세무플랫폼 서비스에 관한 헌법적 연구 (A Constitutional Study on Platform Services in the Field of Taxation)

초록

사업자와 소비자를 연결시키는 플랫폼은 IT기술을 바탕으로 하는 온라인을 이용하면서 본격적으로 주목을 받기 시작하였다. 특히 웹 2.0의 시대부터 본격적으로 등장한 온라인 플랫폼은 IT기술과 접목한 경제환경의 변화와 맞물리면서 급격하게 경제영역에 진입하였다. 플랫폼 사업은 거대 정보통신기업의 참여로 글로벌 대형 온라인 플랫폼이 등장하면서 독과점화를 통한 경쟁의 공정성이 담보되지 못하여 이를 규제하려는 움직임이 나타나고 있다.
우리나라는 온라인 플랫폼의 시장집중을 규제하기 위하여 통신규제의 형식으로 전기통신사업법을 지속적으로 개정하였다. 그런데 전기통신사업법을 통하여 온라인 플랫폼을 규율하는 것은 플랫폼이 통신을 이용한다는 점에 초점을 맞춘 것이어서 규율에 한계가 있다. 이 문제를 해결하기 위하여 플랫폼 자체를 규제하는 플랫폼 공정화에 초점을 맞추고 온라인 플랫폼 중개거래의 공정화를 위한 법률안이나 디지털 플랫폼 발전과 이용자보호를 위한 법률안 등을 놓고 국회에서 해당법률 제정에 관한 논의가 진행되고 있다. 그런데 온라인 플랫폼에 대한 규제법에 관한 논의는 계속되고 있지만 아직 법제화가 되지 못하고 있다.
이와는 별개로 전문분야에서는 플랫폼의 문제가 법적 분쟁화하고 있다. 전문분야 플랫폼 문제는 플랫폼 시장에서 2010년대 중반부터 시작되었다. 전문분야 플랫폼은 처음에 전문직 종사자를 소개하는 형태로 출발하였지만 점차 중개사업자로서 기능하면서 전문직의 특수성과 충돌하는 문제를 야기하였다. 이러한 충돌의 대표적인 사건이 대한변호사협회와 로톡이란 리걸 플랫폼 간의 분쟁이다. 헌법재판소는 대한변호사협회의 변호사 광고규정의 대부분에 대하여 합헌이라고 판단하였지만, 로톡 자체가 위헌이라고는 하지 않았다.
전문분야에서 플랫폼 문제는 의료분야, 세무분야에서도 발생하고 있다. 특히 세무분야 플랫폼 분쟁은 2021년 한국세무사회와 세무분야 플랫폼인 삼쩜삼 간에 발생하였다. 한국세무사회는 삼쩜삼에 대하여 무자격자에 의한 세무대리 광고와 업무수행 등을 이유로 수사당국에 고발하였다. 이 사건과 관련하여 2021년 개정된 세무사법 제2조의2에서 세무대리의 소개 및 알선금지를 규정함으로써, 이 규정이 세무분야에서 직무의 공정성⋅전문성 등을 확보하기 위한 것인지, 아니면 세무 플랫폼 기업이 영업활동에 있어서 그 자유를 과도하게 침해하는 것인지에 대한 논란이 있다. 그런데 플랫폼 사업 자체에 대한 규제는 직업의 자유 관점에서 하기 어렵다. 오히려 향후 전문분야에서 플랫폼 사업은 더욱 확산될 것이다.

영어초록

The platform that connects business operators and consumers began to receive attention in earnest as they used IT technology-based online. In particular, the online platform, which appeared in earnest from the era of Web 2.0, rapidly entered the economic realm in line with the changes in the economic environment combined with IT technology. In the platform business, with the emergence of large global online platforms with the participation of giant information and communication companies, fairness of competition through monopoly and oligopoly cannot be guaranteed, so there is a movement to regulate it.
Korea has continuously revised the Telecommunications Business Act in the form of communication regulation to regulate the market concentration of online platforms. However, regulating online platforms through the Telecommunications Business Act focuses on the fact that platforms use communication, so there is a limit to the regulation. In order to solve this problem, the National Assembly is discussing the enactment of the relevant laws, focusing on platform fairness that regulates the platform itself, and bills for fairness in online platform brokerage transactions or bills for digital platform development and user protection. there is. However, discussions on the regulation of online platforms continue, but they have not yet been enacted.
Apart from this, in the professional field, the problem of the platform is becoming a legal dispute. Problems with professional platforms began in the mid-2010s in the platform market. The professional field platform initially started as a form of introducing professional workers, but gradually functioned as a brokerage business, causing a problem of conflict with the specificity of the professional job. A representative case of such conflict is the dispute between the Korean Bar Association and the legal platform called Rotalk. The Constitutional Court judged that most of the lawyer advertisement regulations of the Korean Bar Association were constitutional, but did not say that Rotalk itself was unconstitutional.
In the professional field, platform problems are also occurring in the medical and tax fields. In particular, a platform dispute in the tax field occurred in 2021 between the Korea Tax Association and the tax platform Samjeomsam. The Korea Tax Service Association filed a complaint with the investigative authorities against Samjjeomsam for advertising and performing duties as a tax agent by an unqualified person. Regarding this case, Article 2-2 of the Tax Accountant Act, amended in 2021, stipulates the introduction and prohibition of mediation of tax agents. There is a controversy over whether the freedom is excessively infringed upon in activities. However, it is difficult to regulate the platform business itself from the perspective of freedom of work. Rather, it is expected that the platform business will spread further in the specialized field in the future.
