초록

자율주행자동차는 4차 산업혁명의 대표적인 기술로서 국내외 여러 기업들이 자율주행자동차의 상용화를 위해 연구․개발을 촉진하고 있는 실정임에도, 자율주행자동차와 관련하여 현행 자동차관리법에서는 개략적인 정의와 임시운행허가의 근거만 존재하고 있을 뿐, 상용화의 전제가 되는 운행구역, 안전기준 등에 관한 법적 근거가 미비한 상황이다. 실재 자율주행자동차가 실생활에서 기존의 자동차처럼 운행되기 위해서는 많은 법적․제도적 뒷받침이 이루어져야 한다. 우리 정부도 2020년 level 3 단계 자율주행자동차의 상용화를 목표로 삼고 있는 상황에서, 국회차원의 이번 입법은 일단 법안이 담고 있는 내용과 수준에 상관없이 매우 반가운 일이다.
지금까지 없었던 최첨단 신기술이 우리 생활에 도입되어 개인의 삶에 편의성을 제공하여 객관적 삶의 질을 개선하고 궁극적으로는 주관적 삶의 질까지 개선하여 행복한 삶에 이르게 한다면 매우 바람직할 것이다. 이런 개인적 삶의 행복과 더불어 우리 사회에서 최첨단 신기술의 도입이 사회전체의 후생과 공공복리를 증진시키고, 생산성과 효율성을 극대화하여 국가경제의 발전을 견인한다면 그 나라의 개인, 사회, 국가 모두의 성장과 발전에 기여하는 것이다. 이러한 모두의 성장과 발전에 기여하기 위해서는 해당 신기술이 법적가치와 의미를 부여받아야 하며, 우리의 삶속에 적용되기 위한 법이 정한 절차를 거쳐야 한다.
이번에 발의된 “자율주행자동차 개발 촉진 및 상용화 기반조성에 관한 법률안”이 개인의 행복에 기여하고, 사회와 국가의 공공복리 증진 및 질서유지라는 헌법적 가치에 부합되는 방향으로 입안되어 본 법안이 제시하고 있는 목적대로 국민생활환경의 개선과 국가경제 발전에 이바지할 수 있는 법으로 거듭나길 기대한다.

영어초록

Although automated vehicles are the representative technology of the 4th Industrial Revolution and many domestic and foreign companies are promoting research and development for the commercialization of automated vehicles, the current "automobile management law" only has a basis for the general definition and temporary permit, but lacks legal basis for the operation areas and safety standards that are the basis for commercialization.
In fact, many legal and institutional support has to be provided for automated vehicles to operate like conventional cars in real life. With the Korean government also aiming to commercialize Level 3 automated vehicles by 2020, this legislation at the National Assembly level is very welcome, regardless of what the bill contains. It would be very desirable to introduce high-tech new technologies, which have never been found before, into our lives, to provide convenience in individuals' lives, thereby improving the quality of objective life and ultimately improving the quality of subjective life, leading to a happy life. Along with the happiness of personal life, if the introduction of state-of-the-art new technologies in our society enhances the welfare of society as a whole, public welfare and leads the development of the national economy by maximizing productivity and efficiency. this will contribute to the growth and development of individuals, society, the country. To contribute to the growth and development of all, these new technologies must be given legal value and meaning, and they must go through legal procedures to be applied in our lives.
We hope that the proposed bill – the Bill on Promotion of Development of Automated Vehicles and Establishment of the Foundation for Commercialization - will contribute to personal well-being and be drafted in a manner consistent with the constitutional values of promoting public welfare and maintaining order of society and the nation. Hopefully, this proposed bill will turn into a law that can contribute to the improvement of the national living environment and the development of the national economy as the purpose of the bill is presented.
