경기북부특별자치도 설치의 법정책적 과제 (Legal Policy Issues Concerning the Establishment of Northern Gyeonggi Special Self-Governing Province)

초록

경기도가 추진하고 있는 경기북부특별자치도는 제주특별자치도, 강원특별자치도, 전북특별자치도와는 다르다. 우선 경기도는 경기북부와 경기남부를 분리하는 행정구역 개편이 선행되어야 한다. 이후 경기북부지역을 특별자치도로 해야 하는 두 단계의 절차가 필요하다. 두 단계 절차를 거처야 한다는 점에서 다른 특별자치도 사례와는 다르다. 이런 두 단계를 위해 21대 국회에서는 이미 김민철 의원과 김성원 의원 각각 대표발의 「경기북도 설치 등에 관한 법률안」이 있다. 이후 「경기북부특별자치도 설치 등에 관한 특별법안」이 2023년 2월 15일 김민철 의원 대표발의 법안, 2023년 4월 13일 최춘식 의원 대표발의 법안이 있다. 2023년 4월 14일 김성원 의원은 「경기북부특별자치도 설치 및 접경지역경제자유특구 지정 등에 관한 특별법안」을 제출하기도 했다. 경기북부특별자치도가 되기 위해서는 이러한 법안을 병합심리 해야 한다. 이 과정에서 정부 통합법안이 나온다면 더욱 환영할 일이다. 병합심리 입법은 국회 몫이지만, 중앙정부, 경기도, 국회의 협치가 필요한 부분이기도 하다. 경기북부특별자치도 설치를 위해서는 경기도의회 의견수렴 또는 경기도민 대상 주민투표 실시 시기 및 범위, 국회 제출 법안의 병합심리와 법 통과 시점 등 아주 많은 난관이 도사리고 있다.
종래 경기도 행정구역 개편에 관한 논의는 이른바 경기분도, 즉 경기북도 설치에 관한 논의였다. 경기북부특별자치도 설치에 관한 논의는 2022년 지방선거 이후 논의되고 있다. 이 연구는 기존의 연구와 달리 경기북부특별자치도 설치에서 발생할 수 있는 다양한 논의를 검토하고, 법정책적 관점에서 대안을 제시한다.

영어초록

The special autonomous province in Northern Gyeonggi Province, which is being promoted by Gyeonggi Province, is different from Jeju Special Self-Governing Province, Gangwon Special Self-Governing Province, and Jeonbuk Special Self-Governing Province. First of all, Gyeonggi-do should be preceded by the reorganization of administrative districts separating Northern and Southern Gyeonggi-do. After that, a two-step procedure is needed to make Northern Gyeonggi Province a special autonomous province. Special autonomy is different from other cases in that it is necessary to go through two-step procedures. For these two stages, the 21st National Assembly already has a "Act on the Establishment of Gyeonggi-do Province" initiated by representatives Kim Min-chul and Kim Sung-won, respectively. Since then, the Special Bill on the Establishment of Special Self-Governing Province in Northern Gyeonggi Province has a bill proposed by Rep. Kim Min-chul on February 15, 2023, and a bill proposed by Rep. Choi Chun-sik on April 13, 2023. On April 14, 2023, Rep. Kim Sung-won also submitted a special bill on the establishment of a special autonomous province in Northern Gyeonggi Province and the designation of a special economic freedom zone in the border area. In order to become a special autonomous province in Northern Gyeonggi Province, such a bill must be reviewed in combination. If a government integration bill comes out in this process, it would be more welcome. The legislation of the merged hearing is up to the National Assembly, but it is also a part that requires cooperation from the central government, Gyeonggi Province, and the National Assembly. In order to establish a special autonomous province in Northern Gyeonggi Province, there are many difficulties, such as the timing and scope of the Gyeonggi Provincial Council's opinions, the timing and scope of the referendum for Gyeonggi residents, and the timing of the passage of the law. Conventionally, the discussion on the reorganization of administrative districts in Gyeonggi-do was the so-called Gyeonggi branch, that is, the establishment of Gyeonggi-do. Discussions on the establishment of a special autonomous province in Northern Gyeonggi Province have been discussed since the 2022 local elections. Unlike previous studies, this study reviews various discussions that may occur in the establishment of special autonomy in Northern Gyeonggi Province and presents alternatives from a legal policy perspective.
