초록

This research aims to identify the trends, problems and future challenges of the study on each area of North Korean law over the past 40 years since ‘the embryonic period in the relationship between North and South Korea’ in the 1970s. That is to say, the objectives of this research consist in examining what we need to prepare for the future unification of Korea, besides the research direction & issues, by exploring how much progress has been made in the study on the legal system for the unified Korea, along with the proceedings of the work.
The research on the law in North Korea has been made from a perception of the need for policy response, with the launch of the Board of National Unification (currently, Ministry of Unification). Accordingly, though the research on the law in North Korea was a realistic necessity, it has been a relatively neglected area, as an academic research theme. However, recently, there has been a considerable progress made in the study of North Korean law.
It was not until in the 1970s that the research on the North Korean law began, and the unification of Germany and Yemen in the 1990, which had been a divided country, served as a momentum to do a practical research on it. The adoption of ‘6.15 Joint Declaration’ in the inter-Korean summit talks brought about the prime time for the research on the North Korean law and Unification law.
This research intends to comprehend the current status and trends on the study of North Korean law through the periodic analysis of it, by classifying it into areas, issue, key words. First of all, the research proceedings will be examined by dividing the periods into the 1970s, 80s, 90s, the 2000s.
The demand for experts on the law in a government-affiliated organizations is very high. The government needs to establish legal infrastructure at government level by being equipped with legal team to support this professionally, not entrusting universities or civic groups with legal research. It is desperately needed to strengthen legal team now that it is 40 years since ‘the embryonic period in the relationship between North and South Korea’
