도의 기관이 아닌 가석방심사위원회에서 함께 심의하는 것이 수형자뿐만 아니라 교정기관의 입장에서도 효율적이라고 생각된다.

영어초록

The parole system was legislated as a substitution means of the punishment for the purpose of utilizing positively according to the degree of the convict's edification and improvement. That is, the parole system is the system converting the convict's treatment in the facility into his treatment in the society to promote his return to society and rehabilitation according to the judgment of having achieved the purpose of the punishment sufficiently in showing the results of his record and the degree of his reform satisfactory and distinctive during the period of executing the punishment. This is the resonable system that can realize the thought of the special prevention in the criminal policy, seek the convict's return to society earlier in the correctional policy, and expect the side effect of reducing the correction expense. But the current parole system is administrated passively because of the strict conditions of the parole system in judging from its legislative intention. These examples includes the practical restriction requisites of the parole system prescribed in the seventy second of the criminal law. In the first item of the seventy second articles of the current criminal law, as it were, the judgment about 'the satisfaction of the record of the convict' and 'the degree of the convict's reform' cannot help being judged by the subjectivity of the correctional agency. Accordingly, these legislative rules can result from the reduction of the convict's parole opportunity unlike the legislative intension of the law. Therefore the norm of the objects of judgement or the latest time over the highest grade of the execution score should be relaxed to invigorate the parole system. Noticed these points, this study is to offer a legislative improvement program to practically relax the official conditions of the parole system as a method of the expansion of the convict' parole opportunity by considering his position in the side of the correctional welfare through guaranteeing the autonomy and efficiency of the correctional agency. Regarding the parole point permitted by the first item of the seventy second article of the criminal law, so to speak, it is natural that the possible parole point for the convict should be more reduced than the current rules through revising after passing 15 years in the life imprisonment and one fourth in the limited penal servitude. Hereby, the parole period of the first item in the second of the seventy third article of the criminal law should be enacted as '15 years in the life imprisonment and the rest in the limited penal servitude, and 15 years in the period cannot be exceeded', and the subside of the parole system can be minimize according to utilizing the necessary parole system. In addition, to establish the system by means of the convict's application, the position of the correctional agency as well as in the convict's position it is thought efficient to deliberate the probation about the screening of the parole short-list in the judging committee on parole, not in a separate agency.
