초록

검찰청 소속 검사가 기소권한을 독점하고 있다. 그래서 검사의 범죄도 검사가 기소를 해야 한다. 이런 점에서 공수처의 등장으로 검찰청검사의 기속독점주의가 깨진 것은 형사절차에서 큰 의미가 있다. 무소불위의 검찰을 견제할 수 있는 기구가 생긴 것이다
그런데 공수처의 기소권은 극도로 제한된다. 수사권만 있는 경찰과 다르지 않다. 공수처의 기소권을 극히 제한한 것은 공수처의 설립 취지에 어긋나고, 이로 인해 생기는 형소법의 해석적·체계적 난점은 해결하기 어렵다. 공수처의 조직과 인원이 매우 소규모이고 그 권한이 매우 취약하다. 공수처에 수사권이 있는 모든 범죄에 대해 기소권을 부여할 필요가 있다. 공수처의 기능을 강화하여 공수처의 설립 취지에 맞게 검찰권한의 견제 역할을 충실히 수행하도록 할 필요가 있다.
공수처가 수사권에 부합하는 기소권을 행사하더라도 수사와 기소의 효율성을 위해서는 수사와 기소의 기능적 분리는 적절하지 않다.
