국민참여재판에 대한 법정책적 조명 - 한국의 국민참여재판과 일본의 재판원재판을 비교하며 - (The law-politic Review of civil Participation in criminal Trial)

초록

국민참여재판제도는 우리나라에 2008년 1월 1일부터 시행되었다. 그에 반해 우리 보다 몇 년 앞서 논의하고 있었던 일본은 더 많은 연구와 준비과정을 거쳐 재판원재판을 2009년 5월 21일부터 시행하였다. 근본적인 양국의 차이로는 양자 모두 국민의 사법참여라는 취지는 같지만 우리나라는 국민참여재판을 피고인의 권리(기본권)로 인식한다는 것이고, 일본은 재판원재판을 국민에 대한 법교육의 차원에서 접근하는 것이 강하다는 것이다. 그러나 일본의 재판원재판으로부터 우리가 취사선택하여 배울 점이 있다. 이를 제도적으로 수용하고 발전시킬 과제가 아직 남아 있다.
국민참여재판의 활성화를 위한 법제도적 개선이 전제되어야 한다. 국민참여재판의 대상사건을 제한하고 있는 현행 법률을 개정하여 일정 정도 대상범죄를 확대하여야 한다. 현재의 국민참여재판처럼 평결에 있어서 권고적 효력을 부여하고 있는데, 일본처럼 동등한 자격을 주어 다수결로서 결정해야 할 것이다. 또한 법원의 국민참여재판 배제결정사유 중 국민참여재판 진행이 부적절한 경우는 구체적인 유형화를 법조문에 명시하여야 할 것이다. 배심원이나 피해자 및 증인의 신변보호를 위한 법제도적 강화책을 마련해야 한다.

영어초록

「Civil Participation in Criminal Trials Act」 introduces Civil participation system in serious criminal trials. The introduction of the new Korean jury system brought on epoch-making changes in Korea. In Korean history there has been no jury system so far. In this sense the introduction of the jury system is regarded as a drastic change of the judiciary system.
The civil participation trial system does not take the conventional form of the English of American jury. It is somewhat modified to fit into the Korean culture and reality. A potential jury panel is selected randomly from a district area, and the jury decides the guilty or not guilty in order to recommend its opinion to the court. The guilty or not guilty verdict should be unanimous in principle. Nevertheless, when the jurors cannot reach an unanimous verdict, they must consult with the court before deciding by a simple majority. Though the verdict of the jury is non-binding, the court must have regard to it, and must give reasons when the court returns a different verdict from the jury's. In case of guilty, the jurors also give their individual opinion on the sentence of the accused, which is non-binding as well. Therefore, the civil participation trial system in Korea is somewhat a hybrid system between a pure jury system in common law countries and a continental mixed jury system. The professional judges, who are appointed as judge by the Chief Justice of the Supreme Court of Korea, had enjoyed a relative high respect and trust from the public. People are recently reluctant to trust the courts, because the judicial process and decisions are obscure to the public, and the judicial judgements appear to be sometimes biased in favor of the rich or the powerful at the cost of the justice and fairness.
The purpose of the new jury system is to; ① reinforce the democratic legitimacy of the judicial process, ② enhance the transparency and credibility of the judiciary and ③ disseminate the legal mind and the reasonable thinking culture in the public. The government should start a nationwide campaign to foster the public participation in the jury trials. Diverse and various attempts should be encouraged to improve the jury trials.
