질적 연구를 통한 전임 교종의 도입방식에 관한 연구 (A Study on the Introduction of Full-Time Prison Chaplin Through Qualitative Research)

초록

본 연구에서는 교정시설에서 종교인의 수용자에 대한 종교교화의 방식인 자원봉사자로서의 비전임 교종인 종교위원제도의 고착되어온 다양한 문제점에 대한 경로혁신적 방안의 하나로 전임교종(矯宗)의 도입의 필요성과 도입방식에 대한 방안을 모색할목적으로 서술되었다. 이를 위하여 전임교종제의 도입에 있어 이해관계자인 교정공무원 경력자들에 대한 질적 연구방법을 통해 현장의 생생한 의견과 인식을 자연스럽고개방적 맥락에서 심층적으로 수집하고 분석함으로써 보다 실효적인 정책의제화와 입법화의 실현에 기여할 수 있는 실천적 방안을 서술하였다.
특히 2009년에 법무부가 전임교종제를 도입하려다가 찬･반이 비슷해 제도도입을보류한 상태이므로 법적, 과학적 근거만 충분히 입증되면 제도의 입법화가 가능한 상태이다.
그런데 전임교종의 필요성에 관한 선행연구들이 추상적이거나 종교적 차원이어서과학적･실천적 근거가 부족한 점에 착안하여 본 연구에서는 과학적 접근의 하나로 실증적 연구인 질적 연구를 통해 전임교종의 필요성과 도입방식의 정책적 방안을 제시하였다. 연구결과 현재의 자원봉사식의 비전임 종교위원제도의 고질화된 문제점에 대해 모든 연구 참여자들이 깊이 인식하였으며 근본대안으로 전임교종제도의 도입의 필요성에 대해 공감하였다. 다만 전임교종제의 도입방식인 채용형식 등에 대해서는 여러 의견이 있으므로 법무부는 이해관계자인 교도관과 종교위원들에 대한 과학적인 설문조사를 통해 보류되어왔던 전임교종제의 도입여부에 대해 면밀한 검토를 할 시기가되었다. 특히 전임교종제의 도입에 큰 거부점이 없고 종교계, 학계 등 접근점(access point)이 강한 상태이므로 조속히 정책의제화를 통해 전임교종제를 실시하는 것이 헌법이념과 비교법적 차원 및 종교교육형주의의 실효성 확보에서 필요하다.

영어초록

This paper was written the aim of preparing measures for the necessity and method of introduction of the full-time prison religious committee practiced in developed countries as one of path-breaking measures about the various problems of a non-executive member of a prison religious committee.
Therefore, I described practical measures that could contribute to the realization of policy making and legislation of it by analyzing vivid opinions in a natural and open context through qualitative research method on experienced correctional officers in introduction of a full-time prison religious committee.
I pointed out various problems of the introduction debate of the full-time prison religious committee attempted by the academic and religious circles after describing the significance and history of the full-time prison religious committee in a political and religious context and pointing out the problems of non-executive member of prison religious committee. In 2009, the justice department tried to introduction of it. but put it on hold.
Therefore, the full-time prison religious committee can be legislated once the legal, scientific grounds have been fully established. Therefore, I asserted the necessity of introducing it and the practical method of introduction as one of the scientific approaches based on lack of scientific, practical evidence due to the emotional dimension of the existing introduction movement of it.
As a result of this study, all participants were deeply aware of the chronic problems of the non-executive member of prison religious committee and agreed on the need to introduce the full-time prison religious committee system as an basic alternative.
Therefore, the justice department needs to conduct a thorough examination of whether to introduction the full-time prison religious committee through an investigation into correctional officials and so on. Implementing the full-time prison religious committee by the justice department through policy making of it in necessary in securing the effectiveness of the constitutional ideology and religious education penalty for inmates.
