정보활동에 관한 경찰관 직무집행법 개선 방안 (A Study on the Improvement of the Police Officer's Duty Execution Act for Intelligence Operations)

초록

경찰의 정보활동은 경찰 임무의 효과적인 수행에 있어 중요한 수단이 된다. 경찰관 직무집행법 제2조는 정보활동과 관련하여 제4호에서 치안정보의 수집작성 및 배포를 경찰관의 직무로 명시하고 있다. 제4호를 둠으로써 경찰이 치안정보와 관련하여 정보활동을 할 수 있음은 분명히 확인되고 있지만 그 외에 정보활동에 관한 규정이 체계적으로 갖추어져 있지는 않다. 이러한 입법 상황에서 치안 및 치안정보의 개념과 범위 등에 관한 논란이 있고, 경찰 정보활동 실무에 대한 사회 일부의 비판은 여전하다. 경찰작용의 목적과 법치주의가 조화를 이루는 경찰 정보활동을 위해서는 우선 제4호를 비롯하여 현재의 경찰관 직무집행법 규정을 정확히 해석하고 엄격히 준수하려는 노력이 요구된다. 그러나 현행 법제에 터잡은 정보활동이 계속 논란이 된다면, 보다 적극적으로 입법적 개선도 고려해 볼 수 있을 것이다. 이 글은 정보활동과 관련한 경찰관 직무집행법의 개선을 검토함으로써 적법·타당한 경찰 정보활동에 도움이 되도록 함에 그 목적이 있다.
이 글에서는 경찰관 직무집행법이 정하고 있는 경찰 임무와 관련된 정보활동을 중심으로 그에 대한 적절한 임무지정과 그에 따른 권한의 입법적 개선을 연구한다. 이 범위를 벗어나 어떤 국가적 정보활동을 경찰 혹은 다른 국가기관에게 맡겨야 하는가와 같은 –정책적 판단 및 결정을 요하는- 문제에 대해서는 다루지 않는다.
정보활동에 관한 경찰관 직무집행법의 개선을 논하기 위해서는 정보활동에서 임무규범이 갖는 의의 및 기능, 치안정보의 수집･작성 및 배포를 정한 제4호 등 경찰관 직무집행법 제2조의 의미와 내용에 대한 고찰이 전제되어야 하지만, 이에 대해서는 다른 글에서 이미 상세히 다루었기 때문에 이 글에서는 간략하게만 언급하고 주로 임무규범의 구체적인 개선 방안과 권한 규정의 보완 방향을 검토·제안하고 있다.

영어초록

Police intelligence operations are an important means for the effective performance of police duty. In relation to intelligence operations, Article 2 No. 4 of the Police Officer's Duty Execution Act specifies the collection, creation and distribution of public safety information as the duty of police officers. It is clearly confirmed that the police can do intelligence operations related to public safety information by establishing No. 4, but there are no other systematic regulations on intelligence operations in the Act. In this legislative situation, there is a controversy about the concept and scope of public safety and public safety information. For police intelligence operations that harmonize the purpose of police action with the rule of law, it is necessary to exactly interpret and strictly observe the current regulations of the Act, including No. 4. However, if intelligence operations based on the current legislation continue to be controversial, legislative improvements can be considered more actively. This article aims to help the legitimate and reasonable intelligence operations of the police by reviewing the improvement of the Act for intelligence operations.
In this article, we study the appropriate duty designation and legislative improvement of the authority for the intelligence operations that are established as police duty by the Act. We do not deal with issues such as what national intelligence activities should be left to the police or other national agencies. These require policy-level judgments and decisions, and are beyond the scope of this review.
In order to discuss the improvement of the Act on intelligence operations, it is necessary to consider the meaning and function of the duty norms on intelligence operations and the meaning and contents of Article 2 of the Act, which includes No. 4 that stipulates the collection, creation and distribution of public safety information, However, this is mentioned only briefly in this paper because it has already been covered in detail in another paper. In this paper, we mainly review and propose improvement measures for duty norms and the complementary directions of authority regulations for intelligence operations.
