현행 스토킹처벌법의 문제 진단과 입법 정책적 관점의 개선방안 연구 (A Study on the Diagnosis of Problems in the Current Stalking Punishment Act and the Improvement Measures from a Legislative Policy Perspective)

초록

2021년 3월 23일 노원구에서 세 모녀가 살해되는 안타까운 사건이 발생한 다음날 국회는 본회의를 열고 스토킹처벌법 제정안을 의결했다. 이후 지난 4월 20일 스토킹처벌법이 제정되어 10월 21일부터 시행되었다. 스토킹처벌법이 수차례의 임기만료폐기와 재발의를 거친 후 22년 만에 스토킹 행위는 징역 3년 이하 또는 3천만 원 이하의 벌금이 부과되고, 흉기 등을 이용할 경우 5년 이하 징역, 5천만 원 이하의 벌금으로 처벌받게 되었다. 스토킹처벌법이 제정된 것은 큰 의미를 가지지만 스토킹범죄를 예방하기 위한 현행 법률의 실효성에 관해서는 여전히 그 한계를 지적하는 우려의 목소리가 높다. 특히 피해자 보호를 위한 긴급조치와 잠정조치만이 규정되어 있어 실질적인 피해자 보호방안이 상당히 미흡한 실정이다.
따라서 본 연구는 스토킹범죄의 정의 및 특징 등을 고찰한 후 외국의 스토킹 관련법을 통한 대책 등을 살펴보고 우리나라의 스토킹범죄 신고 및 사법처리 현황을 분석하였다. 또한 2021년 4월 20일 제정된 스토킹처벌법의 문제를 크게 반의사불벌 조항, 지속성․반복성을 요하는 범죄성립 요건 및 불확정개념의 문제, 피해자 보호조치의 문제, 가중 처벌 문제, 사이버스토킹 처벌 문제 등으로 구분하여 입법적 보완사항을 제시하였다. 아울러 스토킹범죄의 피해자 보호 및 지원 방안으로 긴급지원대상자에 포함시켜 긴급생계지원 등을 요청할 수 있도록 법적 근거를 마련할 것을 제안하였다. 마지막으로 정책적 차원에서 스토킹범죄를 예방하고 피해자를 지원하는 스토킹 지원센터를 설치하여 지역사회 경찰 등 유관기관과 전문가들 간의 연계 및 협조를 통해 신고체계를 구축해야 한다. 이밖에도 피해자 보호 및 지원 방안 등 피해자가 체감할 수 있는 실질적인 보호조치를 마련할 필요가 있다.

영어초록

On March 23, 2021, the day after the unfortunate incident in which three mothers and daughters were murdered in Nowon-gu, the National Assembly held a plenary session and decided to enact the Stalking Punishment Act. After that, the Stalking Punishment Act was enacted on April 20 and came into effect on October 21. After 22 years of stalking punishment after the stalking punishment law has been abolished and reissued several times, stalking is fined less than 3 years in prison or 30 million won, and if using a weapon, it will be punished with imprisonment for 5 years or less and fines of 50 million won or less. Although the enactment of the Stalking Punishment Act has great significance, there are still high voices of concern pointing out its limitations regarding the effectiveness of the current law to prevent stalking crimes. In particular, only emergency measures and provisional measures are stipulated to protect victims, so the actual measures to protect victims are quite insufficient.
Therefore, this study examines the definition and characteristics of stalking crimes, then examines countermeasures through foreign stalking-related laws, and analyzes the status of reporting and judicial processing of stalking crimes in Korea. In addition, the problems of the Stalking Punishment Act enacted on April 20, 2021 are largely addressed, such as the non-intentional punishment clause, the criminal establishment requirements requiring continuity and repeatability, the problem of indeterminate concepts, the problem of victim protection measures, the problem of aggravated punishment, the problem of cyber stalking punishment, etc. and proposed legislative supplements. In addition, it was proposed to prepare a legal basis for requesting emergency livelihood support by including it as a means of protecting and supporting victims of stalking crimes. Lastly, at the policy level, a stalking support center that prevents stalking crimes and supports victims should be installed to establish a reporting system through linkage and cooperation between relevant organizations such as the local police and experts and experts. In addition, there is a need to prepare practical protection measures that victims can feel, such as measures to protect and support victims.
