온라인플랫폼에서의 공정거래에 관한 법제 동향과 전망 (Legal Trends and Prospects for Fair Trade on Online Platforms)

초록

오늘날 전자상거래 없는 생활은 상상할 수 없다. 전자상거래에서 중개 역할을 하는 것이 바로 온라인플랫폼인데, 여기서 이뤄지는 거래에서 분쟁이 발생할 경우 온라인플랫폼측에 책임을 묻기 위한 입법을 준비해 온 공정거래위원회가 이러한 내용을 담은 전자상거래법 전부개정안을 입법예고하였다. 그 주요내용은 전자상거래 과정에서 분쟁으로 인하여 소비자가 피해를 입은 경우에 사업자뿐 아니라 온라인플랫폼도 책임을 지게 하고 아울러 분쟁발생시 중개업체 플랫폼이 판매자의 신원정보를 소비자에게 제공토록 한다는 것 등이다.
그런데 이 전자상거래법 개정안에 대한 플랫폼사업자들의 반발이 큰데, 특히, 요즘 급성장하고 있는 중고거래시장의 경우, 종래 사용자편의를 위해 플랫폼 가입정보를 요구하지 않았으나, 전자상거래법 개정으로 플랫폼들은 개인사업자의 신상정보를 모두 받아야 하고 이 과정에서 개인정보가 유출되거나 악용되는 경우가 발생할 수 있다. 요컨대, 전자상거래법 개정으로 인하여 개인정보보호가 취약해질 수 있는 것이다.
온라인플랫폼 규제와 관련하여 현재 세 개의 법안이 국회에 계류 중이다. 하나는 위에서 언급한 소비자 권익강화를 위한 ‘전자상거래법 전부개정안’이고, 또 하나는 온라인플랫폼에서의 공정거래를 도모하기 위한 ‘온라인플랫폼 공정화법안’이며, 마지막 하나는 온라인플랫폼 이용자 보호를 위한 ‘온라인플랫폼 이용자보호법안’이다. 온라인플랫폼 공정화법안은 국내에서 플랫폼과 입점업체 간 거래를 중개하는 국내외 '거래플랫폼'에 계약서 교부의무 등 의무를 부여하고 이를 위반하는 불공정행위를 할 경우 최대 10억 원의 과징금을 물리는 내용이며, 온라인플랫폼 이용자보호법안은 온라인플랫폼 서비스 시장에서 이용자의 권익을 보호하기 위하여 온라인플랫폼사업자 간, 온라인플랫폼사업자와 이용자 간 및 온라인플랫폼 이용사업자와 이용자 간에 발생하는 온라인플랫폼 서비스에 관한 분쟁을 효율적으로 조정하기 위하여 플랫폼 분쟁조정위원회를 두고 동의의결제도를 도입하는 등의 내용을 담고 있다.
온라인플랫폼 거래에서 정보제공, 위해물품 차단, 피해구제 등 플랫폼사업자의 역할에 따른 책임을 명확히 규정하기 위한 관련 법률의 개정과 신규입법은 조속히 이루어져야 마땅하다. 이를 통해 소비자들이 안심하고 전자상거래를 이용할 수 있고, 관련업계 또한 성장해 나갈 수 있는 공정한 전자상거래의 풍토가 만들어질 수 있을 것이다.

Life without e-commerce today is unimaginable. The online platform plays an intermediary role in e-commerce, and the Fair Trade Commission, which has prepared legislation to hold the online platform accountable in case of a dispute in a transaction made on the online platform, has been preparing for such legal disputes. Legislative notice of all amendments to the Act was made. The main contents are that if a consumer suffers damage due to a dispute in the process of e-commerce, not only the business operator but also the online platform will be held responsible for a certain amount, and in case of a dispute, the brokerage platform will provide the identity information of the seller to the consumer. .
However, there is strong opposition from platform providers to this amendment to the E-Commerce Act. In particular, in the case of the used trading market, which is rapidly growing these days, platforms have not requested subscription information for user convenience. or may be misused. Personal information protection may be vulnerable due to the revision of the E-Commerce Act.
Currently, three bills are pending in the National Assembly regarding the regulation of online platforms. One is the 'All Amendment to the E-Commerce Act' to strengthen consumer rights and interests mentioned above, the other is the 'Online Platform Fairness Act' to promote fair trade on online platforms, and the last one is the 'E-commerce Act' to protect online platform users. This is the ‘Online Platform User Protection Act’. The Online Platform Fairness Act imposes a number of obligations, including the obligation to issue contracts, to domestic and foreign 'trading platforms' that mediate transactions between platforms and vendors in Korea. In order to protect the rights and interests of users in the online platform service market, the User Protection Act is a platform dispute in order to effectively mediate disputes related to online platform services that have occurred between online platform operators, between online platform operators and users, and between online platform users and users. It includes contents such as allowing the establishment of a mediation committee and introducing a consent settlement system.
Revision of relevant laws and new legislation to clearly define the responsibilities of platform operators in relation to information provision, blocking of hazardous goods, and relief from damage should be done as soon as possible. This is because consumers can use e-commerce with confidence and fair e-commerce can be achieved in which related industries can also grow.
In this article, the main contents of each bill proposed for fair trade on the online platform will be examined in detail, the problems will be reviewed, and the conclusion will be made with suggestions.
