과 목 : 글로벌 무역의 이해과 제 명 :사막화에 따른 황사문제와 한중 분쟁 가능성주제 : 사막화에 따른 황사문제와 한중 분쟁 가능성Ⅰ. 서론전 세계적으로 사막화 현상이 큰 문제로 다가오고 있다. 국제연합환경계획 한국위원회(UNEP)의 통계에 따르면 지구 전체의 육지의 1/4이 사막화에 영향을 받고 있으며 110개국이 넘는 국가에서 10억 명 이상의 인구가 사막화로 인해 생존의 위협을 받고 있다고 한다. 생존의 위협까지는 아니지만 한국도 예외는 아니다. 한국환경정책평가원에 따르면 아시아지역(중국, 몽골)의 사막화 현상으로 생겨난 황사문제로 인하여 2000년대 이후 한국의 사회경제적 피해액이 최대 7조 3천억 원에 달하는 것으로 추정되며 피해액은 매년 늘어날 것으로 예측되고 있다.) 이처럼 사막화에 따른 피해가 동북아 전역에 걸쳐 심각해짐에 따라 한중간의 분쟁 가능성이 높아지고 있다. 따라서 사막화의 원인과 피해상황, 그에 따른 분쟁 가능성에 대해 알아보고 다방면의 대책을 강구하도록 한다.Ⅱ. 본론ⅰ. 중국사막화의 원인과 현황1) 사막화의 원인중국사막화의 원인은 크게 자연적 요인과 인위적 요인으로 나뉜다. 자연적 요인으로는 강우량의 감소가 가장 큰 원인으로 현재 중국의 서북 건조지역(타클라마칸, 바다인자단, 텐겔, 고비지역, 만주 사막지대)은 연강수량이 400mm이하(우리나라의 연강수량은 약 1100~1700mm))이다. 인위적 요인으로 여러 가지가 있지만 크게 4가지로 정리할 수 있다. 첫째로 중국정부의 무분별한 초원과 산림 개간 정책이다. 1950년대부터 시작된 중국의 토지개간사업으로 룡강성, 내몽고, 감숙성 등 4개성에서 개간한 토지 중에서 절반 가까운 토지가 버려진 땅이 되었다. 둘째로 무분별한 방목이다. 그 예로 내몽고의 경우 과도한 방목으로 인하여 초원이 사막화가 되었다. 셋째로 무분별한 벌목과 채취이다. 산간지역에서는 개간과 땔감사용을 위하여 무차별적인 벌목과 채취가 이루어졌다. 마지막으로 무분별한 물의 사용이다. 그 예로 중국 황사의 발원지인 민친현은 예부터 대표적인 중국의 오아시스 도시였다. 그러나 민친현의 인구가 기하급수적으로 늘어났고 사람들의 무분별한 물 사용으로 인하여 풍부했던 민친현의 1200여개의 크고 작은 하천과 호수가 사라졌다.)2) 황사의 원인황사란 아시아 대륙의 중심지로부터 다량의 모래와 먼지가 공중으로 비산하여 강풍을 타고 이동하면서, 지면 가까이에 침적하면서 부유하거나 시정장애를 일으키는 현상을 말한다.) 황사의 중요한 원인으로는 중국의 사막화라고 할 수 있다. 특히 사막화 지역은 중국 북부와 서부의 12개성에 집중되어 있다.3) 사막화 현황유엔사막방지화협약(UNCCD)의 보고에 따르면, 중국의 사막화면적은 263.62만 ㎢으로 전체 국토 면적의 27.46%를 차지하고 있다고 밝혔다. 또한 몽골은 전체 국토 면적의 40%가 사막화 되었으며 전 국토의 90%가 사막화의 영향하에 있어 그 심각성이 날로 더해지고 있다.)[세계 사막화 지도]출처 : UNCCD 홈페이지ⅱ. 사막화에 따른 황사에 의한 피해황사는 한국이 가장 직접적으로 느낄 수 있는 사막화에 따른 피해이며, 2008년 한국 정부가 밝힌 한국에 미치는 황사의 간접적인 피해는 다음과 같다.하나, 가시거리 불안정으로 항공기, 여객선 운항 및 어업활동 중단, 교통체증 증가 등의 물류이동에 대한 피해둘, 일사량 감소, 식물기공에 침적 및 수분 방해로 농업분야에 대한 피해셋, 가축의 호흡기계 질환 야기로 축산업에 대한 피해넷, 반도체 도장 공정 등 정밀산업에 대한 피해다섯. 