취소소송의 소송물 개념의 기능에 대한 재조명 ― 처분성 확대 경향과 보완책으로서 원상회복의무 ― (Re-examination of the function of the concept of “Streitgegenstand” in a revocation suit)

초록

‘소송물’은 소송에서 당해 소송의 수소법원이 심판할 대상을 정하고, 또 다른 한편으로는 중복소송이 별개의 법원에서 계속되지 않도록 심판의 대상이 중복되는 소송을 가려내는 기준이 된다. 심판 대상의 동일 여부의 판단이 어려운 민사소송과 달리, 취소소송은 특정한 개별 행정작용인 처분을 소송의 대상으로 하므로, 소송물의 단위는 처분으로써 바로 결정될 수 있다. 취소소송에서 소송물은 이처럼 개개의 특정 처분을 단위로 하여 그 범위가 정해진 까닭에 소송물의 단복･이동(單複･異同)의 판단이 어렵지 않았다. 그런데 소송의 대상인 처분이 달라서 소송물이 다른 별개의 소송 사이에서도 법률적 쟁점이 동일한 경우, 특히 단계적으로 선후 관계에서 이루어지는 행정작용 사이에서 각각의 행정작용에 처분성이 인정되어 별개의 소송물이 성립하는 경우에는 다른 소송물 사이에서 하자의 승계나 소 변경, 제소기간 등의 문제와 관련하여 고민되는 상황이 발생하기도 한다. 취소소송의 소송요건인 ‘처분성’은 동일한 쟁점을 확인하는 복수의 행정작용이나 연속되는 처분들 사이에서 소송의 대상을 하나로 수렴하게 함으로써 중복소송을 방지하는 기능을 어느 정도 수행해 왔는데, 취소소송의 대상으로서 처분성을 확대 인정하는 경향은 소송물과 관련하여 이러한 문제를 더 빈번하게 발생시킨다. 따라서 대상적격의 요건을 완화하고 처분성의 인정 범위를 확대함에 있어서는 이같이 처분성 개념이 대체하여 수행하여 온 소송물 개념의 기능을 염두에 두면서, 공정력이나 하자의 승계 등의 문제와도 조화롭게 해결되는지 검토하는 것이 필요하다. 그리고 취소판결의 취지와 다른 처분이 유효하게 존재하게 되는 경우 취소판결의 취지를 관철하기 위한 기속력 특히 원상회복의무가 기능하는 국면을 관련하여 검토할 필요가 있다.

영어초록

“Streitgegenstand” is the criterion for determining the subject of judgment by the court in a lawsuit and sorting out duplicate lawsuits. Unlike civil litigation, which is difficult to determine whether the subject of judgment is the same, cancellation litigation is subject to disposition, so the unit of litigation is determined immediately by disposition.
However, due to the recent tendency to expand disposition, there are cases where legal issues are the same between separate lawsuits with different dispositions subject to litigation. In particular, if the disposition of each administrative action is recognized between the administrative actions in stages, difficult situations may arise regarding the succession of defects under the substantive law, changes in lawsuits under the litigation law, and the filing period.
Until now, it has not been difficult to determine “Streitgegenstand” in cancellation litigation because the scope of “Streitgegenstand” has been determined as a unit of individual specific disposition. However, as society becomes more complex, administrative procedures become important, and administrative decision-making processes are subdivided, the number of dispositions of relationships that are virtually difficult to see as separate is increasing.
Disposition, a litigation requirement for cancellation litigation, has performed a function of preventing duplicate litigation to some extent by converging the subject of litigation among multiple administrative actions or continuous dispositions that confirm the same issue. However, the tendency to expand disposition intensifies this problem.
Therefore, in easing the litigation requirement of disposition, it is necessary to keep in mind the function of the concept of litigation that disposition has been performing. It should be solved in harmony with problems such as fairness and filing period. In addition, if a disposition that is different from the purpose of the revocation judgment is valid as a result, it is necessary to recognize the obligation to restore the original state as the content of the binding force in order to carry out the purpose of the judgment.
