대통령 권한대행에 대한 법정책적 고찰 (A law-political Study on the Acting President System)

초록

우리나라 헌정사에 있어서 대통령 권한대행체제가 여러 차례 있었다. 그럴 때마다 대통령권한대행에 대한 헌법이나 법률이 제대로 규정될 필요성이 있었다.
헌법 제71조에는 대통령 권한대행의 순위가 국무총리와 법률이 정한 국무위원의 순서로 되어 있다. 그런데 국무총리는 국회의 동의를 얻어 임명되므로 간접적으로 국민적 정당성을 얻었다고 볼 수도 있으나, 국민의 직선에 의하지 않고대통령에 의해 임명된 국무총리가 대통령의 권한을 대행하는 것은 국민적 대표성과 민주적 정당성을 결여한다는 문제점이 있다. 따라서 대통령제 정부형태에서 대통령의 유고시에 권한행사를 헌법원리에 알맞게 해결하려면 대통령직의승계제도를 근본적으로 도입하는 것이 필요하다. 대통령직의 승계를 인정하기위해서는 대통령을 선출할 때 동일한 절차에 따라 부통령을 동시에 선출하여대통령의 유고시에 부통령이 대통령직을 승계하도록 하는 것이 가장 합리적일것이다. 진정한 의미의 대통령제를 취하여 대통령과 부통령 선출방식에서 러닝메이트 제도를 도입하여야 국정수행의 효율과 화합을 극대화할 수 있다.
대통령의 궐위에 따른 권한대행은 대통령직의 유고가 객관적으로 결정적이라는 점에서 60일 이내에 후임자 선거를 하고 후임자에게 바로 대통령직을 인계하도록 하여야 한다. 따라서 특별한 사정이 없는 한 궐위시에는 그 기간이 60일을 초과할 수 없다. 그러나 사고로 인한 경우에는 그 사유가 일시적인지 결정적인지 여부를 판단할 만한 기관이 필요하다. 이 경우 판단권자로서 ‘국회’가가장 적합하다고 생각되며 이를 위해서는 헌법의 개정 및 법률의 제·개정이 필요하다.

영어초록

There are four times that the Acting President System was enacted in Korean constitutional history. But acted Acting President System is not perfect on the Constitution or laws. Therefore, if the President is unable to perform his duties for any reason, some problems might happen. In the Constitution (article 71), "The Prime Minister or the members of the State Council in the order of priority as determined by Act", the successor to the President is determined. Under the Presidential System, there is usually a Vice President.
The Prime Minister shall be appointed by the President with the consent of the National Assembly, so he might get indirectly national legitimacy, however, if the Prime Minister who is not elected by people but appointed by the President shall act as Acting President, it means acting without National Representativeness and National Legitimacy.
Thus, to resolve these problems to fit constitutional principle in the Presidential system,the Succession to the President is fundamental system and the Acting President is just secondary function to complement that. And it is the most reasonable that the Prime Minister elected directly by people like the President can success to the President.
To make efficiency and harmony of the affairs of state maximized, the Running Mate System is instituted as the real Presidential system. Also, It make the Acting President more easy when the office of Presidency is vacant or the President can not perform his duties.
In case of vacancy of the office of presidency, the reason is objectively clear, so the person who will be the acting president should take over his duties within 60 days. But the case of accidental reasons, it needs to determine whether the reason is temporary or conclusive by some institution. In this case, the National Assembly is the best as a institution to determine that. For this, it needs to amendment the Constitution and enact the law.
The range of the Acting President is throughout the affairs of state not otherwise limited, but it is necessary to make a limit by law just like France. And the duties of the performer of the Acting President should be restricted to maintenance of the status quo.
