초록

대한민국 헌법은 대통령으로 하여금 전시ㆍ사변 또는 이에 준하는 국가비상사태에 있어서 병력으로써 군사상의 필요에 응하거나 공공의 안녕질서를 유지할 필요가 있을 때에는 법률이 정하는 바에 의하여 계엄을 선포할 수 있도록 규정하고 있다. 그러나 과거 계엄선포에 따른 비상시국에 주어진 권한을 남용하는 등 문제가있었음에도 불구하고 계엄법상 군내 뿐만 아니라 민간 수사기관과 법원조직까지도계엄사령부 지휘감독 아래 있다 보니 견제가 제한되고 권한의 남용에 따른 기본권침해 행위에 대하여서도 감독이 어려운 측면이 있다. 더구나 과거와 같이 국회, 대통령 등이 제 역할이나 기능이 발휘되지 못할 경우 계엄사령관 등의 권한 남용행위를 견제한다는 것이 법체계상으로 어렵다는 점에서 향후 동일 위법 사례가 재발하지 않도록 이에 대응하는 독립 수사, 조사기관 및 이들이 견제기능이 제대로 발휘되기 위한 관련 법령개정 소요에 대하여 검토하기로 한다. 본 논문은 ① 헌법상대통령의 계엄선포권의 법적 의미와 한계에 대해서 살펴보고, ②「계엄법」상 비상계엄시 통제대상인 행정, 사법기관 범위, ③ 고위공직자범죄수사처 및 국가인권위원회의 계엄사령부 견제 기능 보장 검토에 대한 학설과 이론 및 헌법재판소 결정및 판례를 살펴본 후 관련 법령개정의 필요성을 제시하는 것을 논문의 목적으로한다.

영어초록

The Constitution of the Republic of Korea allows the President to declare martial law as prescribed by law when it is necessary to respond to military needs or maintain public well-being as a force in wartime, events, or similar national emergencies. However, despite problems such as abuse of the authority given to emergency situations following the declaration of martial law in the past, not only in the military but also private investigative agencies and court organizations are under the command and supervision of the martial law command, making it difficult to check and supervise basic rights violations caused by abuse of authority. Moreover, given that it is difficult in the legal system to check the abuse of authority by martial law commanders if the National Assembly and the President do not play their role or function properly as in the past, independent investigative agencies, and they cannot function properly to prevent the recurrence of the same illegal case in the future. The Constitution of the Republic of Korea stipulates that the President may declare martial law as required by law when it is necessary to meet military needs or maintain public order as a force in the event of war, affairs or similar national emergencies. However, despite the problems such as abusing the authority given to the emergency state in accordance with the declaration of martial law in the past, not only the martial law but also the civilian investigation agency and the court organization are under the command and supervision of the martial law command, There is a difficult aspect to supervise. Moreover, it is difficult in the legal system to check the abuse of authority of the martial law commander if the role or function of the National Assembly, the President, etc. can not be exercised as in the past. In order to prevent the recurrence of the same illegal case in the future, And the related laws and regulations to ensure that the check function is exercised properly.
