초록

21세기는 디지털 혁명과 급격한 인구 변화가 사회 구조와 기능에 심대한 영향을 미치는 시대이다. 이러한 변화는 고등교육의 역할과 책임에 대한 재평가를 요구하며, 고등교육법의 개정 필요성을 부각시키고 있다. 디지털 혁명의 시대에 정보통신기술(ICT), 인공지능(AI), 빅데이터, 사물인터넷(IoT) 등의 발전은 교육의 접근성과 방식, 내용 모두에 혁신적인 변화를 초래했다. 특히 COVID-19 팬데믹은 원격 교육의 필요성과 가능성을 극명하게 보여주었다. 그러나 현행 고등교육법은 전통적인 교육 방식을 중심으로 구성되어 있어 급변하는 교육 환경에 대한 유연한 대응이 부족하다. 이를 개선하기 위해 디지털 교육 인프라 강화, 온라인 교육의 질 관리, 개인정보 보호 및 사이버 보안 강화 등의 법적 근거 마련이 필요하다. 인구 감소와 고령화로 인한 지역소멸은 고등교육의 새로운 도전 과제이다. 많은 대학이 학생 수 감소로 운영에 어려움을 겪고 있으며, 특히 지역대학의 상황이 심각하다. 지역 특성에 맞춘 맞춤형 교육 프로그램 개발, 지역 연계 교육 강화, 고령화를 고려한 평생교육 프로그램 도입 등이 요구된다. 또한, 대학의 자율성을 보장하고 산학협력을 촉진하여 지역 경제와 사회에 기여할 수 있는 방안을 모색해야 한다.
본 논문은 고등교육법의 개정 방향으로 디지털 혁명과 인구 변화에 대한 법적 대응 방안을 제시하며, 대학의 자율성 강화, 평생교육 활성화, 산학협력 촉진 등의 전략을 제안한다. 이를 통해 고등교육이 사회적 요구를 충족하며, 지속 가능한 발전을 이루는 데 기여할 수 있도록 하는 법적, 제도적 기반을 마련하고자 한다.

영어초록

The 21st century is an era where the digital revolution and rapid demographic changes significantly impact social structures and functions. These changes necessitate a reevaluation of the roles and responsibilities of higher education, highlighting the need for amendments to higher education laws. In the era of the digital revolution, advancements in information and communication technology (ICT), artificial intelligence (AI), big data, and the Internet of Things (IoT) have brought about revolutionary changes in the accessibility, methods, and content of education. The COVID-19 pandemic, in particular, has starkly demonstrated the necessity and potential of remote education. However, current higher education laws are predominantly structured around traditional educational methods, lacking the flexibility to adapt to the rapidly changing educational environment. To address this, it is essential to strengthen digital education infrastructure, ensure the quality of online education, and establish legal grounds for enhancing privacy protection and cybersecurity.
The challenges posed by demographic decline and aging, leading to regional extinction, present new issues for higher education. Many universities are struggling with reduced student numbers, and the situation is particularly dire for regional universities. There is a need for developing customized educational programs tailored to regional characteristics, strengthening regional cooperative education, and implementing lifelong education programs considering aging populations. Additionally, ensuring the autonomy of universities and promoting industry-academia cooperation are crucial for universities to contribute to regional economies and societies.
This paper proposes directions for amending higher education laws in response to the digital revolution and demographic changes. It suggests strategies such as enhancing university autonomy, promoting lifelong education, and fostering industry-academia cooperation. By doing so, it aims to establish the legal and institutional foundations necessary for higher education to meet societal demands and achieve sustainable development.
