전자파 규제의 법적성격과 인체영향 입증책임 연구 (A Study on the Legal Nature of EMF Regulation and Burden Proof of Human Effects)

초록

전자파의 인체 유해성에 대한 논란은 지속되고 있으나 인체에 어느 정도까지 미치는지에 대해서는아직까지 과학적으로 밝혀진 것은 없다. 그러나 전 세계적으로 전자파를 위험요소로 인식하며, 일반공중보건이라는 공익 목적을 위해 다양한 방법으로 전자파를 규제하고 있다. 국내의 경우에도 전파법에서 국제기준을 준용하여 전자파 인체보호기준을 고시하고 있다.
그러나 인체보호기준은 무선설비 등 전자파를 발생시키는 기기에 대한 규제이며, 그 어디에도 전자파로 인한 손해가 발생한 경우 이에 대한 법적 책임에 대해서는 규정하고 있지 않다. 전자파로 인하여인체 등 손해가 발생한 경우 그 손해를 국민 개인이 부담하고 그 원인의 제공자인 전자파를 발생시키는 무선설비의 소유자는 면책된다는 것은 실질적 법치국가의 원리에 부합하지 않는다는 문제가 있다.
민법상 불법행위책임의 경우 가해자(즉, 제조사 및 이동통신사업자)의 고의 또는 과실과 위법성을인정하기 어렵고 과학적으로 인체 유해 여부가 밝혀지지 않은 전자파와 손해 사이의 인과관계를 일반국민들이 입증한다는 것은 불가능에 가깝다. 무과실책임(위험책임)을 인정하기 위해서는 관련 법률의규정이 있어야 하는 바, 전파법은 관련 규정이 없어 전파법으로는 무과실책임에 의한 손해배상청구는할 수 없다. 무과실책임을 규정하고 있는 제조물책임법에 따른 손해배상책임은 제조사 및 이동통신사업자가 전자파 인체보호기준에 따라 적합하게 제조하였다면, 해당 제조물을 공급한 당시의 법령에서정하는 기준을 준수하였으므로 면책사유에 따라 손해배상책임이 면책된다. 또한 환경정책기본법의 경우 전자파를 환경오염이나 환경훼손으로 볼 수 없다는 문제가 있다.
따라서 본 논문에서는 국민의 생명과 재산의 보호 등은 헌법상 자연법사상에 따라 인간의 존엄과가치존중의 원리와 결합하여 기본권 보장의 기초를 이루는 것이므로 공법상 무과실책임은 개인의 권익구제의 확대를 위하여 입법적인 해결이 요청된다. 전자파로 인하여 인체에 유해한 손해가 발생하였다면 이를 배상해 줄 수 있는 무과실책임의 법적근거를 헌법상 기본권 보장 차원에서 검토하였다. 또한 사전주의 원칙을 적용하여 입증책임의 전환 여부를 검토하였다.
다만, 비록 과학적으로 전자파의 인체영향 정도가 증명되지는 않았지만, 전자파로 인한 피해의 손해배상을 주장하는 사람들의 인과관계 증명책임 완화와 나아가 소송법상 공격권 및 방어권의 보장을위해 입법적으로 해결하는 것이 필요한 시점이라고 사료된다.

영어초록

The controversy over the harmfulness of the human body to electromagnetic waves is continuing, but scientific discovery about how much it affects the human body has not yet been proven. However, electromagnetic waves are recognized as a risk factor worldwide, and regulated in various ways for the public purpose of general public health. Also, in Korea, electromagnetic wave protective standard(Technical Requirements for Human Exposure to Electromagnetic Waves) is notified in RADIO WAVES ACT by applying international standard.
This protective standard has a legal characteristic as statutory supplementary administrative rules.
However, the protective standard is a regulation on devices that generate electromagnetic waves, such as radio equipments, and does not specify liability for legal responsibility for any damages caused by electromagnetic waves. When there is damage to the human body caused by electromagnetic waves, it is a problem that the individual suffers damage and the owner of the radio equipment generating the electromagnetic wave which is the cause of the damage is exempted, and it is not in conformity with the principle of a law-governed state. In the case of tort liability under the civil law, it is difficult to recognize the intentions or negligence or illegality of the perpetrators (ie, manufacturers and mobile telecommunication carriers), and it is almost impossible for the general public to prove the causality between electromagnetic waves and damages that have not yet been scientifically determined to be harmful to humans.
In principle, in order to accept strict liability, there must be a statutory regulation clause, but in the Radio Law, there is no provision related to this, so the victim can not claim damages by strict liability under the Radio Law. Liability for damages under the Product Liability Law which stipulates strict liability, if the manufacturer and the mobile communication carriers manufactured products appropriately in accordance with the electromagnetic wave protection standards, it shall be deemed to be in conformity with the standards set forth in the laws and regulations at the time of supplying the products. Accordingly, liability for damages is excluded. In addition, there is a problem that electromagnetic waves can not be viewed as environmental pollution or environmental degradation in the Basic Environmental Policy Act.
The protection of the lives and property of the people constitutes the foundation of the basic rights guarantee in accordance with the principles of human dignity and value respect in accordance with the natural law ideology in the Constitution. Therefore, in order to expand the rights and benefits of the individual, this article suggests the legislative solution of strict liability in the public law. And when the damage caused by electromagnetic waves, the legal basis of the strict liability for the compensation was reviewed in terms of a guarantee of constitutional rights. Also, applying the precautionary principle, whether to convert the burden of proof was reviewed.
Although it is not scientifically proven that the degree of human influence of electromagnetic waves, there is a need to alleviate the burden of proving causality for those claiming damages due to electromagnetic waves. Furthermore, it have to considered that a legislative solution is needed to guarantee the right of offense and the right of defense under the Procedure Law.
