초록

컴퓨터와 정보통신 관련 기술의 발전과 함께 개인정보 및 프라이버시 정보도 디지털화되어 활용되고 있는데, 현대 사회에서 디지털화된 개인의 개인정보 및 프라이버시 정보는 항상 침해의 위험이 있다.
그런데 저작권자나 관련 사업자는 저작물에 적용되는 DRM(Digital Rights Management) 기술을 활용하여 개인정보를 취득할 수 있다. 그리고 특정인이 기술적 보호조치를 무력화하는 과정에서 프라이버시 정보를 취득할 수도 있는데, 이러한 이유에서 기술적 보호조치의 무력화를 허용하는 경우에 프라이버시에 대한 고려가 필요하다.
이러한 DRM 기술과 관련하여, 우리「저작권법」상 기술적 보호조치 규정의 구조와 내용은 미국「저작권법」상의 기술적 보호조치 규정의 기본적인 구조 및 내용에서 동일하다. 그렇지만 미국「저작권법」의 관련 규정이 상당히 구체적인 내용인데 반하여 우리「저작권법」상의 규정은 비교적 규정의 내용이 단순하다. 이런 점에서 법률 규정의 구체적인 내용은 미국「저작권법」상의 관련 규정과 다소 달리 해석될 수 있게 되었다.
또한 상기한 바와 같이 DRM 기술이 개인정보 및 프라이버시와 상당히 밀접한 관련이 있고 중대한 사안임에도 불구하고,「저작권법」에 현행 기술적 보호조치 관련 규정이 입법되기 이전에 이와 관련한 총론적인 논의가 있었던 것 외에 입법 이후에 해당 규정에 대한 개인정보 및 프라이버시와 관련한 논의는 찾아보기 어렵다.
그러므로 DRM 기술을 둘러싼 개인정보 및 프라이버시의 법적 문제와 관련하여 우리「저작권법」상에 규정된 기술적 보호조치 규정에 관한 법정책인 검토가 필요하다. 이에 따라 본 논문에서는 DRM 기술과 관련하여「저작권법」상 기술적 보호조치 관련 규정을 검토하고, 이 규정에서의 개인정보 및 프라이버시 관련 문제에 대하여 논하도록 한다.

영어초록

Personal information and privacy information have digitized along with the development of computer technology and ICT(information and communication technologies), and there has always been the risk of infringement relating to those in modern society.
By the way the copyright holder or the associated operators may acquire personal information by applying the DRM (Digital Rights Management) technology to the work. And a specific person may obtain the privacy information in the process to incapacitate the technological protection measures. Therefore, it is necessary to consider the privacy for allowing the incapacitating of the technological protection measures.
In connection with this DRM technology, structure and content of the provision on the technological protection measures provided under the copyright law is the same in basic structure and content of the provision on the technological protection measures of the U.S. copyright law. But whereas the relevant provision of U.S. copyright law is stipulated in considerable detail, the relevant provision of our copyright law is relatively simple. In this regard, Specific details of the legal provision has been able to be somewhat different interpretation on the relevant provision of U.S. copyright law.
Also, even if DRM technology is associated significantly closer to personal information and privacy and critical issues relating to these, discussions with respect to personal information and privacy after legislation on the provision of the current technological protection measures are difficult to browse except general discussions in this regard prior to becoming legislation on the copyright law.
Therefore, with respect to the legal issues surrounding the personal information and the privacy, it's necessary to review the provision on the technical protection measures set forth in our copyright law in law and policy perspective. Accordingly, this study investigates the relevant provision of our copyright law in connection with the DRM technology and discusses around issues related to the personal information and the privacy in the provision.
