4차 산업혁명 시대의 에너지정보 활용 방안에 관한 법제연구 (A Legislative Study on the Use of Energy Information in the Fourth Industrial Revolution Era)

초록

우리 인류는 코로나 19로 인하여 정치, 경제, 사회, 문화, 교육, 의료 등 수많은 분야에서 한 번도 경험하지 못한 생활을 영위하고 있다. 이처럼 코로나 19라는 바이러스의 역풍으로 인하여 비대면 경제·산업의 발전, 노동시장의 변화, 온라인 교육의 확산, 온라인 쇼핑 확대, 문화생활 등 우리사회 전반에 걸쳐 언택트(Untact: 비대면) 사회로의 전환을 촉진케 했다. 언택트(Untact: 비대면) 시대에 우리 인류는 신종 금융사기 등으로 개인정보 유출되는 사례가 증가하고 있음에 따라 개인의 정보보호와 공동체를 위하여 개인의 정보 활용을 어떻게 새롭게 설정할 것인지 중대한 사회적 과제가 되고 있다.
과거 산업화시대에서는 석탄, 석유 등과 같은 에너지자원이 경제활동의 중요한 요소로 작용하였으나, 최근 4차 산업혁명시대에는 데이터(Data)가 핵심원유이며, 이는 새로운 산업경제의 쌀이다. 특히, 에너지는 국민들의 안락한 삶을 유지하는 기본이 되며, 전기, 가스, 열 등의 에너지원을 통하여 인류문명의 발달과 함께 그 시대 기술의 진보 또는 산업구조의 체계를 변천시켜 왔다. 대한민국의 산업 및 경제발전은 석탄, 석유, 천연가스를 통한 화력발전과 원자력발전을 통한 안정적인 전력공급을 통하여 국민들에게 편리하고 안락한 삶을 제공해 주는 동시에 국가의 산업발전에 기여해 왔다는 점을 부인할 수 없다. 이에 정부도 “사람 중심 포용국가”를 중심으로 “일자리와 소득주도 성장”, “혁신성장”, “공정경제”를 제시하기에 이르렀고, 에너지 분야에서 재생에너지 3020(태양광발전 30.8GW, 풍력발전 16.5GW를 목표로 함) 등 에너지전환(Energiewnede)정책에 따라 에너지新산업 등 산업정책을 추진하기 위하여 개인의 에너지(전기, 가스, 열 등) 정보를 제3자에게 활용할 수 있는 에너지산업 플랫폼 구축이 필요한 시점이다.
하지만, 4차 산업혁명이라는 측면에서 에너지정보를 통하여 독거노인 사망 예측, 주택 등의 화재예방, 전력손실 감축 등의 문제를 해결하는 긍정적 측면만을 가지는 것이 아니라, 민간주체 등에 의하여 침해되는 개인정보의 문제점을 해결하여야 한다. 이러한 개인의 정보보호의 문제와 공동체를 위하여 개인정보의 활용에 관한 충돌 문제와 관련하여 「헌법」상 국가의 기본권 보호의무 법리나 기본권의 제3자효 이론을 통하여 해결하여야 한다는 점을 제시했다. 그럼에도 불구하고 제4차 산업혁명으로 대변되는 인공지능(AI), 사물인터넷(IOT), 빅 데이터(Big Data), 블록체인 등으로 인하여 에너지정보와 관련하여 에너지 관련 법제(「에너지법」, 「저탄소녹색성장기본법」, 「에너지이용합리화법」, 「지능형전력망의 구축 및 이용촉진에 관한 법률」, 「전기사업법」, 「신재생에너지 및 재생에너지 개발·이용·보급 촉진법」, 「녹색건축조성지원법」)를 분석하였으나, 동법상의 “정보공개제도”만으로는 미래 新에너지산업(E-프로슈머, 전기자동차, 수소자동차, 자율주행자동차 등)을 활성화하는데 법적인 한계가 있음을 지적했다.
따라서 최근 정부가 4차 산업혁명시대에 걸맞는 데이터를 통한 新산업·기술 및 新서비스 활성화를 위하여 개인정보의 활용이 필수적이라는 점에서 개인정보를 제3자에게 제공하여 활용할 수 방안을 모색하기 위하여 EU의 GDPR 규정 등을 벤치마킹하여 개정된 「개인정보보호법」상 “과학적 연구”개념 명확화 방안 마련, 현행 「개인정보보호법」상 개인정보 “동의”방식에 대한 “등급화”제정 방안 제시, 「개인정보보호법」상 “개인정보” 활용에 대한 대가로 “기금”신설을 통한 공익적 활용 방안 모색, 에너지 관련법과 「개인정보보호법」상 충돌 해결 방안 마련, 개인정보 가명정보로 인한 2차 활용을 위한 “전문기관” 모델(안)을, 개인정보 유출에 대비한 “사이버 보험제도 의무 및 현실화 방안”을 개선방안으로 제시했다. 특히, 우리나라는 자동차·철강·석유화학·기계·조선 등의 제조산업, 에너지산업, 유통산업분야 등의 기반시설에 세계적으로 우수한 정보통신기술(ICT)을 접목하여 활용하면서 개인의 정보보호와 개인정보를 활용하여 에너지 新산업 및 新기술을 육성하고 촉진할 수 있도록 “(가칭) 에너지정보 활용을 위한 특별법” 제정 방안을 개선방안으로 제시했다.

