일본 법조인선발방식의 과제에서 본 우리 로스쿨의 발전방향 (The development direction of the South Korean law school seen from the problem of judicial officer people selective system of Japan)

초록

법학전문대학원(로스쿨)을 개원한 지도 어느덧 3년이 되어가고 있다. 내년이면 첫 법학전문대학원 출신 변호사들이 법조시장에 발을 내디디게 된다. 25개의 각 법학전문대학원들은 각기 특색있는 비젼을 제시하며 훌륭한 법조인을 배출하기 위한 노력을 경주하고 있다.
한편 우리보다 5년 먼저 개원을 한 일본의 로스쿨은 그간 많은 문제점 등이 도출되며 이윽고 폐교가 되는 로스쿨까지 보이고 있다. 우리는 변호사시험 응시자격을 로스쿨 출신으로 제한하고 있는 반면 일본은 로스쿨 출신이 아닌 자도 사법시험에 응시할 수 있어 로스쿨의 입지가 더욱더 흔들리고 있는 것이다. 또한 우리가 학부과정을 폐지한 것과 달리 일본은 학부과정을 존치하고 있어 법학교육 및 법조인 양성 방법에 있어 우리와는 사뭇 다른 제도를 유지하고 있다.
로스쿨은 우리의 법학교육에 있어 아주 큰 획을 그은 개혁이라고 할 수 있다. 그간 각 대학의 법학과들은 사법시험에 맞추어 교과목을 개설하는 등 모든 학사운영의 중점이 사법시험에 맞추어져 있어 법학교육의 파행적 운영은 물론 사법시험을 준비하는 수험생들은 오히려 서울의 수험가 등으로 몰려 정상적인 법학교육이 대학에서 이루어지기 힘들었음은 그 누구도 부인할 수 없을 것이다. 이러한 사유로 인해 법학교육의 정상화와 경험이 다양한 자들을 대상으로 법학교육을 실시하여 법조인 선발에 있어 다양화를 꾀하기 위하여 만들어진 제도가 이른바 로스쿨인 것이다.
그간 일선의 교육 현장에서도 새로운 제도의 실시로 인한 혼선이 있었던 것도 사실이다. 이에 일본의 로스쿨 운영과 이에 따른 법조인 선발방식은 이제 막 로스쿨 출신 변호사 배출을 눈앞에 둔 우리에게 적지 않은 시사점을 던져 주리라 생각된다. 이에 본고에서는 일본의 법과대학원 개원의 배경과 현재 법조인 선발방식의 현황과 과제 등을 살펴봄으로서 우리 로스쿨의 나아갈 방향을 모색하여 보는데 그 의의가 있다.

영어초록

Japan will advance the law school introduction as part of the university reform by the reform of the judicial process in 2004, and be established. However, the law school in Japan is low support, and has arrived at the tough going because of a decrease at the new bar examination passing rate now at the time of passed eight years.
he law school in Japan has been managed with a peculiar system only of Japan though introduces the United States system. Japan distinguishes the person who has not ended with the person who ends Department of Law, distinguishes the period of the education, and can say that the point to maintain Department of Law is a difference with the law school in South Korea and the United States. The law school system of Japan that pursues the United States system of the advanced judicial officer person training appears recently enormous difficulties, and gropes for the bill from which it tries to request the clue for the solution.
An actual result has fallen below the ratio of successful applicants of the new bar examination at the establishment this time of the law school though it aimed at 80% from 70%. Moreover, a serious problem has already arrived at the situation in which it cannot find employment in the place of employment that the result of not passing of in those who complete it in a judicial laboratory and about 1000 71 people to the examination is put out for 2007 and a lot of people hope for.
Most of those who complete it about Legal Research and Training Institute by an old bar examination is passes the examination, and situations active as the judge, the public prosecutor, and the lawyer on the contrary. If such a situation continues, the law school continuing will be not significant in Japan. The management situation of such a law school suggests abounding in the law school system of South Korea of just the start.
Then, the current state and the problem of the Japanese judicial officer person selection method will be examined in this text, and it have the machine that thinks about the legal training and the judicial officer person selection method that South Korea actually suits.
