남북한 사회통합을 위한 법정책적 과제 (Legal Challenges for Inter-Korean Social Integration)

초록

남북한 사회통합은 성공적 통일을 위한 전제이므로, 통일이전부터 남북한 사회 각 분야의 제도와 관습을 통합가능한 분야별로 통일화하여 통합을 할 수 있는 여건을 조성해야 한다. 남한이 남북통일 후 사회통합을 선도하려면 남한이 북한출신 주민들을 포용할 수 있는 역량이 있어야 한다. 이를 위해 먼저 우리 사회의 사회적 약자층과 소수자에 대한 편견과 차별을 극복하고, 각종 불평등체계를 개선해서, 누구나 사회의 기회구조에 공평하게 참여할 수 있는 환경을 조성해 나가야 한다. 특히 극단적 이념대결, 정치만능주의, 사회양극화, 기득권층의 독식구조, 극단적 경쟁교육구조와 사교육시장의 병폐 등의 개선이 필요하다.
남한사회의 갈등해소와, 북한주민의 통합에 대한 저항감 해소를 위한 체제적 장치로서, 한국 헌법의 기본원리이기도 한 사회국가의 도입을 통해 남북한 사회통합의 기초를 확립하는 방안을 모색해 볼 수 있다남북한 사회통합을 위한 남한 측의 제도적 기반으로서는, 남북경협의 활성화, 진정한 민주주의의 정착, 북한이탈주민의 정착지원 등의 단기과제가 우선되어야 하며, 이러한 기본방향을 전제로 현 단계에서 실현가능한 남북한의 점진적인 법정비 등이 필요하다.
남남통합의 우선적 과제를 해결하기 위한 전제로, 우선 북한이탈주민에게 교육, 취업, 사회보장 등 외적인 사회통합정책과, 상호문화의 이해를 증진하며 사회적 상호작용과 문화적응을 용이하게 하는 내적 사회통합정책이 병행되어야 한다.
남북한 사회통합을 위한 남한법의 과제는, 남북관계발전법상 남북관계의 특수성에 대한 법적 효력을 부여하고, ‘북한이탈주민의 보호 및 정착지원에 관한 법률’에서 북한이탈주민의 사회적 지위향상방안을 마련하고, 또한 남북교류협력법상 남북교류의 신속성, 간이성, 확장성 등을 강화하는 입법을 통하여 교류협력의 활성화를 법적으로 지원해야 한다. 북한법의 과제로서는, 북한의 북남경제협력법상 남한투자자의 지위를 강화하고, 합영법상의 합리적인 경영구조를 확립하고, 노동관계법상 노동의 유연성을 확보하는 등 남북교류의 활성화를 위한 법정비작업이 필요하다.

영어초록

Social integration of South an North Korea is a precondition For a successful reunification of the two nations. South Korea needs to provide conditions for social integration by unifying possible social areas not only in legal systems but also conventions of each social area of both countries. For South Korea to take an initiative on them after the upcoming reunification, South Korean government should be able to embrace those residents who escaped from the North and settled down in South Korea.
To that end, what is needed for the South is to address social problems such as prejudice and discrimination on the second-class or social minorities and create preferable environments for them by improving existing systems, so that every citizen can enjoy equal opportunities. More precisely, areas in which improvement is urgently needed are radical ideological confrontation, political omnipotence, social polarization, monopoly structure of the privileged, excessively competitive education system, and social ills prevailing in private education market.
As a systemic measure to relieve the issues including major conflicts in South Korean society and its resistance to the consolidation of North Korean residents, introducing the concept of Sozialstaat which is basic principle of The Constitution of Korea is a solution. It will also help Korean government lay the foundation of social unification of the North and the South.
As an institutional foundation South Korean government can set, short-term strategies such as revitalization of inter-Korean economic cooperation, realization of true democracy, and supports for the settlement of residents escaped from North Korea should be the top priority. After that, gradual revision of legal systems of each government should be followed in a feasible manner.
Another precondition for a successful reunification is South-South integration, which includes social integration policies. Offering education, jobs, and social security for North Korean defectors in the South is a good example for the external integration while enhancing mutual understandings on different cultures from each other and facilitating their social interaction and enculturation should be provided on the level of internal integration. The legal policies for both external and internal integrations should be implemented in line with each other for successful and smooth transition.
In this paper I suggest a few suggestions on legal reforms. South Korean lawmakers need to let Inter-Korean Relations Law to exercise its legal validity on specific cases, come up with measures to improve social status of North Korean escapees through ‘Act on the Protection and Settlement Support of Residents Escaping from North Korea’, and make legislation on enhancing immediacy, simplicity, and expandability of inter-Korean exchanges to legally support the re-invigorating mutual cooperation. North Korean lawmakers are also required to make some legal reforms, which include ensuring the status of South Korean investors through North-South Economic Cooperation Law, establishing reasonable corporate governance through Equity Joint Venture Law, and increasing labor flexibility through Labor Relations Law.
