미술품 담보제도에 관한 법적 고찰 (Legal Consideration for Security System of Art Works)

초록

최근 한류가 전 세계적으로 퍼져나가면서 문화콘텐츠가 갖는 엄청난 경제적 가치와 문화적 영향력을 실감하고 있다. 문화콘텐츠가 갖는 이러한 영향력을 감안한다면, 우리나라의 미술품을 발굴하고 발전시켜 나가는 것 또한 우리나라의 문화적 발전과 국익을 위해 중요하게 다루어져야 할 부분이라 할 것이다.
미술품이 단지 감상의 대상에서 벗어나서 투자의 대상인 재화로써 가치를 가지고 있다면 금융거래의 신용을 담보할 수 있는 매개체로서의 역할을 수행할 수 있도록 할 때 그 가치가 상승되어 미술품 거래를 더욱 활성화 시킬 것이고 이러한 거래의 활성화는 문화콘텐츠를 발굴하고 발전시키기 위한 좋은 방안이 될 것이다. 따라서 미술품이라는 문화콘텐츠를 발전시키기 위한 일환으로 미술품의 담보가치를 확보하기 위하여 종래의 담보법과 새롭게 시행되고 있는 동산ㆍ채권 등의 담보에 관한 법률을 중심으로 미술품의 특성에 따른 문제점과 개선 방안을 모색해 보기로 한다.
미술품을 담보로 자금을 확보하는 방법으로는 종래에 질권설정에 의한 방법, 양도담보권 설정에 의한 방법, 소유권유보부매매에 의한 방법이 있다. 그러나 이들 방법은 미술품이 갖는 특징인 유일성과, 심미적 가치, 감가상각 부적용 등의 특성을 제한하여 미술품 소장가층의 확대를 저해하고 있다. 이러한 문제점은 동산ㆍ채권 등의 담보에 관한 법률의 시행으로 어느 정도 해소될 것으로 판단되지만 동산담보법이 취하고 있는 인적편성주의로 인하여 그 효과가 크지는 않을 것으로 예상된다. 따라서 미술품을 계속해서 소장하면서 심미적 가치도 향유하고, 점유 이전에 따른 비용을 줄이면서 부동산과 비슷할 정도로 금융거래의 신용을 담보할 수 있도록 하기 위해서는 미술품 등록제도를 통하여 물적편성주의를 취하게 되면 등록된 미술품에 대해서는 저당권을 설정할 수 있는 가능성을 확보하게 되어 종래 담보법과 새로운 동산담보법이 갖는 한계를 해결할 수 있을 것이다.
그리고 담보가치를 확보하기 위해서는 미술품 시장이 활발하게 운영되어야 할 것이므로 미술품 시장 중에서도 가장 공정하고 객관적인 미술품 경매시장을 활성화하는 것이 기반되어야 할 것이다. 이를 위해서는 전문적이고 공신력있는 감정을 위해서 감정사 자격제도가 도입되어야 할 것이고, 이와 동시에 책임감 있는 경매 진행을 위해서 경매사 자격제도도 같이 고려되어야 할 것이다. 그리고 무엇보다 감정사와 경매사를 양성할 수 있는 교육기관의 설립이 필요하다. 또한 공정한 경매의 진행을 위하여 경매 절차에 대한 제도적 정비가 이루어져야 할 것이다.
미술품은 일반적인 공산품과는 다른 특징이 있으므로 미술품 거래로 인한 문제점에 대해서는 일괄하여 해결할 수 있는 통일적인 법제도를 통해서 해결하는 것이 미술품이라는 문화 콘텐츠를 개발하고 발전시키는데 효율적인 방안이 될 것이다.

영어초록

Recently, as Korean wave spreads globally, enormous economic value and cultural influence exerted by cultural contents are felt realistically. Given this influence exerted by cultural contents, it is considered that discovering and developing art works of our country should be handled significantly for the benefit of cultural development and national interest as well.
Given the fact that art works has a value as a goods of investment subject instead of just a subject of its appreciation, trading of art works would be activated by its value being increased when its role is made to be played as a media of being able to guarantee credit for financial transaction and this activation of transaction would provide a favorable means of discovering and developing cultural contents. Therefore, in order to secure security value of art works as a way of developing cultural contents, problems depending on features of each art work and its improvement method would be explored based on existing security act and laws on security for movables and receivables.
As a way of securing funds by using art works as security, existing method of establishing right of pledge, right of transfer mortgage and ownership (property) forbearance bearing sale are available. However, these methods impede expansion of art work possessors by restricting features of exclusiveness, esthetic value and non-applicability of depreciation involved in art works. It is considered that these problems would be somewhat eliminated by implementation of movables security act but it is expected that its effect would not be significant due to name-based filing system adopted by movables security act. Therefore, if a realfolium should be adopted through registration of art works in order to ensure appreciation of esthetic value, reduction of cost for ownership transfer and allow guarantee of credit for financial transaction like the case of real estate while possessing art works continuously, mortgage for registered art work would be enabled and as a consequence, limitation of existing security act and movables security act could be solved.
And as market of art work should be operated actively in order to secure security value, activation of most fair and objective art work auction market among art work markets shall be provided as its base. In order to achieve this objective, appraiser qualification system shall be introduced in order to ensure professional appraisal having public credibility and at the same time, in order to progress reliable auction, qualification system for auction broker (dealer) is required to be introduced as well. And more than anything else, establishment of an educational institution where appraiser and auction broker could be trained is required. In addition, in order to ensure fair progress of auction, systematic arrangement for auction procedure shall be provided.
As art work has a characteristic different from that of other general industrial products, regarding any problem that may be taken place in a process of art work transaction, solving such problem through a unified legal system on an integrated basis would be an efficient way of exploiting and developing cultural contents called art work.
