초록

온라인 플랫폼 서비스는 우리 생활 속 깊숙이 자리매김하고 있다. 이제 우리는 언제든 인터넷이 연결되어 있는 곳이면 어디서나 일상을 이어갈 수 있다. 대부분 오프라인에서 구현되었던 서비스와 기능들이 플랫폼에 의해 제공되고 있다. 나아가 온라인 플랫폼은 획기적으로 이용자의 시간과 비용을 절약해주고 편리함을 높여주었다. 갈수록 온라인플랫폼에 대한 의존도는 심화될 것으로 예상된다.
경우에 따라 특정 온라인 플랫폼 서비스들은 하나의 사업자나 그 계열 사업자에 의해제공될 수 있다. 어떠한 온라인 플랫폼이 특정 영역에서 시장지배력을 갖는다면, 그 자체로 문제가 된다. 이러한 시장지배력은 다른 시장으로 쉽게 전이될 수도 있는 상황이다.
뿐만 아니라, 온라인 플랫폼에서 제공되는 필수적인 서비스(생존배려 서비스)로부터 소외되어 발생하는 문제는 더 심각할 수 있다. 오늘날 온라인 플랫폼은 디지털 사회에서 기본적 수요의 충족과 사회적 참여의 전제가 되고 있기 때문이다. 이러한 필수적인 서비스에 접근할 수 없다면, 정상적인 사회경제적 생활에도 지장을 초래한다.
이처럼 온라인 플랫폼의 중요성과 영향력이 확대되고 이로 인한 문제가 발생하면서, 이에 대응하기 위한 합리적인 규제체계의 논의도 한창이다. 온라인 플랫폼 시장의 시장획정, 시장지배력 보유 여부에 대한 견해의 불일치, 시장지배력 전이 효과 인정의 인색함등으로 기존 경쟁규제는 한계에 봉착했기 때문이다.
그럼에도, 독일, EU, 그리고 우리나라는 온라인 플랫폼에 대해 여전히 기존 경쟁규제의 틀이나 경쟁규제의 변형을 통해 대응해왔다. 그러나 EU P2B 규칙을 시작으로 독일의경쟁제한법(GWB) 제10차 개정, EU의 디지털시장규칙(DMA)과 디지털서비스규칙(DSA)은온라인 플랫폼에 대한 전문규제 방식의 사전적·확정적 의무 부과 등 혼합형 규제체계로 변화하는 모습을 보여주고 있다.
한편, 생존배려 서비스가 온라인 플랫폼으로 제공되거나, 온라인 플랫폼 그 자체가 생존배려 서비스로 취급될 수 있다. 이때 국가는 이러한 인프라 서비스가 적절히 제공될수 있는 규제체계를 만들 헌법상 임무를 부담하게 된다. 이에 따른 규제체계로는 전문규제체계가 적합하다.
이상의 고려요소를 종합하면, 온라인 플랫폼의 시장지배력, 그 남용으로 인한 경쟁제한성과 이용자에 대한 착취남용 문제는 경쟁규제의 틀에서 풀어가는 것이 바람직하다고본다. 이에 반해, 생존배려 기능과 관련되는 온라인 플랫폼의 문제는 전문규제로 대응하는 것이 합리적이다. 그러나 모든 온라인 플랫폼이 생존배려 인프라로 분류될 수는 없다.
온라인 플랫폼의 유형화가 필요하다.
따라서 경쟁규제와 전문규제의 조화로운 역할 분담이 이루어져야 한다. 다만, 최소한검색엔진이나, 여론형성에 영향을 미치는 SNS 또는 일부 온라인 동영상서비스(OTT)는전문규제가 필요하다. 또한, 전통적인 생존배려 서비스를 플랫폼화 한 온라인 플랫폼도기간 인프라로서의 기능을 인정해야 한다.

영어초록

Online platform services are deeply established in our lives. Now, we can continue our daily lives anytime, anywhere, wherever there is an internet connection. Most of the services and functions that were implemented offline have become platformisation. Online platforms have dramatically saved users' time and money, and increased convenience. The dependence on online platforms is intensifying.
However, most services can be provided by one operator or its affiliates. This market power of online platforms in certain service areas is not only a problem, but also the market power can be easily spread to other markets. The problem of alienation from the essential services(services of general interest) of provided on online platforms is more serious. Today, online platforms are the premise for the fulfillment of basic needs and social participation in the digital society. If essential services are not accessible, it also hinders normal economic and social life.
As the importance and influence of online platforms expand, discussions on reasonable regulatory systems to respond to them are also demanding. This is because existing competition law has faced limitations due to market definition of the online platform market, disagreement on whether to retain market power, and, if so, acceptance of whether to leverage platform's market power into other markets.
Nevertheless, Germany, the EU, and Korea have still responded to online platforms through the existing framework of competition law or reforms of competition law. Starting with the EU P2B regulation, Germany's 10th revision of the Act against Restraints of Competition (GWB), and the EU's Digital Market Act (DMA) and Digital Services Act (DSA) are changing into a mixed regulatory system. They are the way of sector-specific regulation like as the imposition of ex ante and definitive obligations on online platforms. Furthermore, if the services of general interest are provided as an online platform or the online platform itself is the services of general interest, the state must ensure as a constitutional mandate to create a regulatory system(sector-specific regulations) in which such infrastructure services can be properly provided.
Taking the above factors into account, it is desirable to resolve the issues of market dominance of online platforms, restrictions on competition due to their abuse, and exploitation and abuse of users within the framework of competition law. On the other hand, it is reasonable to respond to the problem of online platforms related to the services of general interest with sector-specific regulations.
However, not all online platforms can be classified as the infrastructure related the services of general interest. It is necessary to categorize online platforms.
Therefore, a harmonious division of roles between competition law and sector-specific regulations should be made. However, at least search engines, SNS that influence for the formation of public opinion, or some online video services (OTT) require sector-specific regulations. In addition, online platforms that has turned the traditional services of general interest should also recognize their function as infrastructure.