실외 서비스산업의 중단 또는 둔화 그리고 세차 등 청소비용 증가여섯. 유해 미생물이 황사에 의해 운반돼 인류, 육상 및 해상 생태계 피해 유발일곱. 황사와 수반돼 날아오는 중금속과 오염물질로 해양수질에 악영향여덟. 학교 휴교로 인한 교육적인 피해이 중에서도 특히 산업분야와 교통부분 피해가 커지고 있다. 환경부의 황사피해방지종합대책 보고서에 따르면 황사의 피해로 조선업계는 도장작업 일시 중단으로 조업일수가 1.2%증가 및 백화점이나 할인점의 매출도 약 20% 감소할 것으로 전망하고 했으며, 2002년 황사로 인한 시정악화로 총102편의 국내선 항공기가 결항했으며, 항공운송산업이 입은 직접적인 매출손실은 약 5억8천만으로 추정하였다.)하지만 황사의 빈도수가 증가하고 있으며, 그 강도는 더욱 심해지는 추세를 보이고 있다. 이는 장기적으로 보았을 때 향후 더 큰 피해를 초래할 것으로 보인다. 서울의 황사발생일수는 1980년대 평균 3.9일에서 1990년대 평균 7.7일, 2000년 이후에는 평균 12.4일로 증가했으며 PM10 시간당 최고 농도가 2,000~3,000㎍/㎥에 달하는 강력한 황사도 발생하고 있다.)[서울지역 연도별 황사발생 추이]출저 : 황사피해종합방지대책, 환경부 2008년 P11ⅲ. 중국사막화에 따른 한중 분쟁 가능성중국지역의 사막화는 황사를 일으키고 물리적인 피해를 유발하고 있으며 그 심각성은 점점 커질 것으로 추정된다. 하지만 중국의 사막화 방지정책은 다음과 같은 한계를 가지고 있다.첫째, 중국정부의 자금부족문제로 인하여 사막화 방지 대책이 원활히 이루어지고 있지 않다. 현재 중국은 매년 사막화 방지를 위해서 3000만 위안의 자금을 투입하고 있지만 이는 턱 없이 부족한 숫자이며 오늘날 중국의 사막화를 방지하기 위해서는 80억 위안의 자금이 필요하다고 예측하고 있다.(인용)둘째, 사막화 방지 정책 추진을 위한 사회적 기반이 약하다. 현재 중국의 해안 도시를 중심으로 한 성장으로 인하여 내륙과 해안의 빈부 격차가 심화되고 있으며 내륙지역, 특히 사막화 지역에서는 가난을 극복하기 위해 산지 개간이 조심스럽게 이루어지고 있다.셋째, 사막화 방지를 중국 정부의 기술 개발에 진척이 없다. 현재 중국은 호주와의 협력 아래 황사 방지를 위한 연구를 하고 있지만 자금부족으로 인하여 연구의 진행이 지지부진한 상태에 놓여있다.위와 같이 중국의 사막화 방지 정책이 한계를 갖으며, 구속력 또한 없다. 동북아 지역에서 이루어지는 합의들은 선언적 성격을 가지고, 유엔사막화방지협약(UNCCD)에서 제공하는 프로그램은 사막화 방지를 지침에 가깝다.문제는 황사문제가 국제법상 국가 책임의 문제를 유발한다는 점이다. 중국의 사막화 방지 정책이 한계가 있고 구속력이 없기 때문에, 중국 정부가 황사문제에 관하여 해결하려는 적극적 의지가 보이지 않지만 분명한 것은 황사문제는 중국의 책임소재 하에 있다. 국가의 위법행위에 대하여 해당 국가가 그에 대한 책임을 져야 한다는 것은 국제법상 잘 확립되어 있는 원칙이다. 그리고 이 원칙에 따르면 국제법상 의무를 위반한 국가는 이에 대한 책임을 지고, 발생한 손상에 대한 배상의무를 부담해야 한다. 그리고 국제법상 의무 위반 여부를 판단하는데 있어서는 3가지 조건이 필요하다. 첫째는 국가의 행위가 있어야 하고, 둘째는 그것이 국제법상 의무위반 행위어야 한다. 셋째는 피해와 의무위반 행위 간의 인과관계가 성립 되어야 한
