선거범죄에 대한 특별 형사소송절차의 실효성 확보 방안 (A Plan for Securing the Effectiveness of the Special Criminal Procedure Pertinent to Election Crime)

초록

선거범죄는 선거의 공정성을 파괴함으로써 자유민주주의의 실현을방해하는 중대범죄이다.
선거범죄는 매 선거마다 범죄수법이 치밀하고 조직적으로 꾸준히 진화하여 발생되고 있으므로 이에 대한 철저한 대응방안이 강구되지 않으면 근절되지 않고 다양한 형태로 변형되며 증가할 것이다.
한편 「공직선거법」은 부정선거를 방지함으로써 선거의 공정성 확보를 통한 자유민주주의의 실현을 도모하기 위한 법률이다. 법이 제정된이후 총 82회의 개정을 거치면서 교사범에 대한 처벌강화와 선거관리위원회의 조사권을 강화하고, 신속한 재판진행을 위한 단기공소시효제도도입, 재판기간의 강제, 경합범에 대한 분리 선고 등의 특별 형사소송절차규정들을 마련하였다. 또한 법원은 자체적으로 선거범죄의 신속한 처리를 위해 선거전담재판부를 설치하고, 그에 따른 재판예규인 ‘선거범죄사건의 신속 처리 등에 관한 예규’를 마련하여 각 심급 및 소송절차 마다 기간을 설정하여 준수하도록 하고 있다. 그러나 선거범죄에 대한 특별 형사소송절차의 규정은 선거범죄의 특성과 수사구조, 공판절차 등에대한 현실성이 반영되지 못하여 교사범에 대한 입증의 어려움과 단기 공소시효제도의 악용, 법원이 강행규정인 재판기간을 미준수 등의 문제들로 인하여 특별규정으로서의 기능을 제대로 발휘하지 못하고 있다.
이에 본고에서는 선거범죄의 실태를 분석하고, 법리적·현실적 관점에서 현행 「공직선거법」상의 특별 형사소송절차 규정상의 문제점을 도출하였다. 아울러 현행 규정상의 문제를 검토한 후 그에 따른 선거범죄에대한 특별 형사소송절차의 실효성 확보를 위한 개선방안을 제시하였다.

영어초록

Election crime is a serious crime that obstructs the realization of liberal democracy through destroying fairness of election.
Election crime is being generated by which a criminal technique is evolved elaborately, systematically and consistently in every election. Thus, if a thorough countermeasure against this is not devised, the election crime will not be eradicated, but will grow with being transformed into various forms.
In the meantime, 「Public Official Election Act」, which is the law for promoting the realization of liberal democracy through securing the fairness of election by preventing a rigged election, arranged the special criminal procedure regulations such as strengthening punishment for an abetter, intensifying an investigation right of the Election Commission, and adopting a system for the short-term statute of limitations to progress a prompt trial, coercing trial period, and sentencing the segregation against concurrent crimes, while passing through the revision over totally 82 times following its enactment. Also, the law court installed the election-only justice department for the autonomously swift handling of election crime and prepared ‘the established rules on the prompt handling of election crimes, etc.’ as the trial rule according to it, thereby making it comply by setting a period for each trial and procedure. However, the regulation of the special criminal proceedings against election crime fails to be reflected a characteristic, investigation structure, and trial procedure in election crime, thereby failing to properly exert the function as the special regulation due to the problems such as having a difficulty for proving an abettor, misusing the short-term statute of limitations, and failing to abide by the trial period as the mandatory provision by the law court.
Accordingly, this study analyzed the actual condition of election crimes, and elicited problems in light of the regulations for the Special Criminal Procedure pertinent to the current 「Public Official Election Act」from the legalistic and realistic perspective. In addition, after examining the problems with regard to the current regulations, the improvement plan was suggested for securing the effectiveness of the Special Criminal Procedure concerning election crime according to it.
