4차산업혁명 시대의 저작권 집중관리제도 개선에 대한 소고 (A Study on the role of the Collective Management of Copyright and Related Right organization in the era of the 4th industrial revolution)

초록

4차산업혁명 시대 기술과 서비스의 혁신은 현재의 저작권집중관리 제도가 여전히 유효한지에 대하여 의문을 제기하고 있다. 블록체인, 인공지능 등 각종 혁신적 기술은 개별관리의 가능성을 제시하고 있다. 집중관리제도는 이러한 환경변화를 인식하고 변화해 나가야 한다. 첨단 혁신기술을 선도적으로 응용하여 저작물 이용과 창작의 선순환구조를 창출해 낼 수 있어야 한다. 그러나 현재 위탁관리단체는 정부에 의한 강력한 진입통제, 사업 및 서비스 내용의 엄격한 법정화 등으로 인해 4차산업혁명 환경에 부응하여 저작권 산업의 경쟁력을 향상시키기에는 한계가 있다. 기술의 빠른 수용과 혁신적 서비스 창출은 경쟁을 통해 가능함에도 불구하고 저작권 집중관리의 기본적 정부정책은 엄격한 진입규제를 통한 소수 위탁관리업체의 독점 보장이다. 4차산업혁명이라는 ‘산업 혁명’이 ‘저작권 산업’에서 유발되기 위해서는 위탁관리단체의 규율에 대한 근본적 변화모색이 필요하다. 우선 지금껏 누려온 ‘독점’으로 인한 효율성이 여전히 유효하지 않다는 것을 전제로 저작권 위탁관리 시장에 유효 경쟁이 확보되도록 제도개선을 모색할 필요가 있다. 시장의 진입을 유연하게 하되, 가격결정의 자율성을 독려하고, 사전적 진입규제 보다는 사후 감독 중심으로 전환되어야 할 것이다. 이러한 유효경쟁이 달성되기 위해서는 일정한 기간이 소요되기 마련이다. 단기 방안으로 ‘신탁’ 중심의 저작권 관리시장에서 권리자와 이용자의 다양한 선택권이 보장되도록 혁신적 서비스가 제안될 수 있는 환경을 조성할 필요가 있다. 이를 위해 본 연구에서는 우선 수범자의 혼동을 방지하기 위한 ‘포괄적 대리’의 개념을 명확히 하고, ‘신탁범위 선택제’를 도입할 것을 제안하였다.

영어초록

The innovation of technology and services in the era of the 4th industrial revolution raises questions about whether the current Copyright Collective Management system is still in effect. Various innovative technologies such as blockchain and artificial intelligence offer the possibility of individual management, and cases of individual manage- ment of music are already emerging. The copyright collective manage- ment system should be changed to reflect these environmental changes. It should be possible to create a virtuous cycle of use and creation of works by taking the lead in applying cutting-edge innovative techno- logies. However, the current centralized copyright management system has limitations in improving the competitiveness of the copyright industry in response to the fourth industrial revolution environment due to strong entry control by the government and strict legalization of business and service contents. Although rapid acceptance of technology and creation of innovative services are possible through competition, the basic government policy of centralized copyright management is the monopoly guarantee of a few consigned management companies through strict entry regulations.. In order for the “industrial revolution” of the Fourth Industrial Revolution to be triggered in the “copyright industry,” it is necessary to seek a fundamental change in the rules of entrusted management organizations. First of all, it is necessary to seek system improvement to secure effective competition in the copyright entrusted management market, assuming that the efficiency due to the'monopoly' that has been enjoyed so far is still not effective. It should be flexible to enter the market, encourage autonomy in pricing, and focus on post-supervision rather than pre-entry regulation.. It takes a certain period of time to achieve such an effective competition. As a short-term plan, it is necessary to create an environment in which innovative services can be proposed so that various choices of rights holders and users are guaranteed in the “trust”-centered copyright management market. To this end, this study, first, proposed to clarify the concept of 'comprehensive proxy' to prevent confusion among those subject to the law, and to introduce a 'Selective Management System'.
