반려동물 층간소음(일명 층견소음) 해결을 위한 입법론적 연구 (A Legislative research to solve Inter-floor noise caused by Companion Animal (aka floor dog noise))

초록

반려동물의 양육인구가 증가하면서 반려동물로 인한 ‘층견소음(층간+견+소음)’ 문제가 새로운 사회적 갈등 요소로 다시 한번 떠오르고 있다. 기존의 사람에 의한 층간소음 문제와는 달리 층견소음은 반려동물의 짖는 소리, 울음소리, 발소리 등으로 인해 법적 규제에서도 벗어나 이웃 간 갈등이 더욱 심화되고 있다.
또한 반려동물 시대에 반려동물의 소음으로 이웃 간의 갈등을 빚어 주민끼리 서로 주먹다짐을 하고 흉기까지 휘두르는 일까지 발생하고 있다.
층견소음에 대한 문제는 규제할 방법이 없다는 점에서 더욱 큰 문제를 발생시킨다. 현행법상 층간소음은 「소음･진동관리법」에 의해 규제된다. 하지만 반려동물 소음(일명 층견소음)은 층간소음으로 규제할 수 없다.
층견소음은 단순한 생활의 불편을 넘어 주거환경의 문제, 법적 분쟁, 정신 건강의 문제 등의 다양한 사회적 문제를 야기 시키고 있어 이를 해결하기 위한 입법론적 방안이 필요한 시기이다.
이에 대한 방안 설정에 있어 명확한 기준의 제시와 근거 법률에 대한 부분 및 관할에 대한 상당한 논의가 필요하겠지만 대안이 없는 시점에서 논의를 위한 시발점 및 마중물로서의 제안을 해 보고자 한다.
첫째, 「소음･진동관리법」과 「공동주택관리법」 등에 의해 규제로서 소음이나 층간소음의 규정을 개정하여 반려동물에 의한 층간소음도 포함시키는 방법, 둘째, 「동물보호법」에 의해 규제로서 제2조 정의 규정에 반려동물에 의한 층간소음(층견소음)을 규정하는 것과 제9조의 적정한 사육･관리 규정이나 신규 규정을 추가하여 반려동물에 의한 층간소음(층견소음)을 규율하는 방법, 셋째, 층견소음의 관할로서 법률마다 관리하는 정부 부처가 다르기 때문에 법률에 따른 관할을 정리하는 방법, 넷째, 명확한 기준의 설정으로 국내의 기준은 「공동주택 층간소음의 범위와 기준에 관한 규칙」 [별표]에 따른 층간소음의 기준을 수정･보완하여 따르거나 횟수, 기간, 지속성, 단위 데시벨(db)의 측정 등을 종합적으로 고려한 과태료나 벌금, 소유권 제한 또는 압류나 몰수 등 다양한 방법과 해외의 기준을 기반으로 국내의 현실에 맞게 도입하여야 하는데 해외는 경고에 따른 행정제재, 과태료와 벌금, 소유권 제한 또는 압류나 몰수, 구금까지도 고려하고 있어 수정･보완 도입하는 방법, 다섯째, 위원회를 통한 중재로서 국토교통부의 중앙 공동주택관리 분쟁조정위원회와 환경부의 중앙환경분쟁조정피해구제위원회, 지방환경분쟁조정피해구제위원회를 통해 강력한 중재 권한을 부여하여 분쟁 및 피해구제를 신속･공정하고 효율적으로 해결하여 국민의 건강 및 재산상의 피해를 구제하는 방법이다.

영어초록

As the number of pet owners increases, the issue of ‘floor noise (floor + dog + noise)’ caused by pets is once again emerging as a new source of social conflict. Unlike the existing problem of floor noise caused by people, floor noise is not subject to legal regulations due to the barking, crying, and footsteps of pets, and is further deepening conflicts between neighbors.
In addition, in the era of pets, pet noise is causing conflicts between neighbors, leading to fist fights and even weapons swinging.
The problem of floor noise is even more problematic in that there is no way to regulate it. Under the current law, floor noise is regulated by the ‘Noise and Vibration Management Act.’ However, pet noise (aka floor noise) cannot be regulated as floor noise.
Floor noise is not only a simple inconvenience in daily life, but also causes various social problems such as problems with the living environment, legal disputes, and mental health issues, so it is time for legislative measures to solve it. In establishing a plan for this, it is necessary to present clear standards and have a thorough discussion on the basis of the law and jurisdiction, but at a time when there is no alternative, I would like to make a proposal as a starting point and a welcome gift for discussion. First, the method of revising the regulations on noise and inter-floor noise as regulations under the ‘Noise and Vibration Control Act’ and the ‘Apartment Management Act’ to include inter-floor noise caused by companion animals; second, the method of regulating inter-floor noise (floor dog noise) caused by companion animals by stipulating inter-floor noise (floor dog noise) in Article 2’s definition provisions as regulations under the ‘Animal Protection Act’ and adding appropriate breeding and management regulations or new regulations under Article 9; third, the method of organizing jurisdiction according to laws since the government departments in charge of managing inter-floor noise are different for each law; fourth, the setting of clear standards; domestic standards should be revised and supplemented according to the inter-floor noise standards in accordance with the Rules on the Scope and Standards of Inter-Floor Noise in Apartment Complexes [Appendix], or various methods such as fines or penalties, restrictions on ownership, or seizure or confiscation that comprehensively consider the number of times, period, continuity, and measurement in decibels (db), etc., should be introduced based on overseas standards to suit domestic reality, but overseas standards should be introduced with warnings. The fifth is a method of introducing revisions and supplements by considering administrative sanctions, fines and penalties, restrictions on ownership or seizure or confiscation, and even detention, and the third is arbitration through a committee, which grants strong arbitration authority through the Central Apartment Management Dispute Mediation Committee of the Ministry of Land, Infrastructure and Transport, the Central Environmental Dispute Mediation and Damage Relief Committee of the Ministry of Environment, and the Local Environmental Dispute Mediation and Damage Relief Committee, to quickly, fairly, and efficiently resolve disputes and damage relief, thereby protecting the health and property of the people.
