주한미군이전에 따른 동두천시 지원특별법제정을 위한 법정책적 당위성에 관한 검토 (The Validity of Special Support Legislation concerning USFK Base Relocation from Dongducheon City - A Review from a Legal Policy Perspective -)

초록

본 논문은 미군부대이전으로 인하여 동두천시에 나타나는 법적 의미를 가지는 사실들에 대하여 어떻게 대처할 것인가에 대한 입법정책적 문제에 관하여 다루었다. 동두천시는 6ㆍ25전쟁 때부터 주한 미지상군의 주력부대가 위치하고 있었으며, 시 면적의 42.5%에 달하는 40.63㎢를 미군공여지로 제공한 지역이다. 그 결과 전체 주민의 약 17%가 주한미군관련 업체에 종사하고 있으며, 2005년도 기준 지역총생산 7,465억원 가운데 미군관련분야가 2,436억원에 달하는 등 동두천시 전체경제의 약 32.6% 정도를 미군에 의존한 아주 특수한 지역이다. 이와 같이 동두천시의 형성과 기능에 있어 막대한 비중을 차지했던 주한미군이 이전될 경우, 이후에 전개되는 상황은 단순한 사실적인 현상에 불과한 것이 아니라 본질적으로 법적 의미를 가지는 상황들이 전개되기 마련이다. 해당 지역은 행정주체의 지위를 가지는 공공단체임과 동시에 헌법상 보장된 지방자치단체이며, 그 주민은 헌법상 기본권주체인 국민으로서의 지위를 가지고 있으며, 이러한 상황에 대한 국가의 책무가 헌법적으로 반성이 되는 등등 수많은 법적 문제를 양산하게 된다.
특별법으로서 「주한미군 공여구역주변지역 등 지원 특별법」이 가지는 기본적인 문제점은 미군재배치와 관련한 모든 지역(평택시와 김천시 제외)을 하나의 규율대상으로 설정하고 있다는 점이다. 특별법은 규율의 소재가 특별성을 가져야 성립할 수 있는 법률이란 점을 도외 시 한 결과이다. 현재 동두천시의 특수상황과 현행 「주한미군 공여구역주변지역 등 지원 특별법」의 개별규범들과 관련하여 살펴보면, 입법자들은 자신들에게 부여된 규율과제를 기본적으로 충실히 이행하고 있지 못하는 것으로 평가될 수 있을 것이다. 현행 「주한미군 공여구역주변지역 등 지원 특별법」의 개별규범들은 동두천시의 경우와 같은 특별히 ‘선별된 상황’을 전제하지 않고 모든 지역을 포괄하는 개괄적인 방식으로 규율함으로써 주한미군이전으로 인한 동두천시의 문제에 효과적으로 대처하기 위한 급부한계치보다 상회하는 특별한 급부한계치들을 확정하고 있지 못하기 때문이다. 이에 관한 구체적 예로 「주한미군 공여구역주변지역 등 지원 특별법」의 입법목적, 적용범위, 종합계획, 각 종의 특례규정들 등이 제시될 수 있다. 이 외에도 절차적 규정들에서도 이와 같은 점들이 발견되고 있다. 따라서 동두천시와 같은 특수상황과 관련하여 현행 주공법상 대부분의 규정들은 규범들에 요구되는 법치국가적 명령, 특히 입법체계적 정당성, 과소금지원칙등을 충족하고 있지 못하는 것으로 평가된다. 물론 개별규범이 어느 정도의 양으로 규율되어야 하는지, 최소한 어느 정도로 내용의 특정성을 보여야하는지 등의 문제는 일반적으로 대답될 수 있는 문제는 아니다. 왜냐하면 개별규범에 필요한 특정성의 정도는 통계수치에 의할 수 있는 문제가 아니라 개별사안과 관련한 입법자의 구체적인 의도에 따라 탐구되어야 하는 문제이기 때문이다. 더욱이 개별규범에 요구되는 규정량은 해당 조치의 효과와 직접적으로 관련되는 문제이기 때문에 항상 법원칙들에 의하여 통제된다. 따라서 주한미군이전 이후에 전개되는 동두천시의 법적 문제와 같이 처음부터 예측가능했던 문제점들에 대하여서는 개괄적으로 구성된 현행 「주한미군 공여구역주변지역 등 지원 특별법」이외에 평택시특별법과 같은 동두천시특별법이 제정되어야 할 것이다.

영어초록

This paper deals with legislative policy issues concerning the legally relevant facts related to USFK base relocation from Dongducheon. Dongducheon has been home to key USFK ground units since the Korean war, and has offered 40.63㎢, or 42.5% of the city's total area, as a land grant to USFK. As a result, the city has developed a particular reliance on its American military personnel, with 17% of its population working in USFK-related industries. Based on 2005 statistics, 243.6 billion Won, or 32.6% of Dongducheon's total production of 746.5 billion Won, was connected to USFK. Given the massive role of American military forces in the formation and function of Dongducheon city, the situations that would arise following base relocation would go beyond simple matters of fact and instead fundamentally legally meaningful events. The city is a public organization with status as administrative agent, and is constitutionally guaranteed its position as a self-governing regional administrative body. Its citizens are constitutionally subjects of fundamental rights. Given this situation, numerous legal issues arise including the constitutional responsibility of the state.
The fundamental issue with the Special Law for Support of Regions including those Surrounding USFK Land Grant Areas as a Special Law is that it includes all areas(excluding Pyeongtaek and Kimcheon) related to USFK base relocation within its scope of regulation. This ignores the fact that Special Law can only be enacted when the object of regulation has “special status.” Upon examining the current situation in Dongducheon and individual provisions within the Special Law for Support of Regions including those Surrounding USFK Land Grant Areas, we find that the legislators did not responsibly attend to their regulative tasks. The individual provisions of the current Special Law for Support of Regions including those Surrounding USFK Land Grant Areas do not assume a ‘selective situation’ such as that of Dongducheon City, but rather regulate all regions in a comprehensive manner, failing to establis special limits of effect that exceed those limits that would effectively address the issues arising in the city due to USFK base relocation. The legislative purpose, scope, overall plan, and various special provisions of the law could all be presented as examples of this. Similar issues also arise from the procedural regulations as well. Therefore, given that Dongducheon currently faces a ‘special situation’, most provisions of the current law fail to fulfil normatively required principles such as the mandate for rule of law, and especially legislative legitimacy and the prohibition of under-protection. Of course, we cannot make general statements on the degree of regulation in individual provisions, or the required specificality of the content. This is because the degree of specificality in individual provisions cannot be determined by statistical data, but rather require a deep analysis of the specific intent of legislators concerning individual cases. Moreover, the level of regulation in individual provisions is directly connected to the effects of related measures, and therefore must always be controlled by legal principles. Therefore, given the legal issues that have arisen in Donducheon City concerning the USFK base relocation and other issues that should have been initially predicted, a Special Law for Dongducheon City independent from the current Special Law for Support of Regions including those Surrounding USFK Land Grant Areas should be established.
