통일한반도의 행정통합 법제화 방안의 구상에 관한 고찰 (A Study on the Legislative Plans for Administrative Integration in the Unified Korean Peninsula)

초록

한반도통일은 남북한 합의하에 평화적인 방법으로 추진되어야 하고, 통일한반도는 민주주의를 구현하며, 복지국가를 지향하여야 한다. 이를 위해서는 여러 통일과제 중 특히 행정통합의 법제화 방안의 준비가 핵심이 되어야 할 것이다.
이러한 통일 법제를 연구함에 있어서 통일독일의 행정통합 법제화 사례를 고찰함은 통일이후의 수많은 난점들을 어느 정도 미리 대비할 수 있을 것이라는 점에서 큰 의미가 있다고 할 것이다. 통일독일의 경우는 무엇보다도 조기통일로 인하여 통일 준비의 실질적 기간이 절대적으로 부족했던 것이 가장 큰 문제점이었다. 이로 인해서 결국 내적 통합으로 이어지지 못하고 동독주민들의 ‘이등 시민화’ 등의 갈등이 아직도 해결되지 못하고 있는 것이다.
이러한 난점들이 한반도의 통일과정에서도 드러날 가능성이 높으므로 아직 통일을 준비할 시간적 여유가 있을 때 미리 통일을 대비한 행정통합 법제화 방안의 구상에 관한 연구들이 이루어 져야 할 것이다. 이러한 취지에서 본고에서는 먼저 통일독일의 행정통합 법제화 사례를 살펴보고, 통일한반도의 법제화 방안의 구상에 관하여 살펴보고자 한다.
결국 한반도 통일과정에서는 행정통합 법제화의 이론과 계획이 통일국가의 지역에 적용·시행됨에 있어서 ‘현실 격리감’의 폭을 얼마나 줄일 수 있는가 하는 점이 핵심적 과제이다. 그리고 한반도통일 역시 점진적 통일방향에 맞추어 단계적·점진적인 행정통합 법제화를 계획·실행하여야 할 것이다. 또한 이를 통하여 민족의 동질성을 회복하고 북한 지역민들이 차별받고 소외되지 않는 통일한반도를 지향하고 수립해 나간다는 사명으로 행정통합 법제화 방안을 모색하고 연구하여 진정한 통일한반도를 수립하여야 할 것이다.

영어초록

It is obvious that unification of Korean Peninsula should be proceeded with in a peaceful way under mutual consent, the Unified Korea should embody democracy and aim at welfare state. Above all, Racial homogeneity should be recovered and Integration should be done without discrimination and alienation for North Korean people.
To do this, It would be essential to suggest blueprint about unification process and its concrete implementation plans. We can know through the case of unification of East and West Germany that the Administrative Integration is a very important task.
In this regard, It is important to study on the legislation of the Administrative Integration in the Unification Germany. And in divided country, The Process to achieve the legislation of the Administrative Integration should take the more care to emotion of the residents. Unless It would be likely to run into new problems in the unified national identity and acceptance.
And It should keep in mind that the Process of Integration should not force to a oppressive achievement in the divided country. These factors did not proper consideration in the Process of the Unification of Germany, which would be act to a very important issues in this case of country that have divided experience for 60 years or more.
As A Unified law and the Legal System in relation to Integration is very formal level, it is important that people feeling of the people by finding their identity for the new unified country through the legal system in their own country by their own acceptance. Thus, All of the Plans that related to the Legal System and its Integration should be focus on such the point in whole or in part.
And I agree with that “Throughout the past 40 years, the fastest way to achieve for the Unification in divided country that passes through a step by step process” by Siegfried Broß judge's view. And gradual unification planning and gradual Administrative Integration should be enacted in accordance with the directions in Unification of Korean Peninsula.
Accordingly, It would be important that A study on the Legislative Plans for Administrative Integration consider to how to reduce the width of discrimination of reality in the unification process of Korean Peninsula.