영어초록

Since the outbreak of COVID-19, the human race has been experiencing unprecedented situations in various areas including politics, economy, society, culture, education and healthcare. The pandemic caused by the novel coronavirus has led to the growth of non-contact industries and businesses, changes in a labor market, and the expansion of online education, shopping and cultural experiences, triggering the transition to a non-contact society. This transition has brought up a significant social task of the protection of personal information and the use of personal information for the community, as more cases of the exploitation of personal information such as new types of financial fraud have been witnessed.




The industrial era used energy resources including coal and oil as an important economic element, whereas the recent Fourth Industrial Revolution uses data as a key player which is equivalent to oil in the industrial era or rice in the agricultural era. Energy, particularly, is an essential element for people to maintain their comfortable lives. The human race have used gas, electricity, heat and other energy resources to develop technology and industrial structure as well as the civilization. The industrial and economic development of Korea and comfortable life of Korean people have also been facilitated by a stable supply of electrical power through thermal power generation and nuclear generation. Thus, the Korean government has proposed the concepts of ‘growth led by jobs and income’, ‘innovative growth’, and ‘fair economy’ on the basis of ‘people-centered inclusive country.’ The government also pursues ‘renewable energy 3020’ (objectives: 30.8GW of solar power generation, 16.5GW of wind power generation) and new energy projects based on the policy of Energiewnede. Considering this, it is time to establish a platform that allows personal information of energy use (electricity, gas, heat, etc.) to be used by third parties.




The use of energy information has a bright side such as preventing the death of senior citizens who live alone, fires, and loss of electrical power. However, it also entails a controversial breach of personal information by private parties. This research proposes that the contradiction between the protection of personal information and the use of personal information for community should be dealt with the principle of the state’s duty of protecting fundamental rights under the Constitution or the theory of the third party effects. Nonetheless, this paper analyzed energy-related laws (Energy Act, Framework Act on Low Carbon, Green Growth, Energy Use Rationalization Act, Smart Greed Construction and Utilization Promotion Act, Electric Utility Act, Act on the Promotion of the Development, Use, and Diffusion of New and Renewable Energy, Green Buildings Construction Support Act) in relation with the industries of Artificial Intelligence (AI), Internet of Things (IOT), big data, and Blockchain. As the conclusion of the analysis, the paper points out that the legal grounds for the disclosure of information provided for in the aforementioned Acts were weak and limited in facilitating the future new energy industries (E-prosumer, electric automobiles, hydrogen vehicles, and autonomous vehicles).




It is essential to use personal information in order to revitalize new industries, technologies and service of the Fourth Industrial Revolution and to find a way for a third party to be provided and use personal information. Therefore, this paper proposes a plan to realize a compulsory cyber insurance policy that would prevent the leak of personal information. The proposed plan includes the clarification of the concept of ‘scientific research’ under Personal Information Protection Act which was amended after benchmarking EU’s GDPR; ‘classification’ of the types of agreement on providing personal information under the current Personal Information Protection Act; a way to establish a ‘fund’ for public benefits in return for using ‘personal data’ under the Personal Information Protection Act; a way to address the conflict between energy-related laws and Personal Information Protection Act; and a model of professional organization that makes secondary use of personal information by using alias. Particularly, the research proposes the ‘Special Act on the Use of Energy Information (tentative)’ which would enable the Korean government to graft its world-class ICT on to its manufacturing, energy and distribution industries including automobile, steel, oil and chemical, machine and engineering, and shipbuilding while to grow and promote new energy industries and technologies by using personal information and at the same time by protecting it.
