스토킹범죄 방지를 위한 법제 개선방안 (An Improvement Plan for Legislation to Prevent Stalking Crimes)

초록

「스토킹처벌법」이 시행되고 2023년 7월 스토킹행위자 처벌의 강화와 재발방지를 위한 개정이 이루어졌다. 이렇듯 스토킹행위를 처벌할 수 있는 법적 근거가 마련되었지만 우리사회는 여전히 스토킹행위에 대한 인식의 부족과 행위유형이 적립되지 않아 비슷한 스토킹 행위일지라도 전혀 다른 판결의 결과가 나타나고 있어 명확한 법과 제도의 개선이 요구되고 있다. 스토킹행위는 초기에 가볍고 단순한 행위에서 시작하여 점차 집착으로 이어져 결국에는 살인에까지 이르게 되는 중대한 범죄이므로 보다 구체적이고 체계적인 법률의 개정이 이루어져야 할 것이다. 이에 따라 최근 급증하는 스토킹범죄를 근절하기 위해서는 스토킹행위와 범죄를 포괄할 수 있는 보충규정을 두는 개정을 통해 그동안 스토킹처벌법에서 포섭할 수 없었던 행위까지 처벌할 수 있는 법적근거를 마련해야 할 것이며, 상대방 또는 그의 동거인, 가족으로 한정되어 있는 스토킹 보호대상을 피해자의 주변에 사람들로 확대하여 보호대상의 범위를 넓게 인정해야 할 것이다.
또한 현행법에서는 스토킹피해자에 대한 치료 및 상담은 지원하고 있으나 스토킹행위자에 대한 심리상담 같은 치료처우는 지원되고 있지 않기 때문에 스토킹 신고 이후 행위자에 대한 상담이나 치료처우가 제도적으로 이루어져야 하며, 스토킹범죄의 특성상 출소 후 피해자에 대한 보복이나 위해의 우려가 높아 교정시설 내에서 범죄 유형에 따른 치료·교육프로그램의 필요하다.
최근 스토킹범죄 유형이 정보통신망을 통해 피해자의 개인정보나 위치정보를 활용하여 발생되기 때문에 피해자의 개인정보에 접근하는 것을 원천적으로 차단할 수 있는 시스템을 개발하여 적용한다면 스토킹범죄의 피해가 현저히 감소할 것으로 판단된다. 스토킹범죄는 지금까지 우리가 알고 있던 전통적이고 일반적인 범죄 현상이 아니라 행위자의 이상심리로 인한 범죄로 이를 예방하기 위한 효율적이고 실효성 있는 법과 제도의 보완이 필요한 시점이다.

영어초록

After the stalking punishment law took effect, the amendment was made in July of 2023 in order to intensify the punishment of stalkers and to prevent the recurrence. In this way, the legal basis for penalizing a stalking behavior has been established. But our society has not been accumulated the types of behaviors, in addition to the lack of awareness on a stalking behavior. Even if being similar stalking behaviors, a completely different ruling result is being shown. Thus, there is a need for clear improvement in laws and institutions. Stalking is a grave crime that initially begins with light and simple behaviors and gradually leads to obsession, eventually ending up murder. Therefore, the more specific and systematic revision in laws will have to be made. Accordingly, to root out the recent surge in stalking crimes, the amendment, which puts the supplementary provisions available for including the stalking and crime, will indispensably bring about arranging a legal ground available for punishing even behaviors that have not been possibly embraced by the Stalking Punishment Act in the meantime. The scope of protection targets must be broadly recognized by expanding a stalking protection target, which is limited to the other person, his or her housemate, and his or her family, into people around the victim.
Also, the current law is supporting the treatment and counseling of stalking victims. Nevertheless, the treatment such as psychological counseling for stalking actors is not being backed up. Resultingly, following a stalking report, the counseling or treatment for the actor has to be systematically conducted. Due to the characteristics of stalking crimes, there is a high risk of retaliation or harm to victims after being released from prison. Hence, there is a need for the treatment and education programs in accordance with the types of crimes within the correctional facilities.
In these days, types of stalking crimes have been caused by utilizing the victim's personal data or location information through the information and communication network. The damage of a stalking crime is judged to be likely reduced significantly given developing and applying a system capable of fundamentally blocking the access to the victim's personal information. Stalking is a crime created by an actor's abnormal psychology, not the traditional and common criminal phenomenon that we've ever known so far. It is time for the efficient and effective laws and institutions to be necessarily complemented aiming to avoid this.
