초록

필자는 현재 재판중인 곽노현 교육감 사건을 검찰의 스토리와 다른 스토리로 재구성하였다. 이 사건은 강경선 교수의 깊은 종교적 태도에서 기원한 화해의 스토리라고 판단한다. 이 글의 주장을 크게 세 가지로 정리할 수 있다.
첫째로, 선거법 제232조 제1항 제2호가 사퇴 전에 대가지급에 대한 합의가없는 지원행위마저도 금지한다면 제2호는 행위구조나 목적의 비정상성, 구성요건의 한시성, 법정형의 불균형 등 심각한 문제점을 안고 있으며, 선거후 조속한정치사회적 안정을 추구하는 공직선거법의 기본목적과도 배치된다. 필자는 사퇴 전에 대가지급에 관한 합의가 없다면 선거후 후발적인 지원행위는 구성요건해당성이 없다고 본다.
둘째로, 이 사건의 실체는 선거 이후 악화된 불화와 불평을 타파하고 개인적가혹함을 완화시키려는 회복적이며 대안적 문제해결 과정이었다. 진보세력의단일화라는 사회적 대의를 위하여, 개인적으로는 곽교육감의 당선을 위하여 자진 사퇴한 이후 심각한 선거부채로 인해 곤경에 처한 박명기 교수를 재정적으로 지원해야할 윤리적 보증인 지위가 곽교육감에게는 존재한다. 만약 윤리적보증인 지위가 부정될 때에는 교육감의 증여는 초과의무적 행동에 해당하지만,보증인 지위가 확립될 때에는 그의 증여는 도덕적으로 완전한 의무에 따른 행동으로 규정할 수 있다. 증여는 도덕적으로 완전한 의무에 따른 행동으로 규정할 수 있다.

영어초록

This essay aims at making an alternative story different from the accusation story against Kwak Nohyun, the education superintendent of Seoul against the Public Official Election Act. The epicenter of the alternative story is the deep religious mind of Prof. Kang, superintendent’s best friend, who tried to reconcile the superintendent and Prof. Park, the superintendent-candidate to each other and to lessen Park’s financial predicament caused by election campaign. This essay will be summarized as follows.
The first part of my paper will contend that “crime of candidacy-sale after resignation” stipulated in paragraph 232(1) 2 of the Public Official Election Act is so abnormal that the rational lawyer could not delineate the reasonable sphere of norm application. The provision fails in stipulating the subjective element of crime properly, and contravenes the time-limit of human conduct and election campaign. Therefore, it goes contrary to the leitmotif of the Public Official Election Act which stabilizes the political and social insecurity after the election.
Second, the essence of the event is to restore the uncomfortable relation between Kwak, superintendent and resigned Candidate Prof. Park. It should be considered that civil society’s demand for candidacy unification was an exclusive cause and reason for Park’s resignation of candidacy. According to Election Acts, Park’s campaign cost was not at all covered by the state because of his resignation. It is another serious error of legislator.
Third, crime of selling or buying candidacy after resignation is basically incompatible with the settled customs concerning campaign cost auditing and allotment of political positions in political parties. This provision runs counter to the constitutional principle of equality, in so far as it will be applicable only to the political independents or candidate grounded on the citizen's initiative. Kwak is morally obliged to help emergently Prof. Park, because Park’s financial predicament was brought about through his sacrifice for the social objective of candidate unification. My conclusion suggests that Kwak might take the status of moral guarantee to relieve Park’s extreme financial needs. This money-giving is really either a supererogatory duty or a morally demanded ‘perfect duty’.
