MB 정부의 지방자치(행정)체제의 광역화 개편정책과 최적합 자치경찰모형의 탐색 (The Study on the MB Government′s Enlargement-Reforming Policy of the Local Autonomous (Administration) System and the Search of Optimal Autonomous Police System Model)

초록

MB 정부가 출범한지도 벌써 2년이 경과되었다. MB 정부는 정권인수를 통하여 지방분권과 자치경찰제 도입을 중요정책과제로 인수하여 “이명박 정부 100대 국정과제”에 포함하여 발표하였다. MB 정부에 와서는 지방정책을 크게 바꿨다. 전국을 5+2광역경제권으로 7개 권역으로 나누어 광역적 접근방식을 택하였다. 그동안 지지부진한 지방행정구역 개편에 있어서도 기초자치단체의 통합 정책드라이브 결과, 전국에서 가장 먼저 창원․마산․진해시가 통합에 합의함에 따라 인구 110만의 최대 통합기초자치단체의 등장이 현실화 되었고, 이어질 전망이다. 이런 정책기조는 지방자치체제의 개편에 지대한 영향을 미칠 것이고, 자치경찰제도입의 방향에도 근본적인 변화가 불가피하게 되었다. 역대 정부들은 국립경찰의 폐해를 불식하는 제도개선방안으로 자치경찰제도입을 시도하였으나, 딜레마에 빠져 있다.
자치경찰제 입법시안은 지난정부에서 만들어진 것을 일부분 수정을 가했으나 기초단위자치경찰제 도입의 근간을 유지하는 내용으로 알려져 있다. 이에 대하여 전국시도지사협의회가 자치경찰제를 시도단위로 전환해야 한다는 주장을 지난정부 때부터 고수하고 있다. 현재 정부에서 기존시안의 수정이 논의되고 있으며, 당정도 계속 협의 중에 있고, 또한 지방행정체제와 연계추진을 고려 중인 것으로 알려졌다.
이 논문의 목적은 MB 정부의 광역적 지방자치체계의 개편과 이에 대응하는 최적 자치경찰제 모형을 탐색하는 것이다. 논의는 먼저 지방자치(행정)체제의 개편의 쟁점과, 광역적 개편의 당위성을 인식한다. 다음 기존의 자치경찰제의 선행연구의 이론과 도입시안에서 쟁점으로 부각되어 있는 정부의 안과 시도지사협의회의 안에 대하여 비교․검토하였다. 끝으로 MB정부의 광역적 지방자치체제의 개편에 대응하는 자치경찰제 모형을 제시하였다. 정책대안으로 고려할 수 있는 3가지모형인 기초단위자치경찰제모형, 광역단위자치경찰제모형 및 절충형 자치경찰제모형에 관하여 분석･제시하였다.
결론적으로 MB 정부의 지방자치(행정)체제에 대한 광역적 개편정책 방향에 대비하는 자치경찰제도입 모형으로 경찰조직의 민주성과 효율성의 이념적 균형과 경찰분권화원리에 따라서 절충적 자치경찰제모형을 최적모형이라 판단되어 정책제언 한다.

영어초록

The purpose of this paper is to search of optimal model of the local autonomous police system to adapt to the enlargement-reform of the local administrative system. This study is ①MB government announced the national policy agenda named "Lee Myung Bak's government great 100 issues." including that the decentralization of the local autonomous administration system and the introduction to the local autonomous police system which from the power acquired by the previous government as have to promoting. ②MB government has changed local policy significantly. The 5 +2 wide economies zone in the country wide area enlarged and divided into seven districts. This enlargement policy will give a profound impact on the reforming or deviation of the decentralization of local government system as well as local autonomous police system. ③Been no progress regarding the local government areas to shake up the integration of government policies drive the results, the first in the nation, Changwon. Masan. Jinhae agreed to integration. Therefore a huge population of 110 million unique integration based on the emergence of local governments has been a reality, the future will lead. ④Therefor local government in the policy direction of the introduction to fundamental changes were expected. This policy direction from that discussed so far in the profound reforming of local government system will affect, and introduction of deviation of the process and results of the police, even notice the change is inevitable.
According to the analytic result of the an alternative to consider three kinds of local autonomous police system model introduced first, local autonomous police system in basic unit based on the model. second, the local autonomous police system in wide unit area based on the model and the hybrid model as an alternative capacity in the country or the combination of convergence. The police need to be successful is an important task of the policy.
In conclusion and policy recommend, hybrid local autonomous police system model is decided as the optimum model depending on the ideological balance the police organization's efficiency and the democratic, and depending on the principle of decentralization of the police power, Hybrid local autonomous police system model is the best policy alternatives are determined. hybrid local autonomous model to adapts to MB Government's enlargement-reforming policy environment.
