자율규제의 유형별 사례와 플랫폼 자율규제를 위한 시사점 (Cases of self-regulation by type and implications for platform self-regulation)

초록

자율규제는 한 가지의 규정 형식으로 한정하기 어려우며, 매우 다양한 스펙트럼을 갖고 있어, 산업의 특징과 방식의 실효성 등을 감안하여, 산업 영역별로 혹은 쟁점별로 적절한 형식을 선택하는 것이 매우 중요하다. 자율규제의 성공적인 안착을 위해서는 먼저 규제의 필요성에 대한 시장 상황에 대한 객관적인 평가가 이루어져야 하며, 규제의 영역별로, 관련 쟁점별로 자율규제가 타당한 것인지, 타당하다면 어떤 자율규제의 모델이 적합한 것인지에 대한 검토를 선행해야 할 것이다.
이미 국내외의 다양한 산업 영역에서 상이한 형태의 자율규제 모델을 실행했으므로, 국내에서의 경험들과 더불어 해외의 사례에 대해 검토함으로써 온라인 플랫폼 서비스에 적합한 자율규제의 방식을 찾을 수 있을 것이다. 자율규제 역시 규제의 한 유형이라는 측면에서 비례의 원칙과 실효성 측면에서의 검토가 필요하다. 해외 자율규제 사례들을 살펴봄으로써 우리의 플랫폼 산업 현황에 비추어 적합한 자율규제 모델을 찾기 위한 노력을 해야 할 것이다.
자율규제의 방식 가운데 기업 내부 위원회형이 실효성을 갖기 위해서는 자율규제 실행에 따른 성과를 명확히 드러낼 필요가 있다. 협의체형의 자율규제 도입을 위해서는 자율규제 기구 자체의 정당성을 확보해야 할 뿐만 아니라, 자율규제 시행의 과정에서도 자율규제 체제 자체에 대한 지속적인 감시와 피드백이 필요하다. 기업들의 협의체가 독립 기구를 구성하는 형태의 자율규제는 온라인 플랫폼 시장에서 실질적인 경쟁이 이루어지고 있고, 플랫폼 스스로의 이용자 후생을 위한 노력에 대한 평가가 시장에서의 인센티브로 작용한다면 실효성이 있는 수단인 것으로 보인다. 민관협력 방식의 협의체 역시 장단점을 지닌다. 플랫폼 서비스 영역이 다양한 규제 쟁점을 내포하고 있다는 점에서(공정거래, 인터넷 이용자 보호, 콘텐츠 문제 등) 거버넌스의 갈등이 우리나라에 해당 모델을 도입할 경우에도 나타날 수 있는 위험성이 있다. 유럽에서의 공유경제 플랫폼에 대한 공동규제는 공적 주체(주로 지방자치단체)와 플랫폼의 공고한 파트너십에 기반하여 이루어지는 것으로 보이며, 플랫폼이 규율 집행을 대행하기 위한 근거가 필요할 것으로 보인다. 우리나라에서 특정 모델을 일률적으로 도입하기보다는, 자율규제의 정신을 유지하면서도 공동규제가 적합한 플랫폼 서비스를 찾아나가는 노력을 우선해야 할 것이다.
자율규제는 완결되고 고정된 개념이 아니라, 지속적으로 진행하며 변화하는 움직임이다. 온라인 플랫폼 산업 역시 복잡성을 가지는 분야이므로 이를 하나의 현상으로 보고 일률적인 자율규제의 거버넌스를 관철하려는 시도는 바람직하지 않다. 국내외에서의 자율규제 경험을 면밀히 검토하여, 각 유형별 장단점을 파악하고, 우리의 플랫폼 시장 현황에 적합한 자율규제의 모델을 신중하게 구성해 나가야 할 것이다.

영어초록

Since self-regulation has a very diverse spectrum, it is difficult to limit self-regulation to a single regulatory form. That’s why it is very important to select an appropriate form for each industry area or issue, considering the characteristics of the industry and the effectiveness of the method. For the successful settlement of self-regulation, an objective evaluation of the market situation on the necessity of regulation must be made first, and a review of whether self-regulation is appropriate for each area of regulation and related issues, and if so, which model of self-regulation is appropriate.
Since different types of self-regulation models have already been implemented in various industrial areas at home and abroad, it will be possible to find a method of self-regulation suitable for online platform services by examining overseas cases as well as domestic experiences. In terms of self-regulation as a type of regulation, it is necessary to review the principle of proportionality and effectiveness. By examining overseas self-regulation cases, efforts should be made to find a suitable self-regulation model in light of the current state of our platform industry.
Among the methods of self-regulation, in order for the corporate internal board type to be effective, it is necessary to clearly reveal the results of the implementation of self-regulation. In order to introduce an alliance type of self-regulation, it is necessary not only to secure the legitimacy of the self-regulatory body itself, but also to continuously monitor and feedback on the self-regulation system itself in the process of self-regulation implementation. Self-regulation in the case of an alliance of companies forming an independent organization could be an effective means if actual competition is taking place in the online platform market and the evaluation of the platform's own efforts for user welfare acts as an incentive in the market. The public-private partnership also has advantages and disadvantages. Since the platform service area contains various regulatory issues (fair trade, Internet user protection, content issues, etc.), there is a risk that governance conflicts may appear even if the model is introduced in Korea. Co-regulation of the sharing economy platform in Europe seems to be based on a solid partnership between public entities (mainly local governments) and the platform, and it seems that the platform will need a basis for enforcing rules on behalf of the platform. Rather than adopting a specific model uniformly in Korea, it is necessary to prioritize efforts to find platform services suitable for co-regulation while maintaining the spirit of self-regulation.
Self-regulation is not a complete and fixed concept, but a continuous and changing movement. Since the online platform industry is also a complex field, it is not desirable to view this as a phenomenon and to enforce uniform self-regulation governance. It is necessary to carefully examine the experience of self-regulation at home and abroad, identify the strengths and weaknesses of each type, and carefully construct a self-regulation model suitable for the current situation of our platform market.
