초록

초지능화와 초연결화의 혁명인 4차 산업혁명은 기업들이 제조업과 정보통신기술(ICT)을 융합하여 작업경쟁력을 높이는 산업혁명으로 물리학과 디지털기술 등이 서로 융합 연결되는 혁신을 의미하여, 현실과 사이버 공간의 경계를 없애는 변화로도 상징되는데， 변화의 범위와 속도 측면에서는 전면적이고 신속히 경험되고 이미 국가 사회적 의제로서 자리 잡고 있기 때문에 사회적 실체성을 부정할 수 없다．기업들이 제조업과 ICT를 융합하여 경쟁력을 높이는 ４차　산업혁명은, 2016년 1월 스위스 다보스 세계경제포럼(World Economic Forum)에서 의제로 제시되어 세계인의 주목을 받았고 세계경제포럼의 창시자인 슈밥 회장이 언급한 AI, 로봇, IOT, 자율 주행차, 드론, 3D 프린팅 등이 등장하여 모든 것들이 융합될 것을　예측하게　하고　있다.
여기에서　문제는 산업혁명이 인간가치의 침해나 또는 사람들의　직업에 대한 위협이 되고 수용지연에 따른 혼란을 초래하는 등 사회적 경제적인 위기와 기회를 동시에　몰고 왔다는 측면과 사람이 살고　있는 물리적인 공간을 가상의 사이버공간과 혼합해버리는 4차 산업혁명의 기술이 인간대체기술이라는 측면에 있는 것이다.
4차 산업혁명의 핵심인 인공지능기술과 정보네트워크기술의 결합체인 지능정보기술의　초지능화 및 초연결화를　통하여 인간은 과연 더 인간답고 행복하고 안전하게 삶을 영위할 수 있을까? 융복합 연결이 강조되면서 오히려 사회의 양극화가 더 심화되고 있는 것은 아닌가？ 하는 걱정이 있는 것도 사실이다. 우리사회에 양극화 등 분열적 갈등이 심화된다면， 정부로서는 그 통치기능에 위기를 초래할 수도 있다고　보아 정부의 역할과 위기의 대처에 있어서 형사정책인 문제로 노동시장 및 인구변화에 따른 갈등관리, 사물인터넷이나 빅데이터 그리고 불록체인의 등장에 따른 정보보안과 개인의　사생활 보호, 자율주행 자동차나 드론의 등장에 따른 안전성의　확보, 바이오 공학기술에 따른 인간　생명윤리 및 개인의　사생활 보호 등의 문제가 제기될 수 있을 것이다.
기술발전에 부수해서　따르는 부작용의　문제를 더 나은 기술발전으로 해결할 수는 없다. 4차 산업혁명시대 형사정책의 원칙도 민주적인 절차와 제도로 발전되어야 한다고　본다. 지능정보기술 발전의 긍정적인 효과는 수용해야 하고 부정적인 영향에 대응하는 정책은 4차 산업혁명시대의 사회변화 속에서 삶의 질을 중시하는 국민의 안전과　자유권　확보에 집중해서 수립되어야 할 것이다. 물론 가상현실과 증강현실 등에　관한 기술개발자들　역시 자신의 창작물에 안전개념을 구축해야 할　것이다.
우리사회의 형사정책 전문가 역시 정보기반 디지털환경을 이해하고 활용할 수 있는 지능정보기술을 현실적인 문제해결에 적용하는 능력·정보흐름을 볼 수 있는 비판적인 사고 ·첨단기술의 사회 작동 원리에 대한 이해력 등 정보 네트워크 문해력인 디지털문해력(digital literacy) 배양이 요구된다.　국가정책 수립에 있어서도 형사정책적인 성찰에 의한 과제 해결 노력이 다른 분야의 노력과 결합해야 될 것이며, 개인정보보호 관련법들은 정보의 활용 보다는 보호에 비중을 두고 있는 편이어서 AI나 빅데이터 등 기술발전을 지연시킨다는 비판을　받고 있으나 개인정보보호와 경제가치로 환산되는 데이터를 보호할 수 있는 균형방안이 모색되어야 할 것이다.

영어초록

The Fourth Industrial Revolution is an industrial revolution in which compan ies converge manufacturing with ICT to enhance their work competitiveness, and refers to innovations in which physics and digital technologies converge with one another.
This is also symbolized by changes that eliminate the boundary between reality and cyberspace, which cannot be denied social substance because it is fully and swiftly experienced in terms of the scope and speed of change and is already positioned as a national social agenda.
It was put on the agenda at the Davos World Economic Forum in Switzerland in January 2016, drawing global attention, and the emergence of AI, robots, IOTs, autonomous driving vehicles, drones and 3D printing mentioned by Schwab is making it predicted that everything will converge.
The problem here is that the industrial revolution has driven both social and economic crises and opportunities, such as infringement of human values or threats to people's jobs and confusion caused by delayed acceptance, and that the technology of the fourth industrial revolution, which blends human physical space with virtual cyberspace, is human replacement technology.
Through the Fourth Industrial Revolution, can humans lead lives more humanly, happier, and safer? With the emphasis on convergence connectivity, isn't it rather that social polarization is deepening? It is also true that there are concerns about doing so.
Given that if divisive conflicts, such as polarization, intensify in our society, could cause a crisis in its governing function, there could be problems such as the government's role and criminal policy in dealing with the crisis, such as conflict management due to labor market and demographic changes, protection of information security and personal privacy due to the advent of Internet of Things, big data and non-rock chains, securing safety due to the advent of self-driving cars and drones, and drones, and biotechnology, and human ethics protection of individuals.
Better technological development cannot solve the problems of side effects associated with technological development. I believe that the principle of criminal policy in the era of the Fourth Industrial Revolution should also be developed into democratic procedures and institutions. The positive effects of the development of intelligent information technology should be accommodated and policies to cope with the negative effects should be established focused on securing the safety and freedom of the people who value quality of life amid social changes in the fourth industrial revolution era. Of course, technology developers on virtual reality and augmented reality will also have to build safety concepts in their creations.
Criminal policy experts in our society also need to cultivate digital literacy, a literacy skill in the information network, such as the ability to apply intelligent information technology to realistic problem-solving, critical thinking to see information flow, and understanding the principles of high-tech social operation.
Efforts to address the challenges of criminal policy reflection should also be combined with efforts in other areas in establishing national policies, and privacy laws are criticized for delaying technological advances such as AI and big data because they tend to focus on protection rather than the use of information, but balanced measures should be sought to protect data translated into personal information protection and economic value.
