인터넷 개인방송의 아동･청소년 출연자 권익보호에 대한 연구 (A Study on the Protection of the Rights and Interests of Children and Youth Performers in Internet Personal Broadcasting)

초록

본 연구는 현행 국내법에서 인터넷 개인방송에 출연하는 아동･청소년의 권익 보호 법령과 지난 2020년 6월에 방송통신위원회가 공표한 인터넷 개인방송 아동･청소년 출연자를 위한 지침의 내용을 살펴보고, 인터넷 개인방송 플랫폼 사업자들이 마련해놓은 ‘운영지침’과 ‘청소년 보호정책’에 현행 법령 및 지침이 반영되어 있는지를 알아보고자 하였다. 분석결과, 주요 인터넷 개인방송 플랫폼 사업자의 ‘운영정책’과 ‘청소년 보호정책’에는 아동･청소년 보호 규정이 여전히 콘텐츠 내용에 대해서만 규정하고 있으며, 유튜브를 제외한 대부분의 국내외 인터넷 개인방송 플랫폼 사업자는 아동･청소년 출연자의 학습권, 수면권, 휴식권, 자유선택권, 수익 분배 등에 대한 규정은 마련하고 있지 않은 것으로 조사되었다.
본 연구결과를 통해 도출된 인터넷 개인방송 아동･청소년 출연자 권익 보호를 위한 개선사항은 아래와 같다. 첫째, 인터넷 개인방송 플랫폼 사업자는 현재 인터넷 콘텐츠 내용 규제에 초점을 맞추고 있는 「정보통신망법」, 「정보통신에 관한 심의규정」, 「청소년 보호법」, 「청소년보호위원회 심의규정」에 더하여, 아동･청소년 출연자 보호를 위하여 「아동복지법」과 「대중문화산업법」등을 함께 명시해야 하며, 둘째, 운영정책 등에 있어 아동･청소년의 연령 기준을 명확히 제시해야 하며, 셋째, 이용자가 아동･청소년 보호 정책에 대해 인지하기 쉽도록 짧은 동영상이나 웹툰 등을 조문과 함께 제시해야하며, 넷째, 주요 MCN 사업자와 협조하여 소속 진행자에게 지침 내용을 교육해야하며, 다섯째, 아동･청소년 출연자의 권익보호가 포함된 자율적인 가이드라인을 제작하여 이용자들이 지침을 쉽게 찾아볼 수 있도록 홈페이지 주요위치에 배치해야할 것이다.
이와 함께, 방송통신위원회의 <인터넷 개인방송 출연 아동･청소년 보호 지침>에서 아동･청소년 출연자들의 권익 보장을 담고 있는 “노력하여야 한다.”는 권고사항을 의무조항으로 강화해야 할 것이다.

영어초록

This study looked at the contents of the Act on the Protection of Rights and Interests of Children and Youth Performers in Internet Personal Broadcasting and the Guidelines for Children and Youth Performers in Internet Personal Broadcasting announced by the Korea Communications Commission. In addition, it was investigated whether the current laws and guidelines were reflected in the ‘Operation Policy’ and ‘Youth Protection Policy’ of the Internet personal broadcasting platform. As a result of the analysis, the ‘Operation Policy’ and ‘Youth Protection Policy’ of major internet personal broadcasting platforms had children and youth protection regulations limited to the contents. Except for YouTube, most of the Internet personal broadcasting platforms did not have regulations on the right to learning, the right to sleep, the right to rest, the right to choose freely, and the distribution of profits for children and youth performers.
Improvements to protect the rights and interests of children and youth performers in Internet personal broadcasting derived from the results of this study are: First, the Internet personal broadcasting platform should specify both the law focusing on content regulation and the law for the protection of child and adolescent performers. Second, the age standards for children and adolescents should be clearly presented in the ‘Operation Policy’. Third, it should be presented as a short video or webtoon so that users can easily recognize child and youth protection policies. Fourth, in cooperation with major MCN operators, the content of the guidelines should be educated to the host. Fifth, an autonomous guideline that includes the protection of the rights and interests of children and youth performers should be produced and placed in the main location of the homepage so that users can easily find it.
And, in the guidelines of the Korea Communications Commission, the recommendation “You should make an effort”, which contains the guarantee of the rights and interests of child and youth performers, should be strengthened as a mandatory clause.
