기소절차에서 국민참여 방안에 관한 법정책적 연구 (A study on the Policy and law for Control with Civil Participation in Prosecutorial Procedure)

초록

형사절차 전반에 걸쳐 광범위한 권한을 가지고 있는 검사의 독선과 자의를 방지하고 공소제기에 대한 정치적 영향을 배제함으로써 기소권 행사가 공정하고 효율적으로 이루어지도록 하기 위하여 통제가 필요하다. 이러한 점에서 현행법은 검찰권을 통제하기 위해 기소강제절차, 불기소 처분에 대한 항고제도 및 불기소처분의 취지와 이유고지제도, 법무부장관의 구체적 사건에 대한 지휘·감독의 제한, 특별검사제도 등 다양한 제도를 두고 있지만, 제대로 기능을 하는 데에 한계가 있다. 따라서 새로운 통제방안으로 외부의 개입을 통한 공정성 확보의 필요성이 제기되고 있고, 그 방안으로 국민참여를 통하여 가능할 것이다. 특히 일반 국민이 배심원으로 검찰의 기소과정에 참여할 수 있는 미국의 대배심 제도와 검사의 불기소 처분에 대해 사후적으로 국민이 참여하는 일본의 검찰심사회제도와 같은 국민참여 제도의 도입을 검토해 본다. 미국과 일본의 제도를 살펴본 바, 미국의 대배심은 그 자체가 기소여부를 결정하는 기구로서 검사의 부당한 기소와 불기소를 모두 통제할 수 기능을 하는데 비해 일본의 검찰심사회는 검사의 공소권행사의 정당성 여부만을 사후에 심사하는 자문적 성격이 강하다고 할 수 있다.
이에 기소절차에서 우리나라에 적합한 국민참여 제도는 검사의 기소재량권을 제대로 통제하기 위해서는 사후적 국민참여제도와 함께 부당기소에 대한 민주적 통제를 위해 제한된 범위에서 사전적 국민참여제도도 도입할 필요가 있다는 결론에 도달하게 된다.

영어초록

Prosecutors possess a broad range of power over the whole procedure of criminal cases. For fair and efficient execution of the right of accusation, control is required to prevent the arbitrary decisions made by prosecutors and exclude political influence on the institution of public action. In this sense, the current law in force in Korea has limitations in performing its proper function, despite the diverse systems aimed at controlling the prosecutorial power; for example, a complaint and notification system has been put in place for non-prosecution dispositions and their underlying purpose and grounds. Other measures include compulsory prosecution procedures, restrictions on the direction and supervision of specific events by the Minister of Justice, and the special prosecutor system. These limitations have heralded the need for securing fairness through external intervention as a new way of controlling prosecutorial power, which can be achieved by public involvement.
This study investigated the public involvement system implemented in the United States and Japan, and the study contemplated the introduction of such a public involvement system in Korea. In the United States, there is a grand jury system where the public participates in the course of public prosecutions as a member of a jury. In Japan, there is a Prosecution Review Commission system where, in an ex-post sense, the public participates in cases of non-prosecution dispositions by prosecutors. The grand jury system in the United States is itself an organization that determines the prosecution, and it can control both improper prosecution and non-prosecution by prosecutors. Meanwhile, the role of the Prosecution Review Commission in Japan is more of an advisory one that only screens the legitimacy of the prosecutors’ execution of the right of arraignment after the fact. In examining which type of public involvement is appropriate for Korean society, the paper concludes that not only is ex-post public involvement necessary, which can properly control prosecutorial discretion, but also the introduction of ex-ante public involvement is required in a limited range for the democratic control of improper prosecution.
